Because of the expansion of the postwar welfare state and its rhetoric of inclusion, the British National Assistance Board (NAB), which provided means-tested relief, faced a dramatic increase in the number of lone women with children claiming assistance in the 1950s and 1960s. In trying to restrict the state's role in social provision, the NAB relied on and tried to extend familial obligations for women's support that had been institutionalized in family law and in the poor law. The largely unsuccessful efforts of the NAB to prevent such women from turning to the welfare state included various forms of persuasion, coercion, and intimidation. Scholars of social policy in the postwar period have called attention to later efforts to discourage applications by lone women between the late 1960s and the 1990s. But the defensive posture against such women was adopted much earlier, in a relatively unexamined portion of the NAB's history. In its early, formative years, the NAB devised new strategies based on the rationales of female dependence that had long been entrenched in family law and the poor law. These methods and rationales became fixed in the postwar bureaucratic repertoire and were later available to bolster gendered attacks on the welfare state itself, particularly those made so aggressively under Thatcherism. 相似文献
Abstract: Salivary DNA is encountered in many crimes, such as sexual assaults and murders. In this study, saliva from three male donors was deposited on the skin of three female recipients. The amount of male salivary DNA remaining on the female skin was measured over a 96‐h period using the Quantifiler? Y Human Male DNA Quantification Kit. In eight of the nine experiments, a full male DNA profile matching the donor was obtained even after 96 h. In addition, the study showed that the concentration of salivary DNA varied from donor to donor and from day to day. The efficiency of two recovery methods, wet and dry swabbing and minitaping, was compared. The results indicate the tapelift method gave higher DNA recovery. This study also examined the secondary transfer of salivary DNA from skin to fabrics. Cotton and polyester give higher DNA transfer than leather. 相似文献
This paper analyses elements of the legal process of consent to the donation of 'spare' embryos to research, including stem-cell research, and makes a recommendation intended to enhance the quality of that process, including on occasion by guarding against the invalidity of such consent. This is important in its own right and also so as to maximise the reproductive treatment options of couples engaged in in vitro fertilisation (IVF) treatment and to avoid possible harms to them. In Part 1, with reference to qualitative data from three UK IVF clinics, we explore the often delicate and contingent nature of what comes to be, for legal purposes, a 'spare' embryo. The way in which an embryo becomes 'spare', with its implications for the process of consent to donation to research, is not addressed in the relevant reports relating to or codes of practice governing the donation of embryos to research, which assume an unproblematic notion of the 'spare' embryo. Significantly, our analysis demonstrates that there is an important and previously unrecognised first stage in the donation of a 'spare' embryo to research, namely: consent to an embryo being 'spare' and so, at the same time, to its disuse in treatment. This is not explicitly covered by the Human Fertilisation and Embryology (HFE) Act 1990, as amended by the HFE Act 2008. Having identified this important initial stage in the process of consent to the donation of a 'spare' embryo to research in conclusion to Part 1, in Part 2 we analyse the idea of consent to an embryo's disuse in treatment on the basis that it is 'spare' with reference to the legal elements of consent, namely information as to nature and purpose, capacity, and voluntariness. We argue that there are in fact three related consent processes in play, of which the principal one concerns consent to an embryo's disuse in treatment. If the quality of this first consent is compromised, in turn this will impact on the quality of the consent to the donation of that 'spare' embryo to research, followed by the quality of consent to future cycles of assisted reproduction treatment in the event that these are needed as a result of a donation decision. The analysis overall is of central relevance to the debate as to whether, and if so when, it should be permissible to request the donation of fresh embryos for research, as opposed to those that have been frozen and, for instance, have reached the end of their statutory storage term. This has a particular bearing on the donation of embryos to stem-cell research since there is a debate as to whether fresh embryos are most useful for this. 相似文献
An amendment in 2002 to the Spanish Code of Criminal Procedure converted into documentary evidence the expert reports prepared by official laboratories aimed at determining the nature, weight, and purity of seized drugs. In most cases, experts are spared from appearance before the courts. This is likely to be extended to other forensic fields. After an overview of criminalistic identification in current forensic science, the objectivity and reliability concepts used by jurists and scientists are considered by comparing the paradigm of individualization with that of likelihood. Subsequently, a detailed critical study is made on the above-mentioned Spanish legal reform, and a comparison is made with the decision on the Melendez-Diaz v. Massachusetts case as ruled by the Supreme Court of the United States. Although the reform is in compliance with the Spanish Constitution, it is at odds with science, in particular regarding the logic underpinning the scientific evaluation of evidence. 相似文献

