This is a report of data drawn from a study of personal injury actions in the Superior Court of Alameda County, California, and in the federal district court for Northern California, for the period 1880–1900. Tort actions, in this period, were relatively uncommon compared to the number of accidents. The most frequent type of action was against common carriers—railroads and street railways. Malpractice actions were rare. Most fired cases were settled or dropped out before full trial and jury verdict. Though plaintiffs won damages in most jury cases, the overall finding is that the system provided little compensation for most victims of accidents. Tort law and practice disfavored passengers less than employees or "trespassers." Three types of barrier blocked the path to compensation: legal doctrines which made recovery difficult; an accident-compensation system which, especially for workers, discouraged enforcement of claims; and the legal culture, which was a culture of low expectations.  相似文献

Researchers often define adolescent risk taking in terms of individual behaviors such as alcohol and drug use, early sexual activity, and reckless driving. It is not clear whether these behaviors defined by adults as risky have the same meaning for adolescents. This paper describes the development and preliminary testing of an instrument to assess risk taking among young adolescents. The six item scale was constructed by asking small groups of eighth grade boys and girls to describe things that teenagers your age do for excitement or thrills. The measure was then used in a longitudinal study of 758 young adolescents from three rural counties in Maryland. The scale shows good reliability, as indicated by coefficient alpha and factor analyses. Eighth-grade scores on the scale are associated with the initiation of sexual activity and substance use in ninth grade among virgins and nonusers of alcohol, marijuana, cocaine and pills in eighth grade.  相似文献

Using data from two national surveys conducted in 1990 and 1993, this article investigates seven modes of sociopolitical behavior and one form of potential political participation in the context of Norwegian local government. Results indicate that factors associated with alternative modes of activity vary; different types of people tend to choose different channels of involvement. The most pronounced difference is found between activities directed toward influencing public opinion and those intended to influence political decision making more directly. Whereas the former mode is more typically chosen by younger, well-educated single women living in urban areas, the latter is more characteristic of married, better educated men living in smaller municipalities. Findings are characterized by a high degree of stability over the period considered. Only in the case of voting is there a suggestion of some possible change. After decades in which socioeconomic status variables have been of little significance for voting in Norway (a situation explained by the mobilizing effects of organizations), an effect of education was found in the 1993 survey. Also noteworthy is the distribution of participation among the population: rather than being cumulative, different forms of political involvement are relatively widespread.  相似文献

This article compares government expenditures by functional category of the federal government relative to state and local governments and the changes in their respective roles since 1955. The article includes a review of the federal role relative to the state and local role on a function-by-function basis for these three and a half decades. This analysis demonstrates considerable stability in the federal sector and the state and local sector, but also the capacity for change.  相似文献
