Woodcock v Cumbria Primary Care Trust: The Objective Justification Test for Age Discrimination

This note discusses the limits to the defence of objective justification when applied to direct age discrimination, specifically with regard to situations where the employer attempts to rely on cost‐saving as a legitimate aim. The author examines the jurisprudence of the Court of Justice of the European Union (formerly the European Court of Justice, ECJ) on which this case relies, and considers whether the defence has been interpreted too widely, opening up the possibility of cost‐saving as a defence to discrimination on the grounds of this particular protected characteristic. The note concludes that, while cost‐saving cannot be the sole justification for less favourable treatment by employers, it may nevertheless form part of an overall legitimate aim when coupled with additional factors.     

E-Commerce and Industrial Upgrading in the Chinese Apparel Value Chain

The economic and social gains from electronic commerce (e-commerce) that promote innovation, industry upgrading and economic growth have been widely discussed. China’s successful experience with e-commerce has had a positive effect in transforming consumer-goods sectors of the economy and motivating economic reform. This article looks at how e-commerce reduces barriers to entry and enables firms to move up the value chain by using the global value chain framework to analyse the impact of e-commerce on the upgrading trajectories and governance structures of China’s apparel industry. For large Chinese brands, e-commerce has enabled end-market diversification. For small- and medium-sized enterprises, e-commerce has facilitated entry with functional upgrading as well as end-market upgrading. In the “two-sided markets” created by platform companies, the “engaged consumers” are the demand side of this market, and “e-commerce focused apparel firms” are the supply side of the new market. Consumers and platforms are more directly involved in value creation within this emerging internet-based structure.     

Probation Officers’ Perceptions of Supervising Probationers with Mental Illness in Rural and Urban Settings

As part of a larger study of probation workload and workforce challenges in one southeastern state, this study reports the results from a statewide survey of probation officers’ experiences supervising probationers with mental illness. A total of 615 officers responded to closed- and open-ended questions about the challenges and barriers to supervising offenders with mental illness, and the responses of officers from rural versus urban settings were compared. Officers reported that probationers with mental illness are difficult to supervise and supervision challenges are exacerbated by a scarcity of mental health and substance abuse treatment resources, limited social support, and a lack of employment opportunities for this population of probationers. Officers report unique and similar challenges across rural and urban settings. This study contributes to our understanding of the challenges of supervising probationers with mental illness and informs practice, policy and research at the interface of the criminal justice and mental health systems.     

CHINA'S PENSION CRISIS: SYSTEM REFORMS START WITH RELAXATION OF ONE-CHILD POLICY

China's one-child policy ("OCP") exacerbates the existing weaknesses within the country's pension system.1 This strict family planning measure is the root cause of sub-replacement fertility and rising dependency ratios within the country.Consequently,the one-child policy should not coexist with the nation's currently under-funded retirement security program.In order to avert an impending financial and social crisis,the Chinese government should immediately confront the issue of pension reform.However,designs to improve the retirement security framework cannot be successfully instituted unless,as an initial step,the one-child policy is relaxed.The focal point of this paper delves into the impracticality of the one-child policy in relation to China's pension reform efforts.     

Multivariate analysis for estimating the age of a bloodstain

Our objective is to provide crime laboratories with a technique for estimating the age of a bloodstain. Toward that goal, we have used multiplexed, real-time RT-PCR (or qPCR) to determine the relative stability of different-sized segments of the same RNA species as well as differences in stability between two different RNAs' change over time in bloodstains. Our results indicate that a multivariate analysis of the changing ratio of the different RNA segments can be used to differentiate between samples of different ages in the defined population. Bloodstains from 29 of 30 donors could be partitioned into different ages using this technique. Although further improvements will be required before this approach can be implemented in crime laboratories, the multivariate analysis holds promise of providing a reliable approach for temporally linking a bloodstain to the commission of a crime or excluding a bloodstain as being irrelevant to the case in question.     

The characteristics of a geographical sample of convicted rapists: sexual victimization and compliance in comparison to child molesters

The limited research literature that relates specifically to sexual offenders against adults (rapists) would suggest that they are more likely to demonstrate a greater criminogenic profile but to have experienced fewer childhood and adult psychological difficulties than child molesters. The aim of this study is to describe the characteristics of an urban sample of convicted rapists (n =80), comparing them to a sample of child molesters (n = 230) on background and offense-related variables. Although there were a number of similarities between the two groups, rapists were less likely to have been sexually victimized as a child. The sexual recidivism rate was low (5%) for rapists after an average time at risk of 3 years despite a trend toward them being less compliant in the community. This article comments on the treatment needs of those with a range of psychological difficulties and indicates future directions for research.
