EXTENDING COMITY TO FOREIGN DECREES IN INTERNATIONAL CUSTODY DISPUTES BETWEEN PARENTS IN THE UNITED STATES AND ISLAMIC NATIONS

International custody disputes involving parents and children from Islamic nations and the United States have yielded a spectrum of interpretation of Islamic Shari'a law and the best interests of the child. The lack of a determinative treaty between the United States and all but one Islamic nation has led to an inconsistency of criterion in determining whether to extend comity to a custody decree from a court of an Islamic nation. The domestic law statutes, which determine jurisdiction in these matters, have provisions for international application and recognition of foreign custody decrees. The recognition of custody decrees from the courts of Islamic nations is contingent upon the satisfying of procedural and substantive thresholds. Focusing on the substantive, the author opines that American courts have a responsibility to understand certain aspects of the law, culture, and religion of Islam in order to accurately determine if the threshold has been meet.     

Managerial Perspectives on Implicit Bias,Affirmative Action,and Merit

Public sector organizations concerned about gender inequality have increasingly sought to address the effect of implicit biases on merit‐based employment practices through bias training and affirmative action programs. Applying qualitative content analysis to interviews with 104 managers in three government agencies in which bias training and affirmative action were being implemented, the authors find that many managers acknowledge the existence of implicit biases and their potential to create unequal employment outcomes. However, this recognition of bias does not translate into support for affirmative action, which is seen by many managers to be an unacceptable violation of merit. The authors argue that implicit bias training and affirmative action are unlikely to create a cultural “tipping point” to progress gender equality without a critical reassessment of merit.     

A "Civilised Amateur": Edgar Holt and His Life in Letters and Politics

Now largely forgotten, Edgar George Holt (1904–1988) was a leading journalist and public relations officer in the middle decades of twentieth–century Australia. This article examines his prominent journalistic career in the 1930s and 1940s, his presidency of the Australian Journalists' Association, and his work as the Liberal Party of Australia's public relations officer from 1950 to the early 1970s. The article explores the evolution of his cultural and political views, considering how a literary aesthete and poet came to be at the forefront of the 1944 newspaper strike and then an important player in Australian conservative machine politics and the emerging industry of political public relations.     

Developing critical thinking in NGO field staff

The quality of NGO work is hugely dependent on the quality of critical thinking and analysis of poverty among all levels of staff. In particular, the quality of the work in the field – at partner and community levels – depends on an understanding of development processes and on strong facilitation skills, both of which rely on strong levels of critical thinking. While these are innately present in almost everyone, rote learning in education systems and patriarchal and top–down power structures often impede their development. This article suggests some practical means by which development agencies can develop strong analytical thinking and strong facilitation skills among their staff. While the article is mainly aimed at frontline staff, the implication is that such mechanisms are required at all levels if organisations are going to develop their own capacities.     

The current state of gender-specific delinquency programming

Few attempts to identify “what works” in the crime prevention and offender rehabilitation research specifically address gender. The 1992 reauthorization of the Juvenile Justice and Delinquency Prevention Act, however, called for new research that would improve the processing and treatment of delinquent girls. This article reviews the relevant theoretical and empirical research that both informed the new legislation and took place in response to it. This is followed by an empirical study conducted to: (1) identify gender-specific programs (GSPs), (2) determine the extent to which GSPs utilize applicable research in their design and implementation, and (3) assess the evidence of GSPs' impact on targeted outcomes. The findings from the current study suggested that, in addition to strengthening program evaluation methodology, gender-specific programs for girls need to more meaningfully incorporate relevant theories and gender-specific risk and protective factors into their curriculum.     

The presidential dynamics of leadership decline in contemporary British politics: the illustrative case of Tony Blair

The presidential analogy has provided many explanatory insights into the contemporary development of the British premiership. Nevertheless, the usage of this analytical device is almost invariably confined to the establishment and consolidation of leadership. This article demonstrates that the presidential dimension has comparable utility in accounting for the erosion and decline of leadership. In examining the Blair premiership in relation to three signature themes of the American presidency – public outreach, personalized leadership, and democratic disjunction – the analysis reveals a set of dynamics that not only provides a vehicle for political opposition but largely predetermines the nature and formulation of that critique.
