“YOUTH IS ENMESHED IN A HIGHLY DYSFUNCTIONAL FAMILY SYSTEM”: EXPLORING THE RELATIONSHIP AMONG DYSFUNCTIONAL FAMILIES,PARENTAL INCARCERATION,AND JUVENILE COURT DECISION MAKING*

Although prior work has substantiated the role of external attributes in juvenile court decision making, no study to date has examined how family situational factors as well as maternal and paternal incarceration affect juvenile court officials' responses to troubled youth. Using quantitative and qualitative juvenile court data from a large urban county in the southwest, this study draws on attribution theory to examine how family structure, perceptions of family dysfunction, and parental incarceration influence out‐of‐home placement decisions. Findings reveal that juvenile court officials' perceptions of good and bad families inform their decision making. This study emphasizes the need to unravel the intricate effects of maternal and paternal incarceration and officials' attributions about families and family structure on juvenile court decision making.     

QUEER(Y)ING PUBLIC ADMINISTRATION

Queer theory, understood here as a set of political/politicized practices and positions which resist normative knowledge and identities, has emerged as a theoretical perspective having important emancipatory and explanatory power in the arts, humanities and social sciences. Queer theory resists definition ipso facto, residing as it does within a postructuralist paradigm. It has not hitherto featured within the discipline of public administration and we argue the case for its utilisation in this field by first explicating the theory. Here we develop a way of using queer theory to analyse data, notably through the identification of the ‘moments’ of a queer theory analysis: identification of the norms that govern identity, analysis of what is allowable within those norms, and exploration of what is unspeakable. We demonstrate its use via an empirically‐based case study. The lessons from this exercise are then applied to some of our earlier work which we re‐read through a queer theory lens. This shows the great explanatory power offered by the theory, in that it can develop insights that previously have been inaccessible. We conclude with recommendations for its broader application and wider use within public administration.     

Regulating Risky Business: Dilemmas in Security Regulation*

This paper examines the dilemma of regulating the complex and highly differentiated stock market. I argue that regulations, with legitimacy needs for status neutrality, serve mostly to protect investors with limited capacity for managing risk on their own. In competitive markets, players with greater capacity for risk management (e.g., access to market intelligence, sizeable reserves to cushion losses and enhanced technologies for risk assessment) seek out new arrangements for managing risk. These new privatized forms of risk management interact with the markets and market regulation in ways that undermine the regulatory program for those who depend on it most. I illustrate this form of regulatory bias by examining events surrounding Black Monday, the stock market crash of October 1987.     

THE CROSSING OF THE GYAMAN TO THE CROSS OF LORRAINE: WARTIME POLITICS IN WEST ARICA, 1941-1942

In January 1942 virtually the entire leadership of the Gyamankingdom of the Abron crossed the border into Ghana (then theGold Coast), seeking sanctuary from the Vichy controlled administrationof the Côte d'Ivoire. Leaving the cercle of Bonduku, theGyamanhene, joined by several thousand followers who riskedtheir lives and property, declared that ‘they had lefta dead flag’ and had come to ‘continue war untilvictory and the liberation of France, our dear mother country’.The migration occurred at a time when the Gold Coast was completelyencircled by hostile territory. This passage of the Gyaman courtinto Asante's North West Province is a little-known but extraordinarychapter in wartime politics in West Africa. This paper arguesthat the exodus involved a combination of ‘traditional’and ‘modern’ interests, as the Gyaman leaders skilfullymanipulated the colonial system and the wartime situation totheir own advantage. It reviews not only the sequence of events,but probes the role played by British intelligence organizationsin facilitating, if not encouraging, the migration.     

The Denial of Visitation Rights: A Preliminary Look at its Incidence, Correlates, Antecedents and Consequences

The issue of visitation denial has inspired considerable debate and legislative activity. This article presents empirical evidence on the scope of the problem and the relationship between visitation and child support payment behaviors. Visitation denial is shown to be a problem, although reported levels of denial fall below both levels of non-contact by absent parents and non-payment of child support noted in previous research. Visitation difficulties appear to become established fairly early on in the separation/divorce process and fail to deviate over time. Although non-payment of child support cases do not always involve a visitation problem, the two phenomena are related with visitation problem cases being more likely to involve non-payment of child support. The data do not permit a deciphering of causal order in cases that involve both types of non-compliance. However, both phenomena appear to stem from conflict patterns between the parents which are detectable at early stages of the divorce process. These findings inspire several recommendations, including interventions with divorcing parents aimed at enhancing their communication skills and reducing levels of anger and hostility and the need to develop mechanisms in which visitation and child support grievances can be jointly aired.
