国内外舆情治理研究热点及趋势分析

以CNKI和Web of science核心数据库收录2002-1-1至2019-12-31文献为研究样本,运用Cite Space软件及文献计量方法,通过国内外文献样本对比研究,分析舆情治理领域研究起源、演化路径、热点及研究趋势。发现:已有的国内外研究热点主要集中在网络舆情演化机理的探讨和分析,使用大数据技术对网络舆情分析、研判、预测和预警,网络舆情监管和治理这三个方面;国外舆情治理的研究趋势是舆情演化影响因素分析、社交媒体情感行为分析和大数据网络舆情技术研究;国内舆情治理研究趋势是舆情信息分析研究、舆情的管理及公共政策制定研究、大数据驱动的隐私保护机制、利益相关者及信息生态研究。研究结论对舆情治理领域科学研究和实践应用具有一定的参考价值。     

EU agencies' involvement in transboundary crisis response: Supporting efforts or leading coordination?

EU agencies have emerged as entities offering technical coordination to member states and support to the European Commission in different policy areas. Their expertise may play a role in responding to unexpected crises. Against this backdrop, we examine under which circumstances EU agencies, through their specialized expertise, are involved in transboundary crisis responses, and when they acquire a leading position in coordinating those responses. To do so, we study four agencies which faced crises: the EBA and the 2012 banking crisis; the ECDC and the 2014 Ebola outbreak; EFSA and the 2011 E. coli outbreak; and Frontex and the 2015 refugee crisis. Our findings discuss to what extent agencies' involvement in transboundary crises is related to functional (sector characteristics) and institutional (delegation of authority) variables. We also identify that under certain political conditions EU agencies' coordination capacity is activated, allowing them to emerge as leading institutions in transboundary crisis resolution.     

The Dynamics of Legal Positivism. Some Remarks on Shiner's Norm and Nature

In a recently published book, Roger Shiner shows that understanding the fundamental discrepancies between different legal theories is important for a better understanding of law itself. He argues that one of the most important tasks of legal philosophers is to take into account the dynamics or conceptual movements generated by positivism and antipositivism. Our paper intends to show that Shiner's analysis can be developed and modified when other relevant elements are introduced into the universe of discourse. We emphasize the importance of a positivistic conception of legal science. According to Shiner, an adequate theory of law must reproduce the way in which legal norms work in the lives of the participants who accept the law. After analyzing the distinction between norms and norm propositions and the relationship between legal science and the external point of view, we show that legal positivism is not committed to reproducing the internal point of view to law.     

论网络犯罪的现象和原因

网络犯罪是典型的计算机犯罪 ,网络的发展 ,既可以促进社会经济的全面发展 ,也有可能给人类社会带来不可估计的损失 ,我们应以客观的态度来看待这个问题。不能盲目惊喜于网络给我们社会带来的种种便利 ,过分夸张网络的无所不能 ,认为发展了科学技术就能自动地解决社会生活中的种种问题 ,而忽视它的不稳定性 ;也不能对网络全面否定 ,忽视网络对社会的推动作用 ,进而人为地限制网络的正常发展 ,这样更是得不偿失的。     

论乡土社会的解纷规则及其优化配置

在乡土社会,人们依据各式各样的规则来解决彼此之间的冲突,制定法和习惯法、伦理道德、风俗习惯、宗教信仰等潜规则皆是被选择的对象。乡土社会的现实状况表明:如果将一切乡土冲突都强行纳入制定法的统辖范围,结果只会适得其反。因此,为了在乡土社会推行现代法治的同时不致破坏其秩序,就必须实现解纷规则的优化配置。

公安工作实践知识具有实践理性知识的性质;在知识型类别上主要包括形式理性化的法律规范知识和教科书知识、目的理性化的经验知识和地方性知识;公安成人教自不同于普通公安高等教育,在所需知识型类别上应以经验性知识和地方性知识为主,从而公安成人教育的模式应根据这种知识论方向,根据成人教育的不同对象合理地设计。
