The use of computers and digital media in unlawful activities has increased so dramatically that investigation of any criminal activity may nowadays produce electronic evidence. However, the rapid growth in the number of criminal cases involving electronic evidence has all‐too‐often found law enforcement and the judiciary badly prepared to deal with the new issues created by this evidence. The gathering, conservation, communication and presentation of the computer‐derived evidence must fulfil legal requirements with regard to the admissibility of the evidence. Electronic evidence that was gathered in a way that was not in accordance with the law will be declared inadmissible and be ruled out of court. This report aims to briefly present the core principles of the law when handling electronic evidence. Therefore, this paper examines the conditions of admissibility of evidence in four European countries. In order to be complete and to give an interesting pan‐European view on the question, the English law system has been chosen to illustrate the functioning of the rules relating to the evidence in a country ruled by common law. 相似文献

Legislative studies are an important branch of political science in the United States and most European countries, but French scholars, during the past twenty years, have somewhat neglected the analysis of parliamentary behaviour. This research note argues that this low interest in the life of national and local assemblies can be explained by the conjunction of two factors: on the one hand, the weakness of parliamentary intervention in France, which results from the increasing importance of the executive branch, at the expenses of assemblies, in the formulation of public policy; on the other, the emancipation of political science from law as well as its openness to the sociological approach during the 1980s and 1990s. 相似文献

The evaluation of the self-heating propensity of a vegetable (or animal) oil may be of significant importance during the investigation of a fire. Unfortunately, iodine value and gas chromatographic-mass spectrometric analysis do not lead to meaningful results in this regard. To the contrary, differential scanning calorimetry (DSC), which does not measure the chemical composition of the oil, but rather its thermodynamic behavior, produces valuable results. After a thorough literature review on the autooxidation of vegetable oils, several oils with different self-heating tendencies were analyzed using a Mettler-Toledo differential scanning calorimeter DSC 25 between 40 degrees C and 500 degrees C. Analyses were carried out both under air and nitrogen atmosphere to identify the phenomena due to autooxidation reactions. Using DSC, it was possible to observe the induction period of the oil (when available), the three different exothermic events, and the autoignition temperature (relatively independent of the oil type). 相似文献

That terrorists, criminals, and their facilitators exploit the global marketplace is well known. While the global movement of illicit goods is well documented, robust empirical evidence linking terrorism and organized crime remains elusive. This article posits Network Science as a means of making these links more apparent. As a critical case study, Hezbollah is quite possibly the most mature globalized terrorist organization, although it thinks of itself as the “Party of God.” However, the means seem to justify the ends: this article shows that Hezbollah’s holy men have no qualms about resorting to pornography, contraband cigarettes, immigration fraud, and credit card fraud to raise funds. Beyond establishing links, Social Network Analysis reveals other important characteristics, such as the relative autonomy from Hezbollah headquarters that local fundraising networks enjoy. That finding implies a paradigm shift: Hezbollah is no less a terrorist organization than an organized crime syndicate. This is apparent in a network’s structure. Transnational Organized Crime is typically about nodes being connected to many others in the network. Yet, Hezbollah fundraising networks allow such connectivity because of the group’s typically high levels of mutual trust and familial relationships. ABSTRACTIn sub-Saharan Africa many individuals rely on non-state health providers, and engagement between state and non-state providers is increasingly common. Little analytic work has been done on the varied models of engagement, resulting in a lack of clarity about the promises and challenges of public–private engagement (PPE) for health. Despite their prevalence, PPEs often fail. Faith-based health providers (FBHPs) form a significant proportion of the non-state health sector in sub-Saharan Africa, and the number of partnerships with FBHPs is increasing. Building on a prior systematic review project that developed a typology of organisational models for PPE for health, this article reports on a secondary analysis, highlighting PPE initiatives with FBHPs. 相似文献

This article examines the role of the World Bank and the oecd in the emergence and circulation of the ‘fragile state’ concept. These organisations were critical to the early development of the concept and in the consolidation of a knowledge-based agenda set out by Western aid donors to justify international assistance to poor and conflict-ridden countries. Attention is focused on three normative processes affecting the production of transnational knowledge: normalisation, fragmentation and assimilation. ‘Normalisation’ is the process by which influential knowledge producers help to transform a rough concept into a widely accepted transnational norm based on expert knowledge, detailed definitions and statistical exercises. Once the concept has been appropriated by several international actors, it undergoes normative ‘fragmentation’ as it is subjected to various interpretations across time and space. ‘Assimilation’ is the process by which the overarching concept is renewed, enriched and gradually adapted through the incorporation of additional insights. The article argues that the World Bank and oecd have functioned as central knowledge hubs, facilitating the circulation of new and controversial ideas on fragile states and their integration into the prevailing policies of the most powerful aid donors. The two organisations have thus taken an active role in the consolidation and perpetuation of the aid donors’ policy doctrine, ultimately protecting it from major normative dissent. 相似文献

The special issue ‘Fragile States: A Political Concept’ investigates the emergence, dissemination and reception of the notion of ‘state fragility’. It analyses the process of conceptualisation, examining how the ‘fragile states’ concept was framed by policy makers to describe reality in accordance with their priorities in the fields of development and security. The contributors to the issue investigate the instrumental use of the ‘state fragility’ label in the legitimisation of Western policy interventions in countries facing violence and profound poverty. They also emphasise the agency of actors ‘on the receiving end’, describing how the elites and governments in so-called ‘fragile states’ have incorporated and reinterpreted the concept to fit their own political agendas. A first set of articles examines the role played by the World Bank, the oecd, the European Union and the g7+ coalition of ‘fragile states’ in the transnational diffusion of the concept, which is understood as a critical element in the new discourse on international aid and security. A second set of papers employs three case studies (Sudan, Indonesia and Uganda) to explore the processes of appropriation, reinterpretation and the strategic use of the ‘fragile state’ concept. 相似文献

Family archives from the French ancien régime period offer the possibility of analyzing complex family strategy in the long term. The present article deals with the Brac family over seven generations, from the sixteenth to the eighteenth century, as it rose in prominence from a start in leatherworking to eventual high office in regional and Parisian public life. Over the centuries, the family accumulated land (the patrimony); used a combination of marital, geographical, professional, and kinship networks to advance its various members; maintained a policy of economic parsimony in its expenditures; and through various procedures favored a single heir in each generation. Though the various lines of the family were geographically dispersed, their activities in the main continued to focus on the ancestral family lands and the local society of its origins. 相似文献
