司法鉴定特性及鉴定体制改革的构想

随着科学技术的迅猛发展和法制力度的增强,繁重的司法鉴定与我国目前鉴定体制出现了诸多不相适应的问题,迫切需要改革和完善。需要我们从本质上认识和思考司法鉴定的特性和特点,建立一套符合司法鉴定规律的鉴定体系。     

过敏性反应死亡法医病理学研究

目的 探讨过敏性反应死亡的法医病理学特点，从而解决困扰法医学工作者对过敏性反应死后诊断的鉴定要点。方法 对华西法医鉴定中心1995--2004年尸检检出的26例药物过敏性死亡案例进行回顾性分析。结果 本组26例药物过敏所致死亡案例的死者年龄以31—40岁的例数最多．占了38％；26例因药物过敏所致死亡的案例中，12例为青霉素类药物过敏，为引起过敏最常见的药物；而药物使用途径引起过敏反应死亡的案例中以注射为主，共20例；以个体诊所及基层医院多发生过敏反应死亡的案例；18例在使用药物后出现典型的严重的过敏性反应的临床表现；15例为在用药后半小时内发生死亡；病理解剖可见咽喉粘膜水肿20例，其中咽喉腔阻塞大于75％2例，50．75％5例，25-50％7例，小于25％6例，显微镜下检查嗜酸性粒细胞浸润咽喉粘膜者21例、肺组织18例；6例血清IgE检测值呈现出显著的升高。结论 过敏性反应的死后诊断应结合死者的生前临床病史，死亡时间，生前临床表现，病理解剖发现及血清IgE检测值综合分析。     

证据学是一门法学吗——以研究对象为中心的省察

通过对十年来我国证据法学研究在知识的增长方面进行量化的考察,结果显示:一方面,我国证据法学研究大部分仍然游离于法学与自然科学之间,这种研究既不能增长自然科学方面的知识,也无法增长法学方面的知识;另一方面,在有可能增长法学知识的领域,证据法学却又依附于法学的其他门类,从而丧失了自身独立存在的价值。方法论训练的缺乏及学术研究能力的有限,是造成这些现象的根本原因。因此,为使证据法学成为一门独立的法学学科,必须加强研究者的方法论训练,从而提高该学科在增进法学知识方面做出贡献的能力,并朝着建立统一的证据法学理论的方向努力。     

宫内节育器使用所致医疗纠纷法医学鉴定

在法医鉴定中,由宫内节育器引发的医疗纠纷案例逐年增加,患者法律保护意识、医务人员的技术水平较低是此类鉴定增加的主要原因。目前宫内节育器仍然是我国妇女避孕的主要途径之一,宫内节育器医疗操作中可能发生的并发症或意外及其与医疗行为的关系,医院是否需要承担责任及责任大小等均需要明确。加强医生技能训练,采取必要的防范措施,客观评价和认识宫内节育器诊疗中的并发症,才能确保计划生育工作宫内节育器的安全可靠。
