This article tests the hypothesis that parties in West European parliamentary systems operate under the constraint of "policy horizons," that is, limits or bounds on the extent to which they can compromise on policy for the purpose of entering coalition governments. The test is based on a new expert survey covering thirteen West European parliamentary democracies in which respondents were asked not only to locate party positions on a number of policy dimensions, but also to estimate the parties' limits of acceptable compromise on each dimension. The survey data are first analyzed using a new computer program, Horizons 3D, to determine which parties have intersecting horizons in these systems—and hence the ability to form coalition governments under the hypothesis. These calculations are then employed to assess whether policy horizons structure the choice of governing coalition beyond any effect conveyed by the policy distances among parties. This paper questions the conventional view of F. A. Hayek as a reviver of 'classical liberalism'. It argues that the foundation of Hayek's doctrine is a naturalist or physicalist conception of man which is at variance with the classic tenets of liberalism. It shows how Hayek's theory of society and of the abstract rules that ought to govern society are partly a continuation and partly a contradiction of his physicalist notion of man. After considerable debate about whether a democratic South Africashould be constituted on federal lines, the 1996 Constitutionadopted three "distinctive, interdependent and interrelated"spheres of government. "Co-operative government" followed theGerman model, emphasizing concurrency, provincial delivery ofnational policies, and provincial representation at the center.Implementing this model, with new institutions, actors, andprocesses, has proved difficult because the governing partystrongly favors a relatively centralized polity, and becauseprovinces and local governments have weak political, administrative,and fiscal capacities. This concept paper emerged from a Law and Human Behavior (LHB) Workshop, that was called by the journal's Editor, Richard Wiener, and held at St. Louis University on March 19–21, 1999. This workshop, which brought together 22 scholars and researchers in legal psychology, was part of James Ogloff's Presidential Initiative Project for the American Psychology/Law Society, and was supported by St. Louis University and an NSF grant. Prior to our arrival, each participant answered queries from the Editor about LHB and the field of psychology and law, and each was asked to offer five topics that were underrepresented in the journal or that we would like to see addressed in future issues. At the workshop, we were assigned to small groups, and the authors of this paper constituted one such group. The charge for all groups was to develop plans for encouraging submissions in areas of psycholegal scholarship that continue to be infrequent topics of investigation, and then to develop a concept paper. The direction our group took is captured by our title, Everyday Life and Legal Values, and within this paper we explicate the topic, identify a number of underrepresented research areas, suggest some research paradigms for investigating them, and present this within a perspectival directions frame that ties established lines of research to the newer ones we propose. 相似文献
