In the UK, the Joint Intelligence Committee (JIC) has a poor track record of predicting attack. In the US, official inquiries into 9/11 identified ‘a failure of imagination’ to conceive of a large scale threat to the American homeland. There is a long-standing literature on surprise attack which emphasizes that clues to predict attack often exist but are not pieced together by an intelligence sector which is not structured to look in the right direction. In a world of increasingly fragmented threats and weak signals, it is apparent that much of the challenge in intelligence work now lies not in collection but in managing requirements, setting priorities, and conducting incisive analysis based on the ability to imagine new threats. One solution to a failure of imagination is to widen the range of people who can contribute to the task. Non-Governmental analysis of security issues, whether by academia, civil society or the private sector, can help to identify emerging issues and set priorities. Whilst collection of secret intelligence may always remain the preserve of specialist Government agencies, the rest of the intelligence cycle can benefit from external contributions and open source intelligence. We argue that the process of setting intelligence requirements could be opened to a wider range of actors. In conflict environments, there may be particular value in an open process to identify what each side would need to know about the other to confidently seek peace. 相似文献

Recently support has grown for the view that the Torrens system of lands titles registration, which has now spread to numerous jurisdictions throughout the world, was actually not Torrens's work at all, but a copy of a German system passed off by him as his own production. This article reviews the evidence, much of which is here discussed for the first time, and concludes that that view is incorrect. Poor working conditions in global supply chains have led to private initiatives that seek to regulate labor practices in developing countries. But how effective are these regulatory programs? We investigate the effects of transnational private regulation by studying Hewlett‐Packard's (HP) supplier responsibility program. Using analysis of factory audits, interviews with buyer and supplier management, and field research at production facilities across seven countries, we find that national context – not repeated audits, capability building, or supply chain power – is the key predictor of workplace compliance. Quantitative analysis shows that factories in China are markedly less compliant than those in countries with stronger civil society and regulatory institutions. Comparative field research then illustrates how these local institutions complement transnational private regulation. Although these findings imply limits to private regulation in institutionally poor settings, they also highlight opportunities for productive linkages between transnational actors and local state and society. 相似文献

Surgically implanted devices have become increasingly common in modern skeletal material. Therefore, having the knowledge of the variety of implanted orthopedic devices, their manufacturer, and where to find and how to use identifying numbers in such implants can assist in the identification process when traditional methods are not applicable. Orthopedic device manufacturers are required by the Safe Medical Devices Act of 1990 and the FDA Modernization Act of 1997 to track permanently implanted devices. Manufacturer information on orthopedic devices associates the orthopedic surgeon who implanted the device with the patient. By providing a current list of the most common orthopedic device manufacturers in the U.S.A. and the associated contact information, investigators will have updated tools for the individuation process. This article investigates how activists involved in both sides of the street politics of abortion simultaneously create, are constrained by, and use law when recounting a period of conflict that resulted in litigation. The activists‐turned‐litigants' construction of legality is explored by identifying and analyzing patterns of inclusion, absence, amendment, and type of law (i.e., state or extrastate) in and across the stories they tell. It is found that even though there are multiple reasons to expect all of these activists to resist or amend the state's conception of law, their narratives ultimately reproduce state law's legitimacy and power. The activists' stories also illustrate that legal consciousness is contextually and experientially based and is therefore subject to change. This finding has implications for legal mobilization as well as for the nature of legal consciousness. 相似文献
