Private Preferences for Public Goods: Towards a Model for the Interaction of Pressure Group and Electoral Politics

This essay explores two contrasting paradigms of collective action in the context of some observed anomalies in the development of the welfare states, focussing on private interest mod& of public expenditure growth versus models emphasising social choice and the degree of congruence between the political responsiveness of interest groups to the public expenditure crisis since the early 1970s, and the assumptions underpinning these models on political behaviour in the mixed economies. A bifurcation of the political system, resulting from the development of systems of functional interests representation alongside parliamentary and representative government, gives rise to a potential for strong governments to maintain regime support because of, rather than despite, the political fragmentation of majorities.     

DIVORCE MEDIATION: Research and Reflections

Mediation and other forms of alternative dispute resolution (ADR) grew rapidly in the last few decades as a result of high divorce rates, frequent conflicts between parting parents, the resulting administrative burden on courts, and especially concerns about damaging effects on children and postdivorce family relationships. This article focuses on our longitudinal research involving randomized trials of mediation and adversary settlement to support the conclusions that mediation can: (1) settle a large percentage of cases otherwise headed for court; (2) possibly speed settlement, save money, and increase compliance with agreements; (3) clearly increase party satisfaction; and (4) most importantly, lead to remarkably improved relationships between nonresidential parents and children, as well as between divorced parents—even twelve years after dispute settlement. The key "active ingredients" of mediation are likely to include: (1) the call for parental cooperation over the long run of co-parenting beyond the crisis of separation, (2) the opportunity to address underlying emotional issues (albeit briefly), (3) helping parents to establish a businesslike relationship, and (4) the avoidance of divisive negotiations at a critical time for family relationships. We call for more research on mediation and other forms of ADR, as well as a renewal of the excitement and optimism of the "first generation" of mediators, qualities that are "active ingredients" in any successful social or psychological intervention.     

Criminal justice theory: A case of trained incapacity?

Theories are scientific tools which give meaning to the social and physical reality that scientists study. They also play a crucial role in generating and storing the information of a discipline. The academic field of criminal justice has a wealth of facts but a dearth of theory. As a result, this field is still only partially developed. This article is a call for greater attention to theory so that the analysis of the criminal justice system and its components can be more fruitful.A survey of 25 criminal justice textbooks published since 1975 shows that the analysis of criminal justice retains a facts-without-theory flavor. For criminal justice as an academic field of study to grow, theory must be integrated much more into criminal justice research and education than has been the case. The theoretical frameworks of such social theorists as Durkheim, Marx, and Weber, among others, are suggested as sources to draw upon to develop an integrated comprehensive theory of the criminal justice system.     

The CAFTA Conflict and Costa Rica's Democracy: Assessing the 2007 Referendum

The process of ratifying CAFTA in Costa Rica required traversing a contentious political landscape involving intense legislative battles, massive public demonstrations, and finally a national referendum in October 2007. By employing the mechanism of direct democracy to ratify a free trade agreement, Costa Rica made history. But how did this experiment with direct participation affect Costa Rica's democracy? This article evaluates what the referendum achieved in terms of promoting citizen engagement, equipping voters to make informed choices, resolving the CAFTA conflict in a way viewed as legitimate, and shaping citizens' relationships to representative institutions. While the referendum had positive effects, it had several negative consequences for representative democracy, which raises questions about the limits of democratic control over economic policy in the era of globalization.     

Correlates of Substantiated Emotional Maltreatment in the Second Canadian Incidence Study

The objective of this study was to determine the correlates of substantiated psychological maltreatment (PMT) in Canada on functions of maltreatment characteristics, child profile, household profile, and child protection services interventions. This study is based on a secondary analysis of data collected in the second Canadian Incidence Study. PMT investigations were categorized into six groups: emotional abuse, emotional neglect, and other maltreatment as single form, and these same three groups when they co-occurred with another form of maltreatment. Six logistic regressions, comparing all pairs of groups, were carried out. Cases of PMT (single form) were more chronic and associated with greater adverse emotional impact than other forms of maltreatment. Mothers of psychologically maltreated children had more mental health issues. Emotional neglect cases were more complex (e.g., substance abuse, mental health, and social housing). The three co-occurrent groups present more negative factors but more risk factors are observed when PMT are also observed (e.g., emotional harm, alcohol abuse, housing problems, chronicity, and referral to other services).
