The growth of mass media has complicated the relatioship between the courts and the media. Free press and fair trial rights are kept in balance by the use of judicial restraints and remedies such asvoir dire, change of venue, and gag orders. This balance has shifted back and forth during the past two decades. Current case law and legal codes are inconsistent and provide insufficient guidance to judges in their use of restraints and remedies. Nor is there a body of empirical research on the impact of news coverage and juror behavior capable of informing the courts at this time. In this paper, we review and critically assess the empirical social science literature as it pertains to the legal issues involving free press and fair trial. We argue that carefully conducted empirical research could provide important information to the courts. We suggest research directions and methodological caveats to increase legal relevance and scientific validity.  相似文献

A number of recent international situations have raised again questions regarding the usefulness of economic sanctions as an instrument of foreign policy. Sanctions continue to be applied in a variety of contexts, yet we have not developed a sufficient understanding of the processes involved to determine when, or even if, sanctions can "work." While a great deal has been written on the subject, there have been neither attempts to subject the theoretical arguments to empirical testing nor efforts to provide systematic theoretical explanations for the empirical results that have been produced. In this article, we attempt to address this shortcoming in the literature. We propose a theory of sanctions effectiveness that is based on the spatial model of bargaining in international crises and use this theory to derive a number of hypotheses regarding when sanctions should produce favorable policy outcomes. We then subject some of the derived hypotheses to an empirical test based on a large number of international disputes. The model suggests that while sanctions will not work in many cases, they can have a slight effect on the distribution of expected outcomes if the costs of the sanctions are sufficiently high relative to the values at stake. The available evidence appears to support these expectations.  相似文献

Do protests sway public opinion? If so, why and how? To address these questions, we examine the impact of the 2006 immigration protests on immigration policy preferences. We use the 2006 Latino National Survey coupled with protest data to examine whether temporal and spatial exposure to the protests are associated with policy preferences. Our findings lend evidence that protest activity influences Latinos’ immigration policy preferences. However, the findings suggest the effect of protest on immigration policy preferences is not uniform across the population, but rather contingent on generational status and the intensity of protest activity at the local level.  相似文献

Witnessing violence is one adverse childhood experience (ACE) associated with living in impoverished Black urban communities. Youth with higher violence avoidance self-efficacy and positive coping are more likely to avoid violence. This study evaluates educational entertainment (edutainment) as an intervention with Black adolescents exposed to community violence. Edutainment has shown success in increasing self-efficacy and positive coping skills in other domains. Self-administered scales were used to measure stress, anxiety, violence avoidance self-efficacy, and coping strategies. Data were collected pre- and nine days post-interventions/no intervention from 20 subjects receiving the edutainment intervention, 19 subjects participating in a group discussion about violence, and 21 subjects receiving no intervention (N?=?60). Edutainment and no intervention were more effective than group discussion alone in increasing violence avoidance self-efficacy. Violence avoidance self-efficacy was found to have an intervening relationship between edutainment and the outcome of stress. This study indicates limited but positive effects for edutainment.  相似文献
