Australian legal aid agencies are increasing their reliance on self-help legal services as part of their service delivery mix. Self-help legal services seek to harness the productive capacity of consumers,enabling wider distribution of legal aid services. The move to self-help services as an alternative to traditional legal service delivery appears to have gained momentum in advance of any sound understandings of what legal consumers, and legal aid consumers in particular, are capable of. In addition to the cost benefits of providing self-help services rather than traditional legal services, these services have been promoted on the basis of their capacity to empower users to address their own legal matters. Examples of the misuse by government agencies of notions of empowerment emphasize the importance of ensuring the usefulness of self-help legal services.  相似文献

This study investigated the use made by judges of background information provided in presentence reports in reaching their sentencing decisions. The presentence reports were furnished in a number of modified forms during an experimental manipulation in a real-life setting. By obtaining judges' provisional decisions during their reading of the report, along with their indications of what they found useful, the influence of different sections of information in the report was determined. All sections. were used by judges to some extent. The recommendation section was analyzed in some detail; while there was high agreement between the probation officer's recommendation and the judge's final disposal, judges tended to rate the recommedation low in terms of usefulness. However, analysis of changes to intended disposals, which occurred during reading of the reports, indicated that these recommendations were in fact quite influential, and even when there was not perfect agreement the recommendation produced a high frequency of shifts in the final disposal, bringing it closer to the recommendation than a preliminary decision had been. Reasons for these inconsistencies are considered in terms of the different methods used.  相似文献

Since South Africa's Truth and Reconciliation Commission (TRC), 'reconciliation' is now an authoritative discourse governing political transition. Reconciliation governs the 'moral reordering' of national communities in the wake of conflict and transition to more democratic regimes by enquiring into, and attempting to address, past gross violations of human rights perpetrated, in the main, against civilian populations by the state and its agents. Reconciliation eschews retributive justice in favour of 'restorative' modes of 'dealing with the past', and has come, broadly, to be institutionalised by the truth commission. South Africa's TRC animated theological discourses of forgiveness and Christian reconciliation in order to legitimise and endow with moral resonance the project of transitional justice. This article enquires into the political effects of such an animation, and investigates the performance of forgiveness and reconciliation as metaphor and narrative.  相似文献

The study of policy utilization has been unnecessarily confined to one policy stage and to one group of policymakers-high ranking civil servants. This article suggests to broaden research concerns by including the various stages of the policy cycle and the various policymakers. Utilization plays different functions in different stages and the incentives of policymakers in each stage are guided by self-interest and political-bureaucratic efficacy.  相似文献

The purpose of this study was to determine the performance characteristics of the Cozart Amphetamine Microplate EIA for detecting amphetamine in oral fluid. Oral fluid samples were collected using the Cozart RapiScan Collection System from 135 volunteer donors from drug treatment clinics. A further 35 oral fluid samples were collected from volunteer donors who were not drug users. The samples were analyzed in the laboratory using the Cozart Amphetamine Microplate EIA and confirmed using gas chromatography-mass spectrometry (GC-MS). The samples were stored frozen until analysis by GC-MS. The intra-assay precision for the Cozart Amphetamine Microplate EIA for amphetamine in oral fluid over forty assays was 2.74-7.1% CV (within assay) and 3.4-7.0% CV (within day). A total of 78 samples were positive for various amphetamines and related designer drugs. The Cozart Amphetamine Microplate EIA, using a cutoff of 45 ng/ml amphetamine equivalents in neat oral fluid, had a sensitivity of 91.7+/-3.3% and a specificity of 95.9+/-1.9% versus GC-MS using a cutoff of 30 ng/ml. A series of potential adulterants of oral fluid were evaluated and shown not to alter the outcome of the test result.  相似文献
