This essay outlines the theory of lawin the work of Slavoj Zizek. Zizek proceedsfrom the premise that law is internally,constitutively divided. Law is split betweenthe external social law and the obscenesuperego supplement. Superego is thenecessary, unavoidable underside of the sociallaws that hold together the community.Nevertheless, law can serve potentiallyliberatory ends. It can work as a repositoryfor aspirations for something better. Thus, thearticle argues that for Zizek what is beyondlaw inheres in law as a kind of faith. Definition of markets is fundamental to any analysis of competitionand is the first step in enforcement of antitrust statutes.In the banking industry, geographic market definitions havebeen the subject of considerable discussion in recent years.This paper utilizes a survey conducted by the National Federationof Independent Business Research Foundation in 2001. The surveyasked a variety of questions relating to American small businesses'experience with financial institutions, including a questionasking how many banks were in the market area where the smallfirm did most of its business. Using the zip code of the surveyrespondent, this answer was compared with the number of banksin the same county, in the same metropolitan area, or in thelocal banking market as defined by the Federal Reserve. Theresults show that both urban and rural markets as perceivedby small businesses are considerably smaller than markets asdefined by either the US Department of Justice or the FederalReserve. 相似文献

In this article, an overview of the key findings from the Children'sContact Services Project is presented. Children's Contact Services(CCSs) assist separated parents to manage contact arrangementswith their children through the provision of supervised visitationand changeover services. The aims of this project were to investigatethe use of CCSs in Australia by referring agencies (eg. courtsand legal practitioners), and clients of contact services (parentsand children), and to consider the views and expectations ofthese key stakeholders regarding those usages. This approachwas based on the assumption that there are currently conflictingusages and expectations of contact services, and that this situationcould compromise children's well-being. The findings were derivedfrom two studies. The first study involved conducting 142 in-depthinterviews with representatives from the Australian Government,the courts and legal practitioners who referred families toCCSs, CCS staff and management, as well as parents and childrenwho used CCSs. The second study comprised a quantitative analysisof client data collected by CCS staff from 396 families whohad used a government funded CCS in August 2003. The findingsdemonstrated that in Australia, CCSs provided an invaluableservice that was viewed positively by government, referral agents,CCS staff and management, and by the parents and children whoused them. Despite this generally positive view, there wereconflicting expectations of CCSs that, under certain circumstances,compromised children's well-being and that of their parents,particularly their residence mothers. 相似文献

This paper considers some dilemmas relating to developing effectiveassistance with and to people who have lived through extremeevents in a civil war and post-conflict contextwithin Sri Lanka. The tsunami which devastated many coastalareas of Sri Lanka in December 2004 and left many people withno homes or livelihood has further affected the country. A majorissue is how far the concepts and methods of western psychologyand psychiatry are appropriate to radically different culturesand contexts: in particular, how post-conflict and post-disasterpsychosocial rehabilitation may depend in complex ways on localspecifics and interact or not with biomedical notions of PTSDdiagnosis and individual therapy. The relationship between aculture and its healing rituals is a complex one. Cultural,socio-political, existential and personal meanings, expressionsand responses to civil war or traumatic events and their aftermathare likely to be mediated by each individual and the contextin which they occur. Local governments commonly pursue environmental objectives that exceed state and federal minimum requirements. Although research informs our understanding of factors that lead cities to adopt such policy goals, the underlying mechanisms employed to achieve them are not well understood. This article examines factors that drive the choice of policy instruments that cities use to pursue local environmental objectives. The literature links the structure of the local governing body, characteristics of the community and target populations, and the nature of the policy problem to instrument selection. Building on this, the authors model the dynamics shaping cities' use of regulations, financial incentives, or combination thereof, to pursue a variety of different environmental objectives. Results indicate that community racial composition and political leaning influence instrument choice when policy targets the public at large. Alternatively, when policy targets particular stakeholder groups, such as developers, the characteristics of the local governing body are of greater importance. 相似文献
