A hydrophilic interaction liquid chromatography electrospray tandem mass spectrometry method for the simultaneous determination of γ-hydroxybutyrate and its precursors in forensic whole blood

A liquid-chromatography-tandem-mass-spectrometry method using pneumatically assisted electrospray ionisation (LC-ESI-MS/MS) was developed for the simultaneous determination of γ-hydroxybutyric acid (GHB), γ-butyrolactone (GBL) and 1,4-butanediol (1,4-BD) in human ante-mortem and post-mortem whole blood. The blood proteins were precipitated using a mixture of methanol and acetonitrile, and the extract was cleaned-up by passage through a polymeric strong cation exchange sorbent. Separation of the analytes and their structural isomers was obtained using a column with a zwitterionic stationary phase. Matrix-matched calibrants, combined with isotope dilution, were used for quantitative analysis. GHB was determined in both positive and negative ion modes. The relative intra-laboratory reproducibility standard deviations were better than 10% and 6% for blood samples at concentrations of 2mg/L and 20-150mg/L, respectively. The mean true extraction recoveries were 80% for GHB and greater than 90% for GBL and 1,4-BD at concentration levels of 20-50mg/L. The limits of detection were approximately 0.5mg/L for GHB and GBL, and 0.02mg/L for 1,4-BD in ante-mortem blood. The corresponding lower limits of quantification were less than 1mg/L for GHB and GBL, and less than 0.1mg/L for 1,4-BD. GBL was unstable in whole blood freshly preserved with a sodium fluoride oxalate mixture, but the stability could be improved significantly by preservation with a sodium fluoride citrate EDTA mixture.     

Identification of 1-butyl-3-(1-(4-methyl)naphthoyl)indole in a herbal mixture

Besides the cannabinoid mimetic JWH-073, a novel 4 methylnaphthoyl homologue of JWH-073 was detected in a herbal mixture. The structure of the compound was elucidated after thin layer chromatographic enrichment from the herbal mixture by nuclear magnetic resonance (NMR) and gas chromatographic mass spectrometric (GC-MS) analysis. The paper outlines data after GC-MS, liquid chromatography mass spectrometry (LC-MS) and NMR spectroscopy, and describes the structure elucidation.     

Evaluation of an electronic comparison system and implementation of a quantitative effectiveness criterion

The identification of fired bullets and spent cartridge cases is one of the key tasks of forensic science. The traditional comparison of signatures on specimen with a large collection with only a microscope is a very tedious and time-consuming work. Fortunately, electronic systems for performing a pre-selection have been invented since the last 25 years. On the basis of an expansive database the electronic comparison system used by the BKA, Germany, is evaluated and a mathematical value is proposed to rate the correlation quality. This effectiveness criterion can be valuable to give an objective assessment of different electronic comparison systems. Additionally, the applicability of the system on different calibres and land engraved area (LEA) width is discussed. The so called scores are also on disposition and their benefit to a decision-making is debated.     

Raman spectroscopy and laser desorption mass spectrometry for minimal destructive forensic analysis of black and color inkjet printed documents

Inkjet ink analysis is the best way to discriminate between printed documents, or even though more difficult, to connect an inkjet printed document with a brand or model of printers. Raman spectroscopy and laser desorption mass spectrometry (LDMS) have been demonstrated as powerful tools for dyes and pigments analysis, which are ink components. The aim of this work is to evaluate the aforementioned techniques for inkjet inks analysis in terms of discriminating power, information quality, and nondestructive capability. So, we investigated 10 different inkjet ink cartridges (primary colors and black), 7 from the HP manufacturer and one each from Epson, Canon and Lexmark. This paper demonstrates the capabilities of three methods: Raman spectroscopy, LDMS and MALDI-MS. Raman spectroscopy, as it is preferable to try the nondestructive approach first, is successfully adapted to the analysis of color printed documents in most cases. For analysis of color inkjet inks by LDMS, we show that a MALDI matrix (9-aminoacridine, 9AA) is needed to desorb and to ionize dyes from most inkjet inks (except Epson inks). Therefore, a method was developed to apply the 9AA MALDI matrix directly onto the piece of paper while avoiding analyte spreading. The obtained mass spectra are very discriminating and lead to information about ink additives and paper compositions. Discrimination of black inkjet printed documents is more difficult because of the common use of carbon black as the principal pigment. We show for the first time the possibility to discriminate between two black-printed documents coming from different, as well as from the same, manufacturers. Mass spectra recorded from black inks in positive ion mode LDMS detect polyethylene glycol polymers which have characteristic mass distributions and end groups. Moreover, software has been developed for rapid and objective comparison of the low mass range of these positive mode LDMS spectra which have characteristic unknown peaks.

Der zum Beweis des Vorliegens der Genehmigungsvoraussetzungen des § 77 GewO 1994 herangezogene Sachverst?ndige kann seiner Beurteilung vom Konsenswerber vorgelegte Messberichte zu Grunde legen, sofern er diese nach eigenverantwortlicher überprüfung für unbedenklich h?lt.     

