我国实施股票期权制度的相关法律问题探析

股票期权制度在西方发达国家得到了广泛的应用,在我国也开始实施.我国在实施中,存在着许多法律问题,不利于该制度的推广,因此,相关法律问题的解决显得尤为必要.     

EFFECTS OF FATHER AND MOTHER PARENTING ON CHILDREN'S MENTAL HEALTH IN HIGH‐ AND LOW‐CONFLICT DIVORCES

This article studied the relations of children's mental health problems to the warmth of their relationship with their noncustodial father and custodial mother and the level of conflict between the parents. Using a sample of 182 divorcing families, multiple regression was used to test the independent effect of father warmth, mother warmth, and interparental conflict. Results indicated that father warmth and mother warmth were both independently related to lower child‐externalizing problems. However, the relations between mother and child warmth and child‐internalizing problems were different as a function of interparental conflict and level of warmth with the other parent. Implications for court practices and policies are discussed.

Transformative pathways to world government: a historical institutionalist critiquea

Proposals for world government (WG) have come from a variety of sources including international relations (IR) scholars, economists, normative political theorists and global justice academics. In general, these visions are couched as ideal models to be approximated as closely as possible. The key argument of the article is that, in evaluating the democratic potential of these proposals, we should focus upon the process of designing and building a WG. This is because there is an ineluctable gap between ideal conceptualization and non-ideal realization that emerges through institutionalization. I employ a historical institutionalist lens to describe and problematize potential institutional shifts along a WG pathway. I argue that institutionalizing these ideal visions in our current, non-ideal context would actually exacerbate the democratic deficit. Specifically, building a WG would likely entrench existing inequalities, expand the authority of unaccountable bureaucrats and limit institutional improvements over time. These three points respectively undercut three core values of democratization: equal participation, accountability and institutional revisability. Given this argument, I conclude that an incremental approach—which focuses on advancing values rather than moving towards an ideal model—represents a more productive pathway for global democratization.

Bodies found in the waterways of New York City

We reviewed the case records for all decedents recovered from the waterways of New York City over a three year period (1997-2000). The epidemiological profile, circumstances, toxicology findings, putrefactive changes, date of recovery, length of immersion, and injuries were examined. There were 123 deaths: 52 suicides, 50 undetermined, 16 accidents, and five homicides. The causes of death included: 97 drownings, 13 undetermined, and 13 other. Of all the floating decedents, 27% were without putrefactive change. All found after two or more weeks of immersion were recovered from November to May. The detection of ethanol and illicit drugs was 53% in the accident, 41% in the suicide, and 33% in the undetermined groups. Detection of ethanol and/or drugs of abuse is not a reliable criterion to distinguish suicide from accident. The identification of the deceased is pivotal for determining the manner of these deaths. Therefore, a great reliance is placed upon the medical investigator and the police (including the missing persons bureau) to determine the circumstances and identification of the decedent.
