Despite some retrenchment, the litigation state remains alive and well. All this litigation has engendered intense debates over whether increased lawsuits represent a rising tide of justice or a flood of frivolous claims. Tort law has been at the center of these debates for decades, standing at the fault line between “tort tale,” “total justice,” and “mixed” narratives about the perils and benefits of litigation. In this article, we use a survey experiment to probe attitudes toward claims for workplace injuries in light of these narratives. We find that our participants held multifaceted views. On one hand, they favored making claims over doing nothing or asking family members for help and saw lawsuits as equally appropriate as filing a government claim or hiring a lawyer to send a demand letter. On the other hand, tort tale themes cast a subtle shadow over our participants' views. When told claimants did not rush to the courts in defiance of tort tale expectations, our participants saw the lawsuit as more justified. Indeed, the more remedies exhausted prior to litigation, the more justifiable the lawsuit seemed, even though repeated denials of claims might undermine faith in their merits. The bottom line, we contend, is that attitudes toward litigation reflect not only the choice of remedy but also how remedies are used, even when the underlying claim is meritorious—a point that could be useful to practitioners and advocates as they weigh claiming options as well as litigation and public communication strategies.  相似文献

Objectives

A substantial body of literature indicates that certain forms of media consumption may increase anxiety about crime and support for social controls. However, few studies have examined whether Internet news consumption is positively associated with such attitudes. The void is significant given the public’s increasing use of online news sources. This study addresses this research gap.

Methods

We draw on data from four national surveys conducted between 2007 and 2013, which collectively include interviews with more than 13,000 Americans. Using OLS and logistic regression, we assess the relationships between exposure to traditional and online media and perceptions of victimization risk, support for punitive crime policies, and views about police powers.

Results

Consistent with prior work, we find positive relationships between exposure to traditional forms of media—television news and crime programming—and anxiety about victimization and support for harsh crime policies. In contrast, Internet news exposure is generally not associated with anxieties about crime or support for getting tough on criminals. However, there is evidence of an interactive relationship between political ideology and Internet news exposure.

Conclusions

The results provide little support for cultivation theory in the context of Internet news consumption. We discuss the import of our findings, and suggest new lines of research to explore the correlates and the effects of exposure to online news sources.

Abstract

We examine the sociomaterial regulation of algorithmic trading against the background of the European Union’s directives on Markets in Financial Instruments (MiFID/MiFIR). Tracing the purification and translation of regulatory practices within a French brokerage firm, we examine the impact of electronic trading on the nature of market access. Central to our analysis is the ‘Blackbox’, a tool designed to manage market access efficiently by collating trade flows and automatically pairing them with trading algorithms. Our findings show that, through a process of ‘abstracting’, purification and translation are kept strictly separate, allowing the broker to meet the regulatory requirements de jure whilst retaining de facto the unregulated advantages of high-speed materiality. We discuss the implications for both the policy and practice of high-speed financial trading.  相似文献

A frequent lament among researchers is that public policy makers should pay more attention to scientific and technical information (STI). If there is any single area where one might expect STI to be used in public policy making and agenda setting it is in science and technology policy. Many of the policy makers in science and technology policy are themselves scientists or researchers and presumably would prove especially receptive to STI. However, STI is only one of many types of information used in policy making and policy actors often differ in the extent to which they view STI as credible, particularly compared to other types of potentially policy‐relevant information. Research on credibility (the believability of information, information types, and media) has shown variance and policy makers’ “credibility maps.” Thus, some policy makers have preference for formal information generally and STI specifically, but others privilege raw data, personal experience, authority, history and anecdote, analogical reasoning, or conformance to ideology, to name just a few of the information choices. Here, we build on the current researchers’ previous bibliometrics‐based work and use data from 41 semi‐structured elite interviews with National Research Council (NRC) executives and staff and NRC committee members concerning the use of STI in reports issued by the NRC. Findings show that the use of STI in NRC reports varies according to the nature of the inquiry and the sponsor. Information used in the reports is based on not only the assessed credibility of information but also its perceived direct relevance and the availability of STI as compared to other types of information. In general, the amount of STI in the NRC reports tends to have modest effects on the likelihood that reports will be used in policy making or by the mass media. More important factors include the timing of the report with respect to political agendas, the party requesting the report, and the enacted roles of NRC staff members and committee chairs.  相似文献

Recent research suggests that an additional $1 of health aid would displace – or crowd out – nearly the same amount in a recipient government’s own health expenditure. Implementing a Sector Wide Approach (SWAp) may exacerbate crowding out because recipient governments should face fewer constraints when allocating health aid. This paper uses rigorous panel data methods to investigate this hypothesised effect of SWAps. We find that SWAps provide not an exacerbating but a potentially protective effect, reducing displacement of government health expenditure. This suggests some aid dollars are more fungible than others, and the mechanism for aid delivery makes a difference.  相似文献

Independent scrutiny can help empower bureaucracy's critics so that they might question “government as usual” tendencies, and therefore pressure governments to produce services as advertised. Our premise is that in order to honestly share access to decisions bureaucracies must share access to the information necessary to make those decisions. In particular, more pointed and sophisticated external scrutiny may embarrass management into fully applying the tools it now has available, but often fails to utilise. Data-based dialogues can make government more responsive and responsible in its use of available resources, that is, more productive and more accountable.  相似文献

This article analyses differences in landownership between smallholders using survey data from six villages in a land abundant region in Indonesia. Differences in landholdings are only partially explained by differences in labour availability. Land‐holdings are positively correlated with educational level, and early settlers have more land than late settlers. The hypothesis is put forward that early settlers are wealthier, and some empirical evidence is offered in support. Finally, the paper uses a conditional logit model of land purchases to test whether wealthier households are better able to purchase (additional) land. The results support this hypothesis.  相似文献
