This article revisits the debate over appropriate approaches to the regulation of technology transfer to developing countries. It begins by contrasting two stylized approaches, labeled for convenience the “New International Economic Order” model and the “Globalization” model, which have historically struggled for acceptance. It then explores the implications for the choice between these or alternative models of the fact that many developing countries presently lack the institutional capacity required to provide optimal regulation of technology transfer. Existing discussions appear either to assume that developing countries possess sufficient institutional capacity to design and implement sophisticated regulatory regimes, or to take the opposite approach and assume a drastic shortage of institutional capacity. Both approaches ignore the intermediate category of countries that do face constraints upon institutional capacity but are striving to overcome them. The analysis here is intended to demonstrate the general point that a country's present and future institutional capacity ought to be considered highly relevant to the design of central aspects of the regime that it uses to regulate technology transfer. The analysis is also designed to highlight the specific need for attention to the distinctive questions of regulatory design which arise in countries that are in the process of enhancing their institutional capacity in this and other regulatory contexts.  相似文献

The United States Environmental Protection Agency (EPA) estimated that 3,000 to 5,000 manufactured gas plants (MGPs) were constructed in the United States (EPA, 2000). Companies located their MGPs near urban waterways due to the close proximity to cheap condensing liquid (water), improved site drainage, and easy access to delivery channels. However, these site selection criteria were shared by other industries, many of which generated PAHs or handled tar. Contemporary environmental forensic investigations must draw upon a detailed understanding of the relationship between MGP history and tar chemistry in order to differentiate between different types of MGP-derived tars and non-MGP impacts. This article describes the history of MGP operations in the U. S. and how chemical fingerprinting can aid in unraveling liability associated with MGP legacy sites.  相似文献

Gottfredson and Hirschi's general theory of crime (1990) has generated an abundance of research testing the proposition that low self‐control is the main cause of crime and analogous behaviors. Less empirical work, however, has examined the factors that give rise to low self‐control. Gottfredson and Hirschi suggest that parents are the sole contributors for either fostering or thwarting low self‐control in their children, explicitly discounting the possibility that genetics may play a key role. Yet genetic research has shown that ADHD and other deficits in the frontostriatal system are highly heritable. Our research thus tests whether “parents matter” in creating low self‐control once genetic influences are taken into account. Using a sample of twin children we find that parenting measures have a weak and inconsistent effect. We address the conceptual and methodological issues associated with the failure to address genetic influences in parenting studies.  相似文献

This article is based upon analysis of biographical data of those men and women who reached the rank of Permanent Secretary in the career civil service between 1900 and 1986. Among other matters, the article gives details of the schools and universities attended by Permanent Secretaries, their age on, and mode of, entry to the civil service, and their career pattern within that service, including the number of departments served in, the age of appointment to the rank of Permanent Secretary, and the length of tenure in that role. The evidence shows that for the present cadre of Permanent Secretaries the route to the top has been characterized by inter-departmental mobility, private office service, and experience in the key central departments of the Treasury and the Cabinet Office.  相似文献

The exchange of rationales among debate participants is necessary for legitimacy in a deliberative democracy. I show that witnesses in congressional committee hearings tend to use falsifiable rationales when they encounter moderate levels of disagreement and shift to nonfalsifiable rationales when they encounter extreme disagreement. I use data from a coding of hearings testimony on the Medicare program, held between 1990 and 2003, as well as from a survey of participating witnesses measuring their perceptions of disagreement at the hearing. The results identify conditions that enhance falsifiable discourse and help to establish the empirical grounding deliberative democratic theory.  相似文献

Beginning with a brief review of the governance literature, a definition of governance in the National Health Service of England and Wales (NHS) is offered. This introduces an analysis of NHS reform, as presented in the recent policy literature. Using narrative theory, I critique this literature with reference to three key actors: the new organizational form of the ‘Foundation Trust’, NHS staff, and NHS patients. For each actor, a motif is identified and examined: ‘freedom’ for Foundation Trusts, ‘clinical governance’ for staff, and ‘choice’ for patients. Each of these motifs is instrumental in the narrative on NHS reform, whose main themes are emancipation, progress and duty. These are common to other political projects. This critique makes the rhetoric underpinning the recent policy literature more explicit, and underlines the created, contingent nature of New Labour’s account of NHS reform.  相似文献

This article makes the case for social democracy in the context of difficult national and international economic conditions and changes in domestic politics that see a Conservative‐dominated Coalition government and the Labour party in Opposition for the first time since 1997. It rejects much current thinking in the Labour party and instead argues that traditional social democratic values, such as equality and social justice, are of contemporary relevance and can only be achieved through a strong central state committed to those values.  相似文献
