The wall in the ballot box: The Berlin election of 1995

The Berlin election of October 1995 produced very different results in the eastern and western halves of the city, and although the end result was a continuation of the Grand Coalition, it was the PDS and Bündnis 90/Die Grünen who stole the limelight once the votes were counted. This article attempts to account for the performance of the parties in each half of the city and considers the political consequences for them. It concludes by considering what the election can tell us about the public mood in Berlin and about political trends in the Federal Republic in general. What emerges is a ‘wall in the ballot box’, a practical manifestation of die Mauer im Kopf which clearly continues to exist five years after the first all‐German election.     

Bolivia's soy complex: the development of ‘productive exclusion’

A significant transition is underway in Bolivia where both domestic and foreign capital are monopolizing commercial agriculture and leading a highly mechanized, capital-intensive production model which has considerably diminished the need for labour. This paper explores mechanisms and processes of ‘productive exclusion’ in the soy-producing zones of Santa Cruz in relation to the expansion, concentration and mechanization of the ‘soy complex’. We provide an analysis of how the agrarian structure has developed since soy was adopted – from ‘putting land into production’ to ‘expanding the agricultural frontier’ and ‘controlling the agro-industrial chain’. We explore how and the extent to which the penetration of new capital is leading to new processes of agrarian change which exclude the rural majority from accessing the means of production. While a process of ‘foreignization’ of land began to take shape in the early 1990s, new processes of capital accumulation are eroding the ability of small farmers to engage in productive activity, potentially leading to ‘surplus’ populations no longer needed for capital accumulation.     

Caregiving and quality of life

ABSTRACT

The increase in life expectancy for adults with learning disabilities has extended the caring role for their parents. This study examined the experiences of older parents who provide long-term care for their adult children with learning disabilities and how they conceptualise their quality of life. Data were collected using semi-structured interviews with 27 older parent carers from four London boroughs and were analysed using framework technique. Findings indicate that most parents appraised their quality of life positively and reported benefits, despite the challenges they had to negotiate daily. The benefits from caregiving, more so in later life, were: a connected family from shared caregiving; a sense of belonging; purposeful living; a reciprocal relationship with their adult children; and personal transformations from providing care that improved their quality of life. The challenges that participants regularly encountered were: multiple losses (sleep, career, identity and friends); the added stress of the government’s Personalisation Agenda of caring services; struggles for access to services; searching for a diagnosis; worry about future care and fear of abuse when carers are unable to continue in their role; unhelpful attitudes of health and social care professionals; and a lack of empathy from friends as well as the public towards people with learning disabilities. Caregiving and quality of life are inextricably linked and the difficulties that parents experienced were mainly associated with socio-structural barriers, rather than their children’s disabilities. Importantly, the findings inform the practice of social workers and others who support this unique group of carers by providing new insights into how caring impacts on quality of life over time and how best these parents’ needs can be met. This study makes a specific contribution to understanding the lived realities of older carers and extends current conceptualisations of caregiving and quality of life among older people.     

Truth,justice, and education: towards reconciliation in the former Yugoslavia

Key to the success of peacebuilding and social reconstruction in the former Yugoslavia are the attitudes of these young people. Our goal in this paper is to explore young people’s attitudes about the prospects of reconciliation vis-a-vis those with whom their nations were formerly at war. In particular, we examine three sets of factors. First, we contend that the level of contact among people engendered by the segregated educational systems affects the attitudes of the young about the possibility of reconciliation. We suggest that those who are able to interact more frequently with fellow students from other ethnic groups will be more likely to believe in the possibility of reconciliation. Second, we contend that attitudes of young people about which ethnic groups were responsible for the violence in the former Yugoslavia and the efforts of the international community to bring truth and justice will strongly influence attitudes. Finally, we examine other factors such as education and the influence of gender on reconciliation.     

Guiding Principles for Directorial Conflicts of Interest: Re Allied Business and Financial Consultants Ltd; O'Donnell v Shanahan

The Court of Appeal has disposed of the ‘scope of business’ test as the touchstone principle for directorial entrepreneurship cases and has confirmed the continuing applicability of a capacity approach while emphasising the importance of directors obtaining the company's informed consent before taking up opportunities that they encounter. This provides welcome legal certainty but raises interesting questions about the scope of a director's disclosure obligations.     

The decision to lobby bureaucrats

Despite a good deal of interest in lobbyists?? tactics, virtually no research has been published examining the conditions under which interest groups lobby the bureaucracy rather than or in addition to the legislature. Using two comprehensive datasets, I show that lobbying increases in both branches when conflict is higher and when the lobbyist has professional or political connections to that venue. In addition, certain conditions cause lobbyists to specialize in one branch or a particular branch only, depending on the issue area being lobbied, the interest group type being represented, the lobbyist??s resources, and other factors.     

Reframing the mediation debate in Irish all-issues divorce disputes: from mediation vs. litigation to mediation and litigation

Mediation currently plays a minor role in the Irish family justice system, yet a policy consensus exists that more couples should be encouraged to mediate and that increased rates of mediation will reduce the numbers seeking redress through the courts. The Mediation Act 2017 adopts this position, assuming that the provision of information on mediation will increase uptake and that mediation offers an alternative to litigation for most civil disputes. This article reviews attempts in Ireland, England and Wales to encourage family disputants to mediate, identifying weaknesses in the information strategy. It also examines the legal framework governing all-issues divorce and dissolution in Ireland, pointing to the limited potential for mediation to act as an alternative to litigation. It concludes by arguing that policy focus must shift away from encouraging mediation as an alternative to litigation towards more nuanced understanding of mediation as a support to court based dispute resolution.
