A fatal case of oleandrin poisoning

The study presents a case of fatal poisoning with oleander leaves in an adult diabetic male. After repeated vomiting, and gastrointestinal distress the patient was admitted at the hospital with cardiac symptoms 1h after the ingestion. Urine samples were assayed immunochemically and by GC-MS for drugs of abuse and for general toxicological screen. Blood was analyzed for alcohol and volatiles by static head space GC-MS. Blood and oleander leaves were analyzed by LC-MS/MS for oleandrin and related compounds, the main cardiac glycosides of Nerium oleander. Oleandrin was detected by LC-MS/MS in the blood sample at a concentration of approximately 10 ng/ml. Another cardiac glycoside with pseudo-molecular ion of m/z 577, a likely structural isomer of oleandrin, was also detected in the blood and oleander leaves. However, by using the response as a function of concentration for oleandrin, this cardiac glycoside was roughly estimated at a concentration of approximately 10 ng/ml in the deceased blood. This would give a total fatal blood concentration of cardiac glycosides of about approximately 20 ng/ml in the deceased blood.

Health and Efficiency: Community Law and National Health Systems in the Light of Müller-Fauré

In Müller-Fauré the Court of Justice has made clear that restricting patients to receiving medical services from their domestic health systems is often contrary to EC Treaty rules on the free movement of services, particularly where the treatment is not in-patient. The patient should generally be able to go abroad for treatment at the expense of their national health authority. This has structural and financial repercussions for health care systems in several Member States, including the United Kingdom, whose systems are premised upon captive patients. It also has broader implications for welfare harmonisation and provision in the European Union. Exceptions are possible, where the implications for the national health system would be very serious, but Müller-Fauré indicates that the Court will not allow national courts or authorities to rely on these too freely.     

Argentina's Landmark 2003 Presidential Election: Renewal and Continuity

This article provides an analysis of the political and socioeconomic context of the April 2003 presidential elections, focusing particularly on the campaign platforms of candidates, the outcome of the first round and the election's consequences for the party system. The election's results were far reaching in many respects. Argentina's longstanding two-party system came to an end with the virtual vanishing of the Radical party (UCR) at the national level. An evolved political culture resulted in new, more rigorous criteria for the selection of candidates. Finally, new political parties (MNR and ARI) emerged that could conceivably improve the quality of democratic governance in the future. In short, the 2001–2002 crisis fostered a significant degree of political renewal. Contrary to some predictions, however, the societal rejection of political parties did not result in either the complete demolition of the party system or the wholesale renovation of the political class. In particular, the Peronist party showcased its staying power and uncanny ability to adapt to new political environments.     

CLIENT AND COUNSELLOR PERCEPTIONS OF THE PROCESS AND OUTCOMES OF FAMILY COURT COUNSELLING IN CASES INVOLVING DOMESTIC VIOLENCE

The Family Court of Australia provides conciliation counselling to couples who are involved in disputes regarding their children following separation. In cases where domestic violence is involved, the appropriateness of providing counselling has been seriously questioned. This study is an extension of earlier work completed by the authors that specifically examined client satisfaction with counselling in cases involving domestic violence. This article examines client and counsellor perceptions of the counselling process and its outcomes.     

EU Criminal Law in National Courts: Breaking the Monopoly?

Growth in EU Competence in the field of criminal law has gradually led to more and more secondary legislation with an impact in the criminal law sphere. Member State Courts are gradually being expected to give effect to these measures in ever more complex ways. This leads to difficult questions about the appropriate extent of such effects given the sovereignty implications of obligations relating to criminal law, and the additional rights concerns triggered by criminal tribunals. This piece argues that while the ECJ has got the balance right in the majority of its case law, in certain circumstances, it has shown too great a willingness to push those concerns aside in the interest of pushing forward with its broader constitutionalizing agenda.
