The paper analyzes how institutional elements affect the decision to file of risk neutral agents. In particular, we introduce an objective probability of winning given by the combination of a precedent-weight parameter (defining the type of legal system) and a transparency factor. 603,000 simulated trials, shaped upon our model, reveal two main findings: (1) the transparency level matters in terms of inefficient decisions; (2) a precedent driven system is not necessarily more efficient. Hence, policy makers should invest in increasing the level of information among courts and between courts and the parties both in civil and common law systems.  相似文献

Two direct ethanol metabolites, namely ethyl glucuronide (EtG) and cocaethylene (CE), in the hair of cocaine (COC) users were compared in this study. Hair samples (n=68) were submitted to the determination of EtG (by liquid chromatography-electrospray-tandem mass spectrometry) and of COC and metabolites, including CE (by gas chromatography-mass spectrometry). Quantitative and qualitative results were compared. No quantitative correlation was found between EtG and CE, as well as between EtG and the cocaethylene concentration divided by the concentration of COC and its metabolites (benzoylecgonine and ecgonine methylester, as COC equivalents). Nevertheless, many factors are supposed to affect the amount of the two substances incorporated in the hair matrix, such as the subject's habits in ethanol and COC use, genetic variability in the metabolism of both substances, and the different chemical and physical properties of EtG and CE. When establishing a cut-off of 4 pg/mg for EtG and of 200 pg/mg for CE, 47 samples tested positive for EtG and 41 samples tested positive for CE; 12 samples out of the 47 EtG-positives tested negative for CE (25%), whereas 6 samples out of the 41 CE-positives tested negative for EtG (15%). According to these data, EtG appears to be a more sensitive and specific marker of non-moderate alcohol users than CE.  相似文献

The paper focuses on the application of a particular conception of the rule of law to situations characterized by traditional local justice and legal pluralism. While in the twentieth century international rule‐of‐law programmes were directed almost exclusively at state legal system, they have recently begun to take into account traditional local justice, namely, those institutions which in many world regions represent the main form of effective justice. Starting with a review of the positive and negative aspects of traditional local justice from a rule‐of‐law perspective, the paper underlines the widespread lack of protection of human rights, particularly of women’s rights. Discussing vertical rule‐of‐law functions in contexts of legal pluralism the paper stresses the advantages of an approach to the promotion of the rule of law based on mutual recognition and influence between different legal authorities and sources. It is argued that this “interactive” approach appears best suited to the complex frameworks of relations that characterize present‐day systems of deep legal pluralism. Finally, the paper underlines the correspondence between this approach and a conception of the rule of law as an ideal framework of plural interactions characterized by the limits imposed on the law by the law itself, and it discusses its advantages from the perspective of human rights and women’s rights promotion.  相似文献

The appointments of Colin Powell and Condoleezza Rice to the positions of Secretary of State and National Security Advisor, respectively, represented a significant breakthrough in terms of the participation of black Americans in US foreign policy construction. Their appointments, for a number of publics, raised issues about the relationship between race and US foreign policy, and whether either Powell or Rice could or would represent at any level a black consensus on foreign policy. This tension was heightened by the events of September 11, which led to the most sweeping transformation of US foreign policy in perhaps half a century, a transformation in which Powell and Rice played decisive roles. This article argues that while race has played a symbolic role in how the black community and others have perceived Powell and Rice, it has played no role in their substantive participation in the Bush administration's foreign policy initiatives.  相似文献

In the New Property Rights model ownership of assets should be assigned to the most capable agents. While, in a world of incomplete contracts, the application of the model to IPRs provides insights on the nature of their second best allocation, suggesting a direction of causation going from technology to property rights, also the opposite direction of causation may arise: owners of IPRs tend to develop more capabilities in the production of new IPRs. For some firms and countries, a virtuous complementarity between the development of IPRs and skills arises. For others, the disincentive effect of the exclusion from intellectual property has more damaging consequences than the lack of access to material capital.  相似文献

This paper explores why finance constraints may impact upon the inter firm diffusion of new technology, incorporates these arguments in a hazard rate formulation of a diffusion model and then estimates that model using data relating to the adoption of CNC machine tools in the UK. This paper investigates the role of transnational organized crime in the democratisation process in the Central Asian area. It examines the inherent connections that exist between the leading tribal families, political elites and organized crime, and explores how criminal networks have proliferated in society and consequently in politics. The complete absence of a ruling élite and striking economic issues left unsolved were the legacy that Soviet rule would leave to the newly independent Central Asian Republics. After the fall of the former Soviet Union other, more profitable forms of transnational organized crime flourished. According to the official statistics of the UNODC and the American State Department, 92% of the world’s heroin is produced in Afghanistan. Of this, around 65% is smuggled into Europe and America along the Silk Road, and therefore through the five Central Asian Republics and Russia. High levels of corruption in Central Asia heavily affect political and economic life. The economies of the region have progressively become dominated by criminal activity with smuggling, trafficking and other activities linked to transnational organized crime as the major source of income. Central Asia’s strategic location makes this a global security concern.
