平凉市位于甘肃东部,地处陕、甘、宁三省(区)交汇处。全市辖一区六县,总人口220万。全市共有乡镇、街道司法所110个,有专兼职司法助理员249人。共有基层人民调解组织2038个,人民调解员8320人。近年来,全市基层司法所和人民调解组织基本实现了规范化建设的目标,充分发挥了司法行     

Designation of oripavine as a basic class of controlled substance. Final rule

This is a final rule issued by the Drug Enforcement Administration (DEA) designating oripavine (3-O-demethylthebaine or 6,7,8,14-tetradehydro-4,5-alpha-epoxy-6-methoxy-17-methylmorphinan-3-ol) as a basic class in schedule II of the Controlled Substances Act (CSA). Although oripavine was not previously listed in schedule II of the CSA, it has been controlled in the United States as a derivative of thebaine and, as such, is controlled as a schedule II controlled substance which includes "Opium and opiate, and any salt, compound, derivative, or preparation of opium or opiate." Oripavine is a derivative of thebaine, a natural constituent of opium, hence oripavine has been and continues to be, by virtue of the definition of "narcotic drug", a schedule II controlled substance. International control of oripavine in schedule I of the 1961 Single Convention on Narcotic Drugs (1961 Convention) during the 50th session of the Commission on Narcotic Drugs (CND) in 2007 prompted the DEA to specifically designate oripavine as a basic class of controlled substance in schedule II of the CSA.     

Import and production quotas for certain List I chemicals. Interim final rule with request for comment

In March 2006, Congress enacted the Combat Methamphetamine Epidemic Act of 2005, which mandates that DEA establish total annual requirements, import quotas, individual manufacturing quotas, and procurement quotas for three List I chemicals--ephedrine, pseudoephedrine, and phenylpropanolamine. DEA is promulgating this rule to incorporate the statutory provisions and make its regulations consistent with the new requirements.     

抽调监狱劳教干警参加社区矫正工作的实践与思考

2003年7月，北京市作为首批试点的六省市之一开展社区矫正工作。同年6月，经北京市社区矫正领导小组研究决定，第一批31名监狱干警被抽调到密云、东城、房山3个区县协助开展工作。截至2007年9月，北京市共抽调了4批410名监狱劳教干警参加社区矫正工作，实现了全市18个区县313个司法所每所一警，个别服刑罪犯多的司法所达到了一所多警。目前，已经轮岗回原单位工作的干警54名，现有干警356名，其中干警领队18各，每区县1名，为副处级领导干部。     

司法鉴定认证认可调研报告

在司法鉴定行业逐步走上规范化、法制化和科学化发展轨道的背景下，司法鉴定质量和质量管理问题日益突显，司法鉴定机构的认证认可已经列入相关管理机关的工作议程。本文从实现鉴定意见的合法性、可靠性和有效性要求出发，针对司法鉴定活动中存在的突出问题，依据相关法律、法规和规章，从司法鉴定质量管理的角度．探讨在司法鉴定领域开展实验室和检查机构资质认定或实验室和检查机构认可的必要性、紧迫性和可行性，分析了当前存在的问题和困难，提出了推进这项工作应当遵循的基本原则，提出了分阶段、分层次、分类别、分地域实施司法鉴定机构认证认可工作的具体建议。     

亲权、法定监护、法定代理之界定

亲权作为身份权的一种,是父母基于身份关系对未成年子女所生之权利,原则上不得由他人代为行使,但日本民法第833条和第867条则有例外规定,即父母均为禁治产人时,其亲权应由父母的法定代理人代为行使。法定监护是监护的一种,它归于民事主体制度,是指根据法律的直接规定而进行的监督、保护等民事活动。立法例上,一些国家既规定亲权又规定监护,而另一些国家只规定监护。法定代理是基于法律的直接规定而进行的代理,它兼具民事主体与民事法律行为双重内涵,是各国法律均予规范的内容。民法理论上,亲权、法定监护和法定代理三者之间在诸多方面存在着牵连与叠合,同时又具有严格的界限和适用范围,它们对民事法律制度的协调与完善起着互补作用,是民事法律制度不可或缺的重要组成部分。
