Tomorrow's psychiatrist should be more cognizant, competent, and comfortable in forensic science matters. Psychiatric cases are increasingly the subjects of litigation, but justice in the court depends on able advocacy by all parties. Advocacy for patient-plaintiffs is more similar to customary clinical roles than is advocacy for defendant insurance companies, which nevertheless are as needful of competent psychiatric experts as patient-plaintiffs if justice is to be done. Ironically, defense psychiatrist can do much to help patient-plaintiffs if they understand their roles correctly. Since legal systems are designed to produce justice, not therapy, the forensic competence of future psychiatrists will help to make litigation more therapeutic and just for patients. This paper describes the peculiarities of psychiatric work in litigated workmen's compensation cases, focusing on the role of the defense psychiatrist. We will highlight the constructive and therapeutically gratifying potentials of this work. Greater familiarity with the process will help to enlist the interest and participation of psychiatrist in workmen's compensation cases for the ultimate benefit of the patients and improvement of the legal system.  相似文献

Water reform in Australia has demanded that water usage for irrigation operates in an environmentally sustainable manner. It has resulted in the need to reduce allocations in some local communities, and to date government policy has relied on economic instruments to take the lead in developing equitable processes to do this. A series of community-based justice studies were undertaken and demonstrated that it is possible to derive a package of actions, which reflect the fairness judgments of the vast majority of the community. However, the implementation of these actions within the decision-making process has proven to be a more complex matter. This paper discusses four professional, methodological, and ethical challenges for all justice researchers. It concludes by noting the applicability of this form of research in other natural resource allocation dilemmas. Therefore it is imperative that justice researchers confidently insert themselves in to environmental policy debates. Only in this way will the social criteria for triple bottom line accounting for sustainable development be adequately represented.  相似文献

This article examines how political institutional structures affect political instability. It classifies polities as autocracies or democracies based on three institutional dimensions: election of the executive, constraints on executive decision-making authority, and extent of political participation. It hypothesizes that strongly autocratic and democratic regimes will exhibit the greatest stability resulting from self-enforcing equilibria, whereby the maintenance of a polity's institutional structure is in the interest of political elites, whether through autocratic or democratic control. Institutionally inconsistent regimes (those exhibiting a mix of institutional characteristics of both democracy and autocracy) lack these self-enforcing characteristics and are expected to be shorter-lived. Using a log-logistic duration model, polity survival time ratios are estimated. Institutionally consistent polities are significantly more stable than institutionally inconsistent polities. The least stable political systems are dictatorships with high levels of political participation. The most unstable configuration for polities with an elected executive is one where the executive is highly constrained, but the electorate is very small.  相似文献

Trends of female access to and presence in responsible governmental positions have gained substantial attention. The research reported here assesses and seeks convergence on several issues associated with gender representation. It extends the research by focusing on top executive posts in American state governments. In particular, the presence of women agency heads in all 50 states is examined from 1970 through 2000 using the lenses of passive representativeness and active representation. The authors find, first, that women face fewer blockages in securing top posts—the glass ceilings are cracking. Second, women's access to peak executive positions springs from more solid educational, career, and organizational foundations or "floors." Third, lateral career movements are penetrating the "walls" surrounding traditionally male-dominated agency types. The essay concludes with a framework for understanding relationships involving passive representativeness, active representation, and representative results. That framework assists in shifting attention toward the consequences of both passive and active representation.  相似文献
