The areas of Public Finance and Financial Management present potential problems for small and rural local governments. Responses from a survey of West Virginia local public officials were used to examine the severity of these two issues. Both issues were thought to be of equal importance Instead, the findings showed that Public Finance issues rated very high while Financial Management issues rated very low. Potential influences, such as type of locality, professionalism, and metropolitan area status, fail to explain the differences. Ann Diamond has argued that, unless it is called by all thestates, a convention held under Article V of the Constitutionof the United States would be limited to proposing piecemealchanges. Diamond's arguments are flawed. The power of the statesto call a convention to propose amendments is coequal with thepower of Congress to propose amendments and is subject to onlyone explicit limitation. The Convention of 1787 was not attendedby all the states, and it did not delimit two types of futureconventions. This paper examines Scottish licensing law, in particular the granting of licenses to supply alcoholic liquor. Any application for a license must be granted unless one or more of four conditions are fulfilled. One of these, that the award would lead to overprovision, is the central concern of this study. The paper does not investigate why the consumption and distribution of alcohol are regulated nor why regulatory control takes the form it does. 1 The starting point is rather that regulation exists and takes a particular form. Attention is focused on the operation of this regulatory control and with how it might be improved.In the next section, some of the key features of the licensing law and its appeals are reviewed, establishing the importance of evidence of the presence or otherwise of overprovision. Section II discusses the use of density of licensed premises as a measure of provision, indicates the problems, and argues that a measure might be refined and validated by entering it in an equation explaining the retail price of alcoholic beverages. This study employs data on chamber dominance of legislative conferences involving two House-Senate committee pairs to study the phenomenon of first acting chamber victories. Previous research has concluded that the second acting chamber tends to win in conference, because the committee of the first acting chamber dominates the pre-conference shaping of the legislation, leaving its conferees a powerful incentive to compromise differences with the conferees of the second acting chamber in order to ensure that a conference version of the legislation in question can be agreed on. However, previous research has also shown that the first acting chamber inexplicably wins 25 percent of all conferences for which a winner can be determined. This study finds that the critical common factor in these countertrending conferences was the successful attachment of non-committee amendments on the floor of the second acting chamber. Such successful floor amendments seem to substantially mitigate the strategic advantage of the second acting chamber in conference. 相似文献

Abstract: The revised Police and Criminal Evidence Bill attempts to resolve uncertainties in the relationship between police powers to investigate crime and the rights of citizens. The Bill extends police powers in relation to stop and search, arrest, detention for interrogation and search of premises. Citizens are expressly given rights, for instance to consult a solicitor, and the Bill seeks to safeguard the citizen from arbitrary exercise of authority by requiring that reasons for the exercise of coercive powers be recorded. The effectiveness of these safeguards will depend upon the quality of supervision by senior officers and by the courts.
