Decision Support Within the Criminal Justice System

The Crown Prosecution Service forms a vital component of the criminal justice system, as the chief organization prosecuting on behalf of the State and therefore the public. This paper highlights those areas where the CPS has attracted most criticism, focusing on sources of inconsistency in decision-making and management practices which may be considered inappropriate in the provision of justice. An example of how new technology could be utilized to improve the service provided by the CPS is presented. This would increase consistency of decision-making by introducing an independent assessment of the 'realistic prospect of conviction' test in the form of a decision support system. The various artificial intelligence tools available are discussed, in addition to a brief summary of why a neural network was felt to be the most suitable for the task under consideration. Preliminary results of a practical test, undertaken using archived data collected from various magistrates'courts are disseminated,together with discussion of the issues raised. Key issues concerning the philosophical and social acceptability of utilizing such a system within the Crown Prosecution Service are addressed by reference to correspondence with representatives of various organizations within the criminal justice system. This method is adopted in order to illustrate problems, both real and perceived, with the notion of utilizing technological support in what is a crucial human process.

Individuals and societal groups are questioning the practice of patenting human genetic material in the context of medical research and health care, where diverse ethical, social, and political objections are being raised by critics. A recent case provides a broad legal theory, the common law cause of action, unjust enrichment, and a precedent for challenging the commercialization and patenting of human genetic material.     

Exploring Definitions of Serious Crime in EU Policy Documents and Academic Publications: A Content Analysis and Policy Implications

In recent years the term “serious crime” has gained prominence in EU policy on internal security. This article analyzes how the EU policy and scientific communities have conceptualized and operationalized the term. Through a content analysis, it evaluates the articulation and use of “serious crime” in EU policy documents published from 1995–2013 and scientific articles published from 2004–13 that include the term (n?=?93 and n?=?104, respectively). The analysis demonstrates deficits of conceptualization and operationalization and a correspondingly weak foundation for policy. While the EU’s increasing emphasis on serious crime could represent an opportunity to improve the accountability of EU crime control policies, it is up to academics and policy-makers to address these deficits.     

The harms of human trafficking: demonstrating the applicability and value of a new framework for systematic,empirical analysis

This article uses human trafficking in Belgium to test a newly developed framework for assessing the harms of crime that has been applied previously to cocaine trafficking in the same country. We chose this criminal activity because of its policy relevance and to address apparent needs for systematic, evidence-based analysis. The framework uses quantitative and qualitative evidence to assess harms to individuals, private-sector entities, and others and to establish crime control priorities. The assessment process models the activity, evaluates the severity and incidence of harms, ranks priorities, and considers causality. We highlight three findings. First, trafficking victims can experience catastrophic harms, but the overall dimensions of human trafficking in Belgium appear to be modest. Second, the evidence suggests significant recent declines in the degree of exploitation and use of violence. Third, most harms to individual victims result directly from the activity, which sets it apart from other forms of trafficking.
