生态环境的严重恶化和自然资源的过度开发,使人类的生存环境受到严重的威胁,环境权概念的提出是人们重视自身环境权益的体现。本文从环境权的内容入手,分析环境权的法律性质,尤其是其和传统物权之间的关系,指出环境权保护在我国传统物权制度中的缺失,希望在未来的物权立法中对环境权保护有所体现,并提出了具体的立法建议。     

Gender construction at work in Icelandic fish plants

In this article we present the results of our studies of gender construction at work in Icelandic fish plants. Our aim is to contribute to the understanding of the processes involved in the gendering of jobs, labour and the organization of work and their interrelations. We argue that an examination of these factors can shed light on larger questions of gender segregation, women's lower position in the labour force and how gender categories and identities are constructed and reconstructed in the workplace.

能动司法若干问题研究

作为一种司法理念或司法方式,中国的能动司法与西方司法能动主义既有知识上的缘脉关系,也有现象上的同质性,但由于各国政治及司法制度的不同,两者亦有一定区别,总体上应将中国能动司法视为世界法治语境中司法能动主义的一种特殊形态。西方司法能动主义是以司法独立性较强、全社会规则化意识较为明确、法官职业化制度较为成熟为基本条件的,因此,对于国情差异较大的中国来说,能动司法在实践形态上对西方司法能动主义应既有保留,又有创新和发展,同时应从多方面建立相应的保障机制,亦即:宏观上,建立良性的司法与政治的互动机制;中观上,建立有效的最高司法机构指导机制;微观上,建立合理而有序的法院内部审判运行机制。     

Construction and application of four fluorescence labeled multiplex typing system for 3 miniSTR loci

We constructed a multiplex PCR system for 3 miniSTR loci D20S482, D3S3053, D6S474. This typing system showed high stability and sensitivity (0.05 ng). Population data investigated in 120 healthy unrelated Chinese Han individuals showed higher genetic polymorphism, with the combined power of discrimination and power of exclusion being 0.998 and 0.84. The amplification product length ranged from 88 bp to 127 bp for all three loci. The successful rate of typing highly degraded samples using this miniSTR multiplex PCR system was significantly higher than using identifiler kit, indicating the multiplex set represents a useful tool in Chinese forensic practice, especially for the highly degraded DNA sample.     

A Genetic Basis for Social Trust?

A propensity to believe that fellow citizens will not act against our interests in social and economic transactions has been identified as key to the effective functioning of democratic polities. Yet the causes of this type of ‘generalized’ or ‘social’ trust are far from clear. To date, researchers within the social and political sciences have focused almost exclusively on social-developmental and political/institutional features of individuals and societies as the primary causal influences. In this paper we investigate the intriguing possibility that social trust might have a genetic, as well as an environmental basis. We use data collected from samples of monozygotic and dizygotic twins to estimate the additive genetic, shared environmental, and non-shared environmental components of trust. Our results show that the majority of the variance in a multi-item trust scale is accounted for by an additive genetic factor. On the other hand, the environmental influences experienced in common by sibling pairs have no discernable effect; the only environmental influences appear to be those that are unique to the individual. Our findings problematise the widely held view that the development of social trust occurs through a process of familial socialization at an early stage of the life course.     

政策能力与国家公共治理

最近二三十年以来,由于市场经济放任模式一再出现危机以及失灵现象,国家公共政策能力问题摆到了政府和学者们的面前。政策能力成为当前各国政府关注的热点,也成为学术研究的重点。然而。政策能力并不是孤立的’它与国家能力、行政能力之间存在着内在的关联性。它们之间既存在上下结构关系,又存在着相互的联动关系。这三个方面的能力共同构成了所谓的公共治理能力。不同国家对政策能力自然具有各自的评价标准,更应具有形成这方面能力的支持系统。论文对以上这些复杂的关系做一尝试性的梳理。
