The Strategic Fears of the Ruling Class: The Construction of Queensland's Chinese Immigrants Regulation Act of 1877

In early 1877, there were no immigration restrictions in any of the Australian colonies. Queensland's Chinese Immigrants Regulation Act of 1877 was the first of many laws that restricted Chinese immigration, in a movement that ultimately led to the White Australia legislation of 1901–2. This article finds that, contrary to the hegemonic understanding of White Australia, there was no significant working class or popular pressure behind the passage of the Act. Instead, it reflected the agendas of Queensland's elite, and in particular their concern that the large influx of Chinese people to the Palmer River goldfield could threaten their strategic control of Far North Queensland. In support of anti‐Chinese laws, Queensland's conservative newspapers whipped up fears of a Chinese “invasion”, a theme that would continue for nearly a century.     

A molecular genetic approach for forensic animal species identification

This study investigated potential markers within chromosomal, mitochondrial DNA (mtDNA) and ribosomal RNA (rRNA) with the aim of developing a DNA based method to allow differentiation between animal species. Such discrimination tests may have important applications in the forensic science, agriculture, quarantine and customs fields. DNA samples from five different animal individuals within the same species for 10 species of animal (including human) were analysed. DNA extraction and quantitation followed by PCR amplification and GeneScan visualisation formed the basis of the experimental analysis. Five gene markers from three different types of genes were investigated. These included genomic markers for the beta-actin and TP53 tumor suppressor gene. Mitochondrial DNA markers, designed by Bataille et al. [Forensic Sci. Int. 99 (1999) 165], examined the Cytochrome b gene and Hypervariable Displacement Loop (D-Loop) region. Finally, a ribosomal RNA marker for the 28S rRNA gene optimised by Naito et al. [J. Forensic Sci. 37 (1992) 396] was used as a possible marker for speciation. Results showed a difference of only several base pairs between all species for the beta-actin and 28S markers, with the exception of Sus scrofa (pig) beta-actin fragment length, which produced a significantly smaller fragment. Multiplexing of Cytochrome b and D-Loop markers gave limited species information, although positive discrimination of human DNA was evident. The most specific and discriminatory results were shown using the TP53 gene since this marker produced greatest fragment size differences between animal species studied. Sample differentiation for all species was possible following TP53 amplification, suggesting that this gene could be used as a potential animal species identifier.     

Foreign,criminal: a doubly damned modern British folk-devil

An association of strangers with danger and criminality is one of the most enduring social myths. However, in the UK, it was only after a media outcry 10 years ago over the release of foreign nationals from British prisons, that the ‘Foreign Criminal’ exploded into political and popular consciousness. Despite the small numbers of people involved, the location of this folk devil at the intersection of legal and moral assessments of ‘wickedness’ and alterity imbues it with considerable potency and has ensured that its reverberations are still felt strongly a decade later. Drawing on qualitative research with immigration detainees, deportees and irregular migrants, the article considers some of the many faces of the Foreign Criminal and illuminates their racialised, classed and gendered natures. It argues that a twin set of developments – coalescing around Operation Nexus and curtailed Article 8 right protections – work together to taint a growing number of non-citizens with criminality, whilst simultaneously undermining their claim to belong. Case studies are presented to demonstrate the fault lines of this malleable and expanding category, and to argue that the Foreign Criminal is paradigmatic of both social disorder and national boundaries, and is fundamentally shifting the lines of citizenship and belonging.     

Death in birth

The number of women in poor countries who die in childbirth has barely changed in two decades--and this despite a host of medical breakthroughs. How can the incidence of this devastating human tragedy be reduced?     

Reconfiguring Law: An Ethnographic Perspective from Botswana

Using two marital disputes, this article examines women's experiences in bringing legal claims regarding family property in Botswana. It highlights the ways women draw on diverse economic and social resources available to them through their differing positions within gendered social networks that shape daily life and affect the ability to access and manipulate a legal system incorporating Tswana customary law and European law. The divergent discourses among women and between women and men document how the administrative and theoretical separation of legal systems does not extend to people's uses of the law in arranging their own lives. This analysis challenges the formalist model of legal pluralism by demonstrating that legal arguments are constructed from the gendered social and economic facts of individuals'lives that traverse the legal categories of European and customary law. It also contributes to feminist legal scholarship by explicitly marking the links among gender, power, and law.
