Relevanz der Gewerbeberechtigung für die Vollausnahme vom MRG bei Vermietung im Rahmen eines Beherbergungsunternehmens

Für die Anwendung des § 1 Abs 2 Z 1 MRG ist wesentlich, dass die Vermietung im Betrieb des Fremdenbeherbergungsgewerbes erfolgt und die vermieteten R?ume zu einem solchen Gewerbebetrieb geh?ren. Dieser Ausnahmetatbestands ist nicht schon deshalb zu verneinen, weil der Gewerbebetrieb (noch) ohne Gewerbeberechtigung geführt wird. Es müssen aber die übrigen Merkmale einer Vermietung im Rahmen des Betriebs eines Beherbergungsunternehmens vorliegen, etwa dass die überlassung der R?ume mit bestimmten Dienstleistungen (wie Reinigung des Objekts durch den Vermieter und Beistellung der Bettw?sche und von Geschirr) verbunden ist und der vereinbarte Mietzins die Kosten für Strom, Heizung und Wasser enth?lt. Eine l?ngere Dauer der Vermietung schlie?t eine Anwendung des § 1 Abs 2 Z 1 MRG nicht aus.     

Prosecution and Diversion within Criminal Justice Systems in Europe. Aims and Design of a Comparative Study

This article presents the aims, approach and design of a 11 countries study on diversion and prosecution in European Criminal Justice Systems. The basic assumption is that the flood of proceedings is mastered by procedural short cuts and simplifications with the public prosecutor as the key player. The article describes the methods developed in order to compare the different national concepts and and competencies of criminal justice agencies and procedures. Furthermore, it demonstrates the interdependencies of the various articles in this double issue focusing on different parts of the criminal justice system from police to the court.     

The coalition of the willing: Effect of country diversity in an environmental treaty game

It is analyzed how size differences among countries affect the benefits from climate coalitions. It is shown that size differences lead to smaller coalitions and greater benefits than coalitions among identical countries. The importance of trigger strategies for supporting cooperative solutions is considered. A real world example, based on the world’s six largest emitters, is used to illustrate the implications of size differences in terms of emissions versus valuations of benefits. Climate coalitions become smaller when ranking in terms of benefits is different from ranking in terms of emissions. Three cases of benefit valuations are considered: benefits equal (i) share in world emissions, (ii) share in world GDP, and (iii) share of world population.     

Zum Schutz öffentlicher Denkmäler und Naturdenkmäler nach § 304 StGB

Der überkommene strafrechtliche Schutz „?ffentlicher Denkm?ler“ nach § 304 Abs. 1 Alt. 4 StGB findet trotz ungenehmigter Denkmalzerst?rungen in der Praxis zu wenig Anwendung. Er bleibt wegen des einschr?nkenden Merkmals „?ffentlich“ hinter anderen Alternativen des § 304 StGB wie dem Schutz der Naturdenkm?ler nach § 304 Abs. 1 Alt. 5 StGB oder dem Straftatbestand des V?lkerstrafrechts (§ 11 VStGB) zurück. Da der sozialsch?dliche Charakter bei der Zerst?rung von Denkm?lern stets anzunehmen ist, sollte künftig aus kulturstaatlicher Verantwortung für den Schutz aller Denkm?ler auf das Merkmal „?ffentlich“ in § 304 Abs. 1 Alt. 4 StGB verzichtet werden.     

Welfare Implications of User Innovation

Innovation by users is now understood to be an important part of innovative activity in the economy. In this paper we explore the implications of adding innovation by users to existing models of social welfare that currently assume innovation by manufacturers only. We find this addition removes several inefficiencies, and that social welfare is likely to be increased by the presence of user innovation. Implications for policies that can impact users' freedom to innovate are discussed.
