This article reviews the legal basis for the development of forensic psychiatry in China, the organization of clinical assessments, and training of forensic psychiatrists. Regulations for the management of patients in Ankang hospitals and the role of forensic psychiatrists within the Criminal Justice system are described. The primary role of forensic psychiatrists is to provide expert opinions on competence to stand trial and criminal responsibility in criminal cases. They are increasingly involved in civil court proceedings and tribunals at the request of a range of official agencies. The clinical cases assessed by Chinese forensic psychiatrists are very similar to those of their counterparts in Western countries, but the organizational and legal framework for these assessments reflects a very different system that has evolved independently. 相似文献

Waste in the Sewer: The Collapse of Accountability and Transparency in Public Finance in Jefferson County,Alabama 总被引:1,自引:0,他引:1
Following failed auctions for sewer debt in April 2008, major bond rating companies downgraded Jefferson County, Alabama’s bond rating to D (default) triggering massive mandatory payments by the county to its creditors. At the time of writing, the county teeters on the brink of actual default and bankruptcy, unable to pay service on its $3.3 billion sewer debt portfolio. If the county defaults, it will be the largest municipal bankruptcy in United States history, eclipsing Orange County, California’s 1994 default. The intriguingly complex tale of the Jefferson County debt crisis is recounted here by identifying and examining failures of transparency and accountability by local bureaucratic and political actors, private financial institutions, as well as the larger regulatory framework governing public finance. Enhanced regulation of local government and the financial sector plus greater local government capacity to close accountability gaps and thus prevent future crises of similar scale in this or other jurisdictions are recommended. 相似文献

Public reporting is increasingly used to enhance accountability and transparency and stimulate performance improvement in the public sector. In Canada performance reporting in the health sector is still in development, and involves a large number of actors. This article reports on the results of a recent intervention by the Canadian Institute for Health Information (CIHI) to develop a platform for pan‐Canadian performance reporting ( http://www.yourhealthsystem.cihi.ca ). It describes approaches taken to: develop a conceptual framework; engage the public in the definition of performance reporting priorities; and select indicators for public reporting. Studies of tax compliance have focused primarily on individual taxpayers rather than representative enterprises. However, this paper examines several determinants of tax compliance perspectives among medium taxpayers. Using an ordered logit model, the associations of psychological and institutional factors with medium taxpayers’ compliance perspectives are analysed. The results indicate that tax law enforcement, penalties, tax awareness, trust in tax authority, and accounting agency are the main determinants increasing medium taxpayers’ high-compliance perspectives and reducing their medium-compliance perspectives. Tax law enforcement and accounting agency also remedy their low-compliance perspectives. These findings provide guidance for policymakers in enhancing tax compliance. 相似文献

Considering the steady and rapid growth of product counterfeiting and the damage it causes to society, it is important for criminology and criminal justice scholars to assist criminal justice officials, industry practitioners, and law makers in understanding the product counterfeiting problem and developing strategies to combat it. However, for researchers to be effective in their advisory role they must first establish what is known about product counterfeiting. As a first step in this process, we investigated relevant published research through a content analysis of 47 articles discussing product counterfeiting published in criminal justice and criminology journals through 2014. We analyzed various characteristics about the articles themselves, their authors, the journals they appeared in, and the nature and extent of their focus on product counterfeiting. Why do majority parties choose to add extreme dead on arrival bills to their legislative agendas rather than enactable legislation? Majorities in Congress choose this strategy in order to accrue political support from their allied interest groups who reliably reward this legislative behavior. By examining all bills that receive floor consideration from 2003 through 2012, as well as interest group scorecards and campaign commercials, I find support for my theory. Dead‐on‐arrival bills generate electoral benefits for majority‐party lawmakers, are more politically valuable than other bills, and are more often used to credit rather than punish legislators. 相似文献

由于淡化理论发展的不完善,美国<1995联邦商标淡化法案>的立法过程过于仓促,使得对商标淡化的界定在法院之间一直存在着可能淡化标准与实际淡化标准的争议.在前不久的Moseley案中,美国联邦最高法院出人意料地裁决,应以实际损害来认定商标淡化的存在.这表面上为争议给出了最终的结论,但是问题远未得到真正的解决.我国在司法实践中对淡化进行界定时可以从中加以借鉴. 相似文献