There are many challenges in evaluating international networks. The use of conventional tools can be difficult and often provides less than useful information. Social Network Analysis offers benefits for network evaluators by allowing for documentation and analysis of inter-relationships between individuals and organisations. This paper describes the use of this approach in the evaluation of a major international project entitled the Global Dialogues on Sexual Health and Well-being. It highlights the value of maps in enabling clear visual representations of networks, the identification of areas needing greater focus and the basis on which networks are constructed.

L’évaluation des réseaux internationaux présente de nombreux défis. L'utilisation d'outils conventionnels peut être difficile et fournit souvent des informations qui ne sont pas des plus utiles. L'analyse des réseaux sociaux comporte des avantages pour les évaluateurs des réseaux, car elle permet la documentation et l'analyse des corrélations entre individus et organisations. Cet article décrit l'utilisation de cette approche dans l’évaluation d'un important projet international intitulé Global Dialogues on Sexual Health and Wellbeing (Dialogues mondiaux sur la santé et le bien-être génésiques). Il met en relief la valeur des cartes pour permettre des représentations visuelles claires des réseaux, l'identification de zones nécessitant un axe central plus marqué et la base sur laquelle les réseaux sont construits.

A Análise de Rede Social oferece benefícios para avaliadores de rede ao considerar a documentação e análise das inter-relações entre indivíduos e organizações. Este artigo descreve o uso desta abordagem na avaliação de um grande projeto internacional chamado Diálogos Globais sobre Saúde Sexual e Bem-Estar. Ele destaca o valor de mapas para permitir representações visuais claras de redes, a identificação de áreas que estejam precisando de um maior enfoque e a base sobre a qual as redes são construídas.

A la hora de evaluar las redes internacionales surgen muchos retos. Los métodos tradicionales pueden presentar dificultades y a menudo proporcionan información poco útil. El Análisis de Redes Sociales presenta ventajas para los evaluadores de redes ya que ofrece la posibilidad de documentar y analizar relaciones entre individuos y organizaciones. El presente ensayo examina cómo se utilizó este método para evaluar un importante proyecto internacional llamado “Diálogos globales sobre salud sexual y bienestar”. También ilustra cómo los mapas son valiosos porque muestran una clara representación visual de las redes, revelan las áreas que necesitan mayor atención y señalan las bases sobre las que se construyen las redes. 相似文献
Patron banning involves banning individuals who engage in problematic behaviour in night time entertainment precincts from certain areas. Patron banning is used in most jurisdictions within Australia despite a lack of evidence regarding its effectiveness. To have an impact, patron banning should act as a deterrent for problematic behaviour at a range of licenced premises (individual and general deterrence), as well as constituting as an immediate punishment which prevents future problem behaviours at the establishment(s) from which an individual has been banned (incapacitation). However, for deterrence to occur, the general public must be aware of the existence and basic functions of patron banning. Therefore, the aim of this study is to determine the level of public awareness of patron banning and its use. One hundred seventy-two participants anonymously completed an online questionnaire, comprising two sections: (1) demographic information and (2) participant’s awareness, understanding, and previous experience with patron banning. The majority of participants indicated being aware of patron banning, but most did not know any details about it. The results of this study indicate that while individuals are aware that banning powers exist, they are less aware of how these powers are used in practice. In this way, patron banning fails to fulfil the requirements of a general deterrent. Given its expanding use, further research is needed to determine if patron banning does affect the behaviour of those receiving bans and of the community more generally. 相似文献
