The Social Movement Turn in Law

The rise of social movements in US legal scholarship is a current response to an age‐old problem in progressive legal thought: harnessing law for social change while maintaining a distinction between law and politics. This problem erupted in controversy around the civil rights–era concept of legal liberalism defined by activist courts and lawyers pursuing political reform through law. Contemporary legal scholars have responded by building on social science to develop a new concept—movement liberalism—that assigns leadership of transformative change to social movements to preserve conventional roles for courts and lawyers. Movement liberalism aims to achieve the lost promise of progressive reform, while avoiding critiques of legal activism that have divided scholars for a half‐century. Yet rather than resolving the law‐politics problem, movement liberalism reproduces long‐standing debates, carrying forward critical visions of law that it seeks to transcend.     

Integrated leadership system in the Australian Public Service

On 16 July 2004 the Australian Public Service Commission launched a new approach to leadership capability development for the public service. This approach, the Integrated Leadership System (ILS), is described as innovative and unique by the four speakers who make up this presentation—including Andrew Podger (AO), Public Service Commissioner, Jane Halton, Secretary of Health and Ageing, Anne Simic, Head of People, Qantas, and Dr Peter Shergold, Head of the Public Service and Secretary of the Department of Prime Minister and Cabinet.     

Problem solving and youth violence: an evaluation of the Boston Gun Project

The Boston Gun Project is a problem-solving policing initiativeaimed at reducing homicide victimization among young peoplein the city of Boston. It represented an innovative partnershipbetween researchers and practitioners to assess the city's youthhomicide problem and implement an intervention intended to havepowerful impacts in the near term. In early 1996, a workinggroup representing a variety of law enforcement and social serviceagencies implemented an intervention that strategically respondedto gang violence, focused enforcement efforts on gun trafficking,and emphasized communication of the strategy to generate deterrence.The intervention is associated with a 60% decline in youth homicidevictimization (i.e., two fewer victims per month). There aresmaller declines in other measures of violence. The declinein youth homicide is sharp and occurs coincident with the introductionof the intervention. Competing hypotheses appear unable to accountfor the decline.     

From Research Evidence to “Evidence by Proxy”? Organizational Enactment of Evidence‐Based Health Care in Four High‐Income Countries

Drawing on multiple qualitative case studies of evidence‐based health care conducted in Sweden, Canada, Australia, and the United Kingdom, the authors systematically explore the composition, circulation, and role of codified knowledge deployed in the organizational enactment of evidence‐based practice. The article describes the “chain of codified knowledge,” which reflects the institutionalization of evidence‐based practice as organizational business as usual, and shows that it is dominated by performance standards, policies and procedures, and locally collected (improvement and audit) data. These interconnected forms of “evidence by proxy,” which are informed by research partly or indirectly, enable simplification, selective reinforcement, and contextualization of scientific knowledge. The analysis reveals the dual effects of this codification dynamic on evidence‐based practice and highlights the influence of macro‐level ideological, historical, and technological factors on the composition and circulation of codified knowledge in the organizational enactment of evidence‐based health care in different countries.     

Interparental Aggression and Adolescent Adjustment: The Role of Emotional Insecurity and Adrenocortical Activity

Adolescents exposed to interparental aggression are at increased risk for developing adjustment problems. The present study explored intervening variables in these pathways in a community sample that included 266 adolescents between 12- and 16-years-old (M?=?13.82; 52.5 % boys, 47.5 % girls). A moderated mediation model examined the moderating role of adrenocortical reactivity on the meditational capacity of their emotional insecurity in this context. Information from multiple reporters and adolescents’ adrenocortical response to conflict were obtained during laboratory sessions attended by mothers, fathers and their adolescent child. A direct relationship was found between marital aggression and adolescents’ internalizing behavior problems. Adolescents’ emotional insecurity mediated the relationship between marital aggression and adolescents’ depression and anxiety. Adrenocortical reactivity moderated the pathway between emotional insecurity and adolescent adjustment. The implications for further understanding the psychological and physiological effects of adolescents’ exposure to interparental aggression and violence are discussed.     

Challenges to prosecutorial discretion

In the ordinary conduct of prosecutions, challenges are faced when, especially, discretionary decisions need to be made. That situation arises at many stages of the process, some of which are identified in this paper. Many legal and factual circumstances will operate to determine the outcome of such situations. In addition, legal challenges may be able to be made to actions taken by prosecutors and that possibility should be anticipated when decisions are being made and action taken.     

Ethics and the Changing Nature of Public Service

The public sector is held to an ethical standard not demanded of others. It must recognise the distinctive nature of its contribution to the public good and meet a demanding accountability regime. Structural changes pose still further challenges for the public sector. Yet we should be proud of our accomplishments and willing to defend the unique character of public service.
