PAROLEE RECIDIVISM IN CALIFORNIA: THE EFFECT OF NEIGHBORHOOD CONTEXT AND SOCIAL SERVICE AGENCY CHARACTERISTICS*

We studied a sample of reentering parolees in California in 2005–2006 to examine whether the social structural context of the census tract, as well as nearby tracts, along with the relative physical closeness of social service providers affects serious recidivism resulting in imprisonment. We found that a 1 standard deviation increase in the presence of nearby social service providers (within 2 miles) decreases the likelihood of recidivating 41 percent and that this protective effect was particularly strong for African American parolees. This protective effect was diminished by overtaxed services (as proxied by potential demand). We found that higher concentrated disadvantage and social disorder (as measured by bar and liquor store capacity) in the tract increases recidivism and that higher levels of disadvantage and disorder in nearby tracts increase recidivism. A 1 standard deviation increase in the concentrated disadvantage of the focal neighborhood and the surrounding neighborhoods increases the likelihood of recidivating by 26 percent. The findings suggest that the social context to which parolees return (both in their own neighborhood and in nearby neighborhoods), as well as the geographic accessibility of social service agencies, play important roles in their successful reintegration.     

THE SOCIAL CONTEXT OF GUIDELINES CIRCUMVENTION: THE CASE OF FEDERAL DISTRICT COURTS*

Recent scholarship on criminal punishments increasingly highlights the importance of courtroom social contexts. Combining recent data from the U.S. Sentencing Commission (FY1997–2000) with aggregate data on federal districts, the current study examines interdistrict variations in the application of downward departures from the federal sentencing guidelines. Findings indicate that substantial variation exists in the probability of both prosecutor‐initiated substantial assistance departures and judge‐initiated downward departures. This variation is accounted for, in part, by organizational court contexts, such as caseload pressures, and by environmental considerations, such as the racial composition of the district. Additional evidence suggests that individual trial penalties and race disparities are conditioned by aggregate court contexts. Drawing on interviews with federal justice personnel, this article concludes with a discussion of future directions for research on federal guidelines departures. THE reduction of China’s 2012 growth target to 7.5 percent from the eight percent of recent years headlined the international media coverage of PremierWen Jiabao’s report to the National People’s Congress. The announcement was greeted with fallson international stock markets - simultaneously reflecting China’s economic weight and a misanalysis by international markets. But the lowered target,which is justified by the global economic situation,is only the tip of the iceberg of complex short- and long-term challenges China is facing in its economic policy.
