Conceptualizing and theorizing EU regulatory networks

European regulatory networks (ERNs) play a central role in the formulation, deliberation, and implementation of EU policies and have, thus, become objects of investigation in a fast‐growing scholarly literature. We identify two shortcomings – one conceptual, one theoretical – in the literature on ERNs: First, we argue that the principal–agent approach, which is conventionally used to conceptualize ERNs, overlooks and even misrepresents central features of ERNs. By introducing and applying the “orchestration” framework to ERNs we demonstrate that it better captures the specific characteristics of ERNs. Secondly, explanations for the choice and design of ERNs have treated functional and power‐based accounts as mutually exclusive. We argue instead that explanatory leverage can be gained by combining these two accounts by specifying their respective domains of application. While functional accounts enable us to illuminate why and under what circumstances ERNs are created in the first place (rather than EU agencies or delegation to the Commission), political accounts help us to shed light on variation in the design of ERNs (i.e. why actors opt for rather close or loose network structures). We illustrate the explanatory value‐added of such an approach through two brief case studies on EU telecommunications and competition policies.     

Who's Afraid of WikiLeaks? Missed Opportunities in Political Science Research

Leaked information, such as WikiLeaks’ Cablegate, constitutes a unique and valuable data source for researchers interested in a wide variety of policy‐oriented topics. Yet political scientists have avoided using leaked information in their research. This article argues that we can and should use leaked information as a data source in scholarly research. First, the methodological, ethical, and legal challenges related to the use of leaked information in research have been considered, concluding that none of these present serious obstacles. Second, how political scientists can use leaked information to generate novel and unique insights concerning political phenomena using a variety of quantitative and qualitative methods have been shown. Specifically, how leaked documents reveal important details concerning the Trans‐Pacific Partnership negotiations, and how leaked diplomatic cables highlight a significant disparity between the U.S. government's public attitude toward traditional knowledge and its private behavior have been demonstrated.

患者知情同意权

让患者知情同意义务是近些年来在医疗诉讼过程中逐步从一般注意义务中分化出来的特殊注意义务。IC产生有其深刻的社会背景,医师在医疗行为时要对患者进行充分的告知并取得患者的同意以保障患者自我决定权的实现。     

Föderalismusreform und Umweltrecht*

Der Beitrag befasst sich mit der Entwicklung, der Lage und den möglichen Veränderungen des deutschen Föderalismus im Hinblick auf das Umweltrecht. Die bisher in der Kommission zur Modernisierung der bundesstaatlichen Ordnung geäußerten Vorschläge können nur teilweise überzeugen. Zu empfehlen ist insbesondere ein einheitlicher Kompetenztitel des Bundes für den Umweltschutz im Bereich der konkurrierenden Gesetzgebung. Allgemein sollten die Rahmengesetzgebung und die Grundsatzgesetzgebung ebenso entfallen wie die Möglichkeit des Bundes, gemäß Art. 84 Abs. 1 GG künftig weiter die Einrichtung und das Verwaltungsverfahren der Landesbehörden zu regeln. Large‐scale Map or the A‐Z? The Place of Self‐help Services in Legal Aid

Australian legal aid agencies are increasing their reliance on self-help legal services as part of their service delivery mix. Self-help legal services seek to harness the productive capacity of consumers,enabling wider distribution of legal aid services. The move to self-help services as an alternative to traditional legal service delivery appears to have gained momentum in advance of any sound understandings of what legal consumers, and legal aid consumers in particular, are capable of. In addition to the cost benefits of providing self-help services rather than traditional legal services, these services have been promoted on the basis of their capacity to empower users to address their own legal matters. Examples of the misuse by government agencies of notions of empowerment emphasize the importance of ensuring the usefulness of self-help legal services.     

Reformnotwendigkeiten des Jagdrechts aus Sicht einer Harmonisierung mit dem europäischen und internationalen Recht der Biodiversität und dem Artenschutzrecht

Auf internationaler und nationaler Ebene gibt es eine Vielzahl von Regelungen zum Schutz von Tier- und Pflanzenarten, deren Koh?renz fraglich ist. Der folgende Beitrag geht dieses Problem systematisch an, setzt hierbei einen Akzent auf das europ?ische und internationale Artenschutzrecht zur Erhaltung der Biodiversit?t und dessen Verh?ltnis zum (nationalen) Jagdrecht. Die Reformnotwendigkeiten werden aufgezeigt. Handelsverbote, wie sie insbesondere das Washingtoner Artenschutzübereinkommen und seine europarechtlichen Auspr?gungen aufstellen, k?nnen nur am Rande (tabellarisch) berücksichtigt werden.
