The invisible hand plays dice: multiple equilibria in sects markets

Religious participation is much more widespread in the United States than in Europe, while Europeans tend to view sects more suspiciously than Americans. We propose an explanation for these patterns without assuming differences in preferences or market fundamentals. We study a religious market where both demand and supply of spiritual services are endogenous. Such markets may have multiple equilibria. Further, equilibria with more sects result in higher welfare and lower membership costs, as secular societies tend to host on average more demanding sects.

Nachdem es zuletzt etwas ruhiger um die Frage nach der korrekten Qualifikation von Bestandvertr?gen in Einkaufszentren (EKZ) geworden zu sein schien, sind nunmehr wieder interessante Entwicklungen zu verzeichnen. Einerseits liegt eine neue Entscheidung des OGH vor, die als weiterer beachtlicher Schritt zur Konsolidierung der einschl?gigen Judikatur gewertet werden kann. Andererseits werden dem Vernehmen nach gegenw?rtig massive Anstrengungen unternommen, um eine gesetzgeberische Intervention zu diesem Themenkomplex herbeizuführen. Im folgenden Beitrag werden die geschilderten aktuellen Entwicklungen n?her dargestellt und gewürdigt.     

Zur Rechtsqualität von Kfz-Parkwippen ("Stapelparkern") auf einer WE-Liegenschaft; Stapelparkanlage als "gesondert abzurechnende Anlage" iSd § 32 Abs 6 WEG 2002?

In der technischen Vorrichtung zum Erreichen einer Parkwippe ist ein allgemeiner Teil der Liegenschaft zu sehen, wenn sich die gesamte Hydraulik für die Stapelparker in einem nicht dem WE zugeordneten Raum, sondern auf einer Allgemeinfl?che befindet. Resultiert aus der Zubeh?reigenschaft der Stellfl?chen der Parkwippen die Unzul?ssigkeit der Nutzung durch andere Wohnungseigentümer und kommt es zu evident unterschiedlichen Aufwendungen gegenüber gew?hnlichen und Stapelabstellfl?chen, muss die objektive Sinnhaftigkeit einer gesonderten Abrechnung iSd § 32 Abs 6 WEG 2002 grunds?tzlich bejaht werden.     

Molecular study of time dependent changes in DNA stability in soil buried skeletal residues

In the past years, many publications about identification and sex-determination of dry human bones by means of DNA analysis have been published. However, few studies exist that investigate the potential use of DNA technique to determine the postmortem interval (PMI). In the present study we analyzed the rate of increasingly smaller fragments of chromosomal DNA and PMI.     

Multikulturalismustheorien und der Kulturbegriff

Das Konzept des ?Multikulturalismus“ erscheint zur Analyse von Gegenwartsgesellschaften ebenso wegweisend wie diffus, was nicht zuletzt auf die Uneindeutigkeit des Kulturbegriffs zurückzuführen ist. Es werden zunächst die Konnotationen des Kulturbegriffs in den beiden avanciertesten sozialphilosophisch ausgerichteten Theorien des Multikulturalismus bei Charles Taylor und Will Kymlicka herausgearbeitet. Beide Theoretiker erweisen sich als Repräsentanten eines ?homogenitätsorientierten“ Multikulturalismusmodells kultureller Gemeinschaften. Es zeigt sich, dass dieses Kulturverständnis im totalitätsorientierten Kulturbegriff der Tradition Herders wurzelt, dem ein neuerer bedeutungsorientierter Kulturbegriff entgegengestellt werden kann, welcher die Identifikation von Wissensordnungen mit Gemeinschaften aufgibt. Damit kann ein alternatives Modell des Multikulturalismus formuliert werden, das auf dem Konzept ?kultureller Interferenzen“, das heißt der simultanen Wirksamkeit unterschiedlicher ?background languages“ in Kollektiven basiert, und das zwischen der Struktur impliziter Wissensvorräte und den Selbstbeschreibungsdiskursen von Kollektiven differenziert.     

Pay‐for‐Success Development in the United States: Feasible or Failing to Launch?

Social impact bonds, known as pay‐for‐success (PFS) initiatives in the United States, have attracted attention as a novel strategy for financing and providing preventive services to the most vulnerable populations. This article provides an exploratory qualitative analysis of the Preschool PFS Feasibility Pilot grant applications and projects initiated by the U.S. Department of Education to encourage state and local exploration of PFS for implementing high‐quality preschool programs. Drawing on the public administration evidence base that informs PFS design, the authors examine the feasibility pilots’ features and investigate why grant applicants saw PFS as a promising strategy for achieving their preschool program goals. The challenges encountered, lessons learned, and perceived viability of fully executed PFS preschool programs are also discussed. Findings show that few projects are advancing toward formal PFS arrangements, with many struggling to overcome constrained capacities, structural and political barriers, and inherent incentives to minimize risk and loss.     

Negligent homicide caused by exhaust gas escaping from a manipulated chimney

A chimney built and operated according to the instructions is supposed to ensure that the combustion gases coming from the fireplace can escape safely. If the operational reliability is impaired, this presents a risk of acute poisoning. The report deals with a negligently caused carbon monoxide poisoning of a married couple as a consequence of improper installation of a cover of the chimney opening. Various causes of fatal poisoning due to defective exhaust systems are discussed in connection with the presented case report.     

Assessing measurement invariance of PCL-R assessments from file reviews of North American and German offenders

Cross-cultural research on psychopathy necessitates assessment methods that are generalizable across linguistic and cultural differences. Multiple-group confirmatory factor analysis was used to compare the factorial structure of Psychopathy Checklist-Revised (PCL-R) assessments obtained from file reviews of North-American (N = 2622) and German (N = 443) male offenders. The analyses indicated that the 18 item, 4-factor model of the PCL-R obtained with the standard PCL-R protocol (interview and file review) also holds for file review data. On a factor-by-factor level, the data are commensurate with strong factorial invariance of factor loadings and item thresholds for the Interpersonal and Lifestyle factors, and with likely metric invariance for the Affective factor. The Antisocial factor showed structural differences between the two samples. The results imply that cultural or environmental factors more strongly influence the judgment and/or expression of antisociality. Based on the results, cross-cultural comparisons between North-American and German offenders in terms of PCL-R psychopathy should be limited to the Interpersonal and Lifestyle factors. Further research using data obtained through the standard protocol (i.e., interview plus file information) is encouraged.     

Mietvertragliche Erhaltungs- und Endrenovierungspflichten nach der 4. "Klausel-Entscheidung"

In einer 4. "Klausel-Entscheidung" wurde jüngst vom 2. Senat – neben der Zul?ssigkeit eines standardvertraglichen generellen Tierhaltungsverbotes in einer Wohnung – auch über die Zul?ssigkeit von in einem Mietvertragsformular enthaltenen Erhaltungs- und Endrenovierungspflichten des Mieters abgesprochen. Im folgenden Beitrag werden die von der Entscheidung diesbezüglich eingenommenen Rechtsstandpunkte n?her analysiert und gewürdigt. Zudem wird ganz allgemein auf den einschl?gigen status quo in der h?chstgerichtlichen Judikatur Bezug genommen und die Sinnhaftigkeit einer legistischen Intervention diskutiert.
