The aim of this paper is to evaluate how infostructure has been reformed in the liberalisation process of network industries, which has involved third party access to the network through a comparison of the electricity, railway, and civil aviation sectors in Switzerland. Our theoretical argument posits that infostructure is a missing link in the study of the regulation of liberalised network industries. Infostructure is defined as the control and command services that are necessary for monitoring the access to and optimising the uses of infrastructure. Our empirical comparison of the sectors aims at answering the principle question: What is the impact of the management of infostructure on the liberalisation process and the structure of liberalising markets? This study of the liberalisation of network industries in Switzerland highlights the potential strategic function of infostructure in the context of opening to competition and internationalising markets. Infostructure management can impact infrastructure ownership and service operation in terms of market structure and constrain access to the infrastructure and the market. Infostructure could also weaken the capacity to regulate the entire sector from regulatory agencies, particularly when self‐regulatory arrangements control third party access to the network. 相似文献

Academic debate on public utility regulation has considerably evolved over the past 50 years. The conflict between the supporters
of franchise regulation and commission regulation has given way to much more balanced in-depth analyses. Regulation is defined
on the basis of its structure but also its scope and regulation incentives. A regulation mode must above all be evaluated
with regard to the institutional environment. We propose a neo-institutionally-inspired analysis framework and show how the
dynamic relationship between regulation and the institutional environment can lead to reforms and ultimately to more efficient
regulation. The findings of a French water utility sector analysis underline how a series of national normative reforms and
local exploratory reforms can give rise to innovations in the regulation mode. This new hybrid regulation, between commission
regulation and franchise bidding, could be more effective than previous regulation mode, i.e. more stable and in line with

Amniotic fluid embolism (AFE) continues to be one of the most feared complications of pregnancy. A healthy 32-year-old woman died during delivery after a normal 39-week third pregnancy. The family filed a complaint with a criminal court as the causes of death appeared unclear. No risk factor associated with AFE was identified. Clinical presentation was typical, including sudden onset of cardiovascular and respiratory symptoms. Autopsy confirmed the histological diagnosis of amniotic embolism and excluded an iatrogenic cause of death or anesthetic malpractice. This article highlights the value of both antemortem records and histological features in establishing the diagnosis of AFE and demonstrates the fundamental importance of autopsy in an unexpected death related directly or indirectly to a medical procedure. 相似文献

Governments continue to play a central role in the way research is conducted and organized by defining new models for research
centers. How do existing research centers adapt to changes in their environment? Institutional theory suggests that organizations
pursue efficiency and legitimacy by conforming to isomorphic pressures in their organizational field, which will eventually
lead to a reduction of diversity in organizational practices and strategies. Resource-dependence theory assumes a more active
agency and calls attention to the diverse strategic responses of organizations to institutional processes. Based on funding
microdata and qualitative information at center level, this study undertakes to analyze changes in two populations of Spanish
research centers (government laboratories and technology centers) in a time of evolving policy paradigms, emergence of new
models for research centers, and increasing competition in the field of R&D. We find that a large share of the existing government
laboratories and technology centers have progressively conformed to a funding strategy based on diversifying sources and increasing
competitive public funding, although both populations are still characterized by some degree of internal diversity regarding
funding portfolios. Structural heterogeneity also remains as regards management practices such as research planning and agenda

Knowledge transfer from science to industry has been shown to be beneficial for the corporate partner. In order to get a better understanding of the reasons behind these positive effects, this study focuses on the junction of science and industry by comparing characteristics of academic inventions that are transferred to industry and those staying in the public sector. Academic inventions are identified via patent applications of German academic scientists. We find that academic patents assigned to corporations are more likely to enable firms reaping short term rather than, possibly more uncertain, long-run returns, in contrast to patents that stay in the public sector. Firms also strive for academic inventions with a high blocking potential in technology markets. Academic patents issued to corporations appear to reflect less complex inventions as compared to inventions that are patented by the public science sector. 相似文献

Currently, pharmaceutical companies' utilization of foreign clinical trial data is a ubiquitous and indispensable aspect of gaining approval to market drugs in the United States. Cost benefits, a larger pool of ready volunteer subjects, and greater efficiency in clinical testing are some of the reasons for conducting clinical trials overseas. Despite these advantages, lack of proper oversight may have serious public health implications regarding the integrity of clinical research, ethical treatment of human subjects, and drug safety. Due to the expansive global nature of foreign clinical trials, there are concerns with the FDA's ability to monitor and regulate these trials. This article examines the FDA's oversight of foreign clinical trials and the agency's limitations regulating these trials. In addition to looking at steps the FDA is taking to address these limitations, the article examines other potential regulatory and cooperative actions that can be taken to effectively monitor foreign clinical trials and to ensure data integrity and patient safety. 相似文献

Using original French panel data, this paper investigates the relevance of the broken windows theory in case of an offence
category featured by the absence of monetary benefits. Estimates from random and fixed effects models highlight the deterrent
effect of sanctions for rapes and minor sexual offences. The enforcement activity of rapes is the most deterrent factor both
for rapes and other sexual offences, compared with the rapes- and minor sexual offences-reducing impact of an increase in
the enforcement activity for minor sexual offences. Our results cast doubt on the broken windows theory. From a normative
perspective, it would be more efficient to deter the authors of rapes rather than those of less severe sexual offences. 相似文献
