Feststellung des rückforderbaren Kautionsbetrags im Außerstreitverfahren – eine erste Bestandsaufnahme

Gem § 37 Abs 1 Z 8b MRG idF der WRN 2009 ist die Feststellung der H?he des rückforderbaren Kautionsbetrags im (mietrechtlichen) Au?erstreitverfahren geltend zu machen. Der vorliegende Beitrag behandelt die Folgen dieser – lediglich auf Feststellungsansprüche beschr?nkten – Verweisung ins Au?erstreitverfahren für die Durchsetzung des Kautionsrückforderungsanspruchs. Darüber hinaus werden Fragen der Geltendmachung von Gegenforderungen durch den Vermieter und Probleme zeitlich versetzter Rechtsverfolgung n?her untersucht.     

Competition and cooperation in artificial intelligence standard setting: Explaining emergent patterns

Efforts to set standards for artificial intelligence (AI) reveal striking patterns: technical experts hailing from geopolitical rivals, such as the United States and China, readily collaborate on technical AI standards within transnational standard-setting organizations, whereas governments are much less willing to collaborate on global ethical AI standards within international organizations. Whether competition or cooperation prevails can be explained by three variables: the actors that make up the membership of the standard-setting organization, the issues on which the organization's standard-setting efforts focus, and the “games” actors play when trying to set standards within a particular type of organization. A preliminary empirical analysis provides support for the contention that actors, issues, and games affect the prospects for cooperation on global AI standards. It matters because shared standards are vital for achieving truly global frameworks for the governance of AI. Such global frameworks, in turn, lower transaction costs and the probability that the world will witness the emergence of AI systems that threaten human rights and fundamental freedoms.

Crisis intervention team officer dispatch, assessment, and disposition: Interactions with individuals with severe mental illness

The Crisis Intervention Team (CIT) model is a specialized police response program for people in a mental illness crisis. We analyzed 2174 CIT officers' reports from one community, which were completed during a five year period. These officers' reports described interactions with people presumed to be in a mental illness crisis. We used hierarchical logistic and multinomial regression analyses to compare transport to treatment to either transport to jail or no transport by how the calls were dispatched. The results revealed that both dispatch codes and officers' on-scene assessments influenced transport decisions. Specifically, calls dispatched as suspected suicide were more likely to be transported to treatment than calls dispatched as mental disturbance. Furthermore, calls dispatched as calls for assistance, disturbance, suspicious person, assault, suspicion of a crime, and to meet a citizen were all less likely than mental disturbance calls to result in transportation to treatment. Officer assessments of the use of substances, being off medications, signs and symptoms of mental or physical illness, and violence to self or others were associated with the likelihood of being transported to treatment. These results build on previous work that demonstrated differences in transport decisions between CIT trained and non-CIT trained officers.     

Social citizenship and ethnicity around a public sector steel plant in Orissa,India

This article is about a modern public sector steel plant in the state of Orissa and its promise to set standards for post-colonial India's citizenry at large. These steel plants were to provide their workforces with superior social and economic citizenship rights, which in turn were to serve as exemplary industrial relations for the industrialising nation. The steel plants were also intended to forge multi-ethnic workforces into exemplary Indian citizens by transcending their manifold ethnic differences. The trajectory of the public sector steel plant in the town of Rourkela confirms that enhanced social and economic citizenship rights detached public sector steel workforces from labour at large and produced a ‘labour aristocracy’. The trajectory, furthermore, reveals how in Rourkela policies designed to accommodate ethnic differences constantly recreated these differences and hampered the access of large sections of the local population to these enhanced social and economic citizenship rights.     

Law and ethics of deep brain stimulation

Deep brain stimulation (DBS) is a non-destructive, adjustable, and mainly reversible method of continuously giving electrical impulses into a small area of the brain via implanted electrodes. It has been established as a standard form of treatment for specific cases of Parkinson's disease, essential tremor and dystonia. It is currently being evaluated for several mental disorders, dementia and even alcoholism. In spite of its growing practical importance, the legal issues have so far undergone almost no analysis. The article outlines both the essential legal questions of DBS from the perspective of German Law as well as major issues of the current ethical debate, and the correlation of both fields.
