Regarded as a contemporary prophet of the new technology and economy, widely acclaimed author and editor of Wired , Kevin Kelly argues that the realms of nature and human construction are becoming one. Human-made things are becoming more lifelike and life is becoming more engineered. Utilising complexity theory and other concepts fashioned on the paradigmatic logic of biological systems, Kelly envisions a future with radically different forms of social and organisational control. In this future world, control is dispersed in highly pluralistic, open, and decentralised systems. Natural, technological, economic and social elements of the system co-evolve towards a superior, neo-biological civilisation that (among other things) will foster bottom-up control, co-ordinated change and co-operation among all elements. We contest Kelly's metaphysic of the new economy and new technology, arguing that he illicitly collapses technology and the economy into nature, using nature metaphors to legitimate the new forms of economy and organisation. We argue that Kelly fails to factor in the logic of capital into his scenario and does not explore the consequences of the new organisation of economy and new technology for the environment and society.  相似文献

Migration has always been a sensitive issue as it is oftentimes driven by a sense of tragedy and loss. This paper examines the irregular sea migration of the Rohingyan Muslims who fled from Myanmar in order to escape state-sponsored socio-cultural persecution. In their quest to find sanctuary in neighboring states such as Thailand, Malaysia, and Indonesia, the United Nations High Commissioner for Refugees report that thousands are now missing at sea, drowned, or detained in holding centers for undocumented migrants. It is against this factual backdrop that the author has chosen to make an analysis of a coastal state's rights to maritime border control vis a vis its established obligations to irregular sea migrants under the United Nations Convention on the Law of the Sea, the International Convention on Maritime Search and Rescue, the International Convention for the Safety of Life at Sea, the Refugee Convention, and various international human rights instruments. Finally, key regional and bilateral initiatives that deal with the issue will be examined.  相似文献

The teaching of negotiation in law, business, and other professional schools has greatly increased over the last quarter-century. The author sets the stage for a review of two negotiation texts and an educational video by opening with an historical overview of the development of negotiation pedagogy, which has been informed by scholars from many different academic disciplines. Teaching negotiation in law schools (which have a long tradition of the case method style of teaching, which often encourages an energetic but adversarial approach to problem solving) is still relatively new. The two texts and the educational video examined in this essay offer lessons in a wide angle approach to negotiation, which includes (among many other useful topics): ideas fundamental to theory and practice; social and emotional considerations; the role of cultural and gender difference; relationships between principals and representatives; differences among various types of ADR; and applications of various forms of negotiation in many different contexts.  相似文献

Civic participation does not necessarily equate to civic engagement. However, to date, integrated measures of civic engagement that go beyond civic behaviors have not been developed. In this article, we propose an integrated construct of civic engagement, active and engaged citizenship (AEC), that includes behavioral, cognitive, and socioemotional constructs. Using data from 909 adolescents (62.4% girls) who took part in the Grades 8–10 assessments of the longitudinal 4-H Study of Positive Youth Development (PYD), we assessed the structure and measurement invariance of AEC. AEC was proposed as a second-order latent construct that encompasses four first-order latent factors: Civic Duty, Civic Skills, Neighborhood Social Connection, and Civic Participation. Measurement invariance was tested over time (from Grade 8 to Grade 10) and between boys and girls. The results supported strong invariance of AEC over time and between sexes. Implications of AEC for future research and practice are discussed.  相似文献
