Institutional innovation,development and environmental management: An ‘administrative trap’ revisited. Part I

In the first section of this two-part study the author considers the relationship between administrative structure and the persistence of broad ecological problems. This is set in the context of the issues leading to, and identified at, the Stockholm Conference on the Environment in 1972. It is evident that, despite all the interest and effort, the main parameters of environmental well-being show that the situation remains at least as bad. The case is made that there is a considerable dysfunction between the nature of ecological problems and the ‘problem-solving’ structures within the public arena. This dysfunction is here termed the ‘administrative trap’. This section concludes by reviewing three areas in which administrative innovation resulted very largely from the Stockholm initiative: Global Conferences and their attendant Global Institutions; Ministries of the Environment; and ‘reforms’ in the legislative apparatus.     

Queer Black Feminism: The Pleasure Principle

In this critical personal narrative Harris explores some of the gaps between conceptions of feminist thought and feminist practice. Harris focuses on an analysis of race, class, and desire divisions within feminist sexual politics. She suggests a queer black feminist theory and practice that calls into question naturalized identities and communities, and therefore what feminism and feminist practices might entail.     

Perceived fairness of drug-testing policies: An application of Leventhal’s principles of procedural justice

Employees rate the fairness of organizational policies by applying principles of distributive and procedural justice. Using Leventhal’s (1980) Principles of Procedural Justice, the current study surveyed 279 upper-level college and graduate students to determine the impact each principle has on support for drugtesting policies. The results support the hypothesis that drug-testing programs that violate these principles are viewed as unfair.     

What Role Does the "Federalism Bonus" Play in Presidential Selection?

The conflicting outcome of the electoral and popular votes inthe 2000 presidential election provoked calls to abolish oralter the electoral college. One prominent criticism is thatthe institution distorts election outcomes by providing disproportionateinfluence to small states. If each state receives a number ofpresidential electors equal to that states' number of membersin the U.S. House of Representatives plus the two senators,then the "federalism bonus" represents the two electoral collegevotes that correspond to the position of each state as an equalentity in the Senate. This research examines how the "federalismbonus" influences presidential selection by addressing threequestions. First, why did the framers include a federal componentin the electoral college? Second, under what circumstances hasthe "federalism bonus" played a role in presidential selection?Third, how would the various alternatives for reform affectthe federal component of the electoral college, and what isthe likelihood of adoption for each?     

PMS,psychosis and culpability: sound or misguided defense?

Premenstrual Syndrome (PMS) is believed to affect up to 90% of women of reproductive age. A small subset of women have been identified who actually experience psychotic symptoms in the premenstrual phase of their cycles. Not surprisingly, PMS has made it into the courts where it has been offered as a defense for criminal acts. The defense has generally fared poorly in the United States, although it has been successfully used as a factor in supporting diminished capacity in Great Britain. The following paper sets out to review the medical literature on premenstrual syndrome with a particular focus on premenstrual psychosis. Available literature from both medical and legal sources is then utilized to investigate instances in which premenstrual psychosis has been invoked as a defense in the courts.     

The Equity Impacts of Municipal Tax Incentives: Leveling or Tilting the Playing Field?

The widespread use over the past two decades of Michigan's PA 198 Industrial Tax Abatement program provides an opportunity to assess the inter‐urban equity impacts of this economic development tool. Not only has PA 198 been used relatively more often by suburban municipalities, local governments at the metropolitan periphery are more likely to use abatements to attract new plants and new jobs. The older central cities primarily use the program to retain existing jobs, albeit at high cost of lost tax revenues. On balance, it appears that PA 198 has done little to alter the location decisions of participating firms.
