Towards a Study of Human Rights Practitioners

The expansion of human rights provisions has produced an increasing number of human rights practitioners and delineated human rights as a field of its own. Questions of who is practicing human rights and how they practice it have become important. This paper considers the question of human rights practice and the agency of practitioners, arguing that practice should not be conceived as the application of philosophy, but instead approached from a sociological point of view. Whatever the structuring effect of political institutions, human rights is being defined more expansively by practitioners. The weakness of international institutions and the interpretive scope of human rights discourse produce significant opportunity for practitioners to interpret the meaning of human rights. Our exploratory interviews of a small sample of practitioners reveal widely varying histories, in which they interpret their own work as “human rights” practice in differing ways. Practitioners who in the past thought of themselves differently, now identify as human rights activists. They are also becoming more professional, but concerned about professionalization. Their self-interpretations reflect these concerns and also respond to the necessities of career events. Through the conscious and unconscious aspects of their practice, practitioners exercise considerable agency in adapting human rights discourse to their own concerns while also being critical of it.

The Acquired Rights Directive and Compulsory Competitive Tendering in the UK: An Economic Perspective

This paper considers neglected economic aspects of the conflict between the desire of EU Member States to extend competitive tendering in their public sectors and EC law which guarantees terms and conditions of employment for workers who are transferred to a new employer. Whilst the Acquired Rights Directive explicitly contains reference to economic considerations, the debate concerning its revision has largely neglected economic analysis. Concentrating upon UK experience, we show how differences in the interpretation of the term economic in the Directive can give rise to a clash between principles of economic and legal decision-making.     

Modeling Risk for Intimate Partner Violence among Recent-Era Veteran-Partner Dyads

Using an actor-partner interdependence model, we examined whether veterans’ posttraumatic stress symptoms (PTSS) contributed to partners’ drug abuse symptoms, whether partners’ drug abuse symptoms contributed to intimate partner violence (IPV) perpetration, and whether drug abuse symptoms mediated PTSS-IPV perpetration associations. Participants were recent-era veterans who participated in the Mid-Atlantic Mental Illness Research, Education and Clinical Center Post-Deployment Mental Health study. Veterans who took part at one site and their partners (N = 49 couples) completed a follow-up study in which drug abuse symptoms and IPV perpetration were assessed. Veterans’ PTSS contributed to veterans’ drug abuse symptoms. Veterans’ drug abuse symptoms were associated with their IPV perpetration (i.e., an actor effect) and their partners’ IPV perpetration (i.e., a crossover effect). Drug abuse symptoms mediated the association between veterans’ PTSS and partners’ reports of IPV perpetration. Findings suggest complex relationships between PTSS, drug abuse problems and IPV perpetration among these dyads.     

Informative Committees and Legislative Performance in the American States

The information theory of legislative organization suggests that legislative committees are designed to provide their parent chamber with necessary information to legislate. Despite empirical evidence for various aspects of the theory, we have limited knowledge of committees’ influence on legislative outputs. I argue that informative committees are more than information providers, that they also substantively impact legislative outcomes. With supportive evidence from the US state legislatures, this article shows that the presence of an informative committee system not only lowers the number of bills introduced to the legislature but also enhances the chamber's efficiency in transforming legislative proposals into laws.