Keine "Streitigkeit aus dem Vereinsverhältnis" iSd § 8 VerG bei Streit über ein Darlehen an ein Vereinsmitglied

Die Wendung "Streitigkeit aus dem Vereinsverh?ltnis" (§ 8 VerG) erfasst alle privatrechtlichen Streitigkeiten zwischen Vereinsmitgliedern und dem Verein oder Vereinsmitgliedern untereinander, sofern sie in der Vereinsmitgliedschaft wurzeln. Dazu geh?ren zun?chst Streitigkeiten über die Zahlung der Mitgliedsbeitr?ge, aber auch über die Erbringung anderer mit der Mitgliedschaft verknüpfter verm?genswerter Leistungen an den Verein. Beruht der Anspruch nach dem Klagebegehren auf einem selbstst?ndigen vertraglichen Schuldverh?ltnis, für dessen Zustandekommen die Vereinszugeh?rigkeit nicht denknotwendig Voraussetzung ist, liegt seine Grundlage nicht im Vereinsverh?ltnis, sondern in dem zwischen den Streitparteien abgeschlossenen Vertrag. Auch der Umstand, dass die Stellung als Mitglied und/ oder Funktion?r des Vereins das entscheidende Motiv für den Vertragsschluss zu nicht fremdüblichen Konditionen ist (hier: Gew?hrung eines zinsenlosen Darlehens), führt nicht dazu, dass das Grundgesch?ft denknotwendig in der Vereinszugeh?rigkeit wurzelt.     

Präklusion sekundärer durch Verurteilung zu primären Gewährleistungsbehelfen?

Die aus der materiellen Rechtskraft abgeleitete Bindungswirkung zieht eine Pr?klusion von im rechtskr?ftig erledigten Verfahren bereits m?glichem, aber nicht ausgeführtem Vorbringen nach sich. Diese Pr?klusion bezieht sich aber nur auf solche Tatsachen, die zur Vervollst?ndigung oder Entkr?ftung des für das Urteilsbegehren im Vorverfahren ma?geblichen rechtserzeugenden Sachverhalts dienten, sodass neues Vorbringen dann nicht pr?kludiert ist, wenn es mit dem Prozessstoff des Vorverfahrens nicht im Zusammenhang steht. Von einer Vorentscheidung kann dann und soweit abgegangen werden, als sich der ihr ma?geblich zugrunde liegende Sachverhalt ge?ndert hat. Das trifft auf die erst nach Erlassung des Teilanerkenntnisurteils – das auf Verbesserung lautet – stattgefundene Verweigerung des übergebers zu, die einzig zielführende Mangelbehebung (hier: Sanierung eines Parkettbodens) durchzuführen. Wenn der Verbesserungspflichtige objektiv in Verzug ist, kann der Gew?hrleistungsberechtigte (nach Gew?hrleistung alt) das zur M?ngelbehebung erforderliche Deckungskapital verlangen, ohne dass dem ein früheres Begehren auf Verbesserung entgegenstünde. Der Grundsatz "ne bis in idem" schlie?t die Erwirkung eines auf einen anderen Sachverhalt gegründeten Urteils nicht aus.     

Bescheidverkündung nur unmittelbar nach Verhandlung zulässig

Aus § 67g Abs 2 Z 2 AVG folgt, dass die mündliche Verkündung eines Bescheides überhaupt zu entfallen hat, wenn dieser nicht unmittelbar im Anschluss an die mündliche Verhandlung beschlossen werden kann. Eine entgegen § 67g Abs 2 AVG erfolgte mündliche "Verkündung" des Bescheides ist unwirksam, sodass der Bescheid durch die Zustellung der schriftlichen Ausfertigung zu erlassen ist. Eine solche Verkündung unterbricht nicht die Verj?hrung.     

Polytraumatization and trauma symptoms in adolescent boys and girls: interpersonal and noninterpersonal events and moderating effects of adverse family circumstances

The objective of this study was to investigate the cumulative effect of interpersonal and noninterpersonal traumatic life events (IPEs and nIPEs, respectively) on the mental health of adolescents and to determine if the adverse impacts of trauma were moderated by adverse family circumstances (AFC). Adolescents (mean age 16.7 years) from the normative population (n = 462) completed the questionnaire, the Link?ping Youth Life Experience Scale (LYLES), together with Trauma Symptom Checklist for Children (TSCC). The lifetime accumulation of interpersonal, noninterpersonal, and AFC was independently related to trauma-related symptoms in both boys and girls. The number of AFCs moderated the mental health impact of both IPEs and nIPEs in boys but not in girls. Cumulative exposure to both interpersonal and noninterpersonal traumatic events is important for the mental health of adolescents, and, at least for boys, family circumstances seem to be relevant for the impact of trauma. Our results suggest that broader approaches to the study, prevention, and treatment of trauma, including consideration of cumulative exposure, different types of trauma, and additional social risk factors, could be fruitful.
