Reconceptualising the Custody Threshold in England and Wales

The custody threshold provision in England and Wales was intended to operate as a limit on the use of custodial sentences, preserving what is the system’s most severe sanction for the most serious offences. However over the past few decades it has become apparent that the custody threshold is failing. Academics have discussed the reasons for this failure, which has seen the prison population double in space of a quarter of a century. This piece explores the custody threshold in the context of the use of custody in other Western European jurisdictions. It examines the courts’ response to the provision and various judicial attempts to amplify Parliament’s language. The authors then consider the academic critiques of the custody threshold provision, analysing the extent to which said criticism can be seen as a solution to the problem, before offering a new critique of their own. Finally, in a move towards more a more principled approach to the custody threshold, the piece offers a solution which would, it is argued, make the provision more effective and more theoretically sound.     

The Effect of Body Mass on Outdoor Adult Human Decomposition

Forensic taphonomy explores factors impacting human decomposition. This study investigated the effect of body mass on the rate and pattern of adult human decomposition. Nine males and three females aged 49–95 years ranging in mass from 73 to 159 kg who were donated to the Complex for Forensic Anthropology Research between December 2012 and September 2015 were included in this study. Kelvin accumulated degree days (KADD) were used to assess the thermal energy required for subjects to reach several total body score (TBS) thresholds: early decomposition (TBS ≥6.0), TBS ≥12.5, advanced decomposition (TBS ≥19.0), TBS ≥23.0, and skeletonization (TBS ≥27.0). Results indicate no significant correlation between body mass and KADD at any TBS threshold. Body mass accounted for up to 24.0% of variation in decomposition rate depending on stage, and minor differences in decomposition pattern were observed. Body mass likely has a minimal impact on postmortem interval estimation.     

Less Government, More Secrecy: Reinvention and the Weakening of Freedom of Information Law

Many critics have suggested that worldwide efforts to reinvent government could also weaken democratic control over public institutions, but few have considered how attempts to implement the "new paradigm" in public management might affect a widely used instrument for promoting accountability: freedom of information law (FOI). FOI laws give citizens and nongovernmental organizations the right of access to government information. However, recent Canadian experience shows that reinvention can weaken FOI laws in three ways. First, attempts to reduce "nonessential" spending may cause delays in handling FOI requests and weaken mechanisms for ensuring compliance. Second, governmental functions may be transferred to private contractors and not-for-profit organizations that are not required to comply with FOI laws. Third, governments' attempts to sell information and increase FOI fees may create new economic barriers to openness. Thus, restructuring provides an opportunity for political executives, public servants, and some well-organized business interests to weaken oversight mechanisms and increase their own autonomy within the policy process.     

A death involving probenecid.

A death following deliberate ingestion of approximately 75 g of probenecid in a 36-year-old man is described. Tissue concentrations of probenecid were highest in serum (710 mg/L) and liver (550 mg/kg). Probenecid was also detected in vitreous and bile. Ethanol was also detected in blood at 0.13 g/100 mL.     

UK policy coordination during the 1990-91 intergovernmental conference

Despite the importance of European Union negotiations, the majority of scholarly attention has not been directed towards the means by which policy is coordinated in member states. This article addresses one aspect of this gap by focusing upon the structures which existed for UK policy making during the 1990-91 IGC negotiations. Particular emphasis is attached to the key role of officials, who often proved crucial to the extraction of compromises at the European level, and the manner by which policy was constrained by the inability of the Prime Minister to dominate Cabinet.

This is a review of four books by Leonard White: The Federalists (1948), The Jeffersonians (1951), The Jacksonians (1954), and The Republican Era (1958). In these books, White develops an approach to the study of administrative development that accounts for a broad range of considerations, including political and economic structure, the organization of the international order, popular culture, the stock of available communication and organizational technologies, and executive talent. White also offers an early argument about the significance of path dependence in institutional evolution. White's approach is largely concerned with the macrodynamics of administrative development. It has been neglected within the field of public administration over the last half century. A literature that builds on White's work would improve the field's ability to explain and anticipate failures in state building and administrative reform.
