This paper outlines a new form of justice, called regenerative justice. Regenerative justice is the coupling of restorative justice with the notion of generative justice, which involves the explicit and intentional discovery and building of life meanings, as well as the consideration of the relationships that those meanings have with wrongdoing and ‘making things right’. This exploration comes about after first considering restorative justice, then providing a critique that uncovers potential blind spots in restorative practice. Logotherapeutic techniques, including: Socratic dialogue, attitude modulation, and dereflection, are used by therapists to help people discover meaning and purpose and have successfully assisted crime victims and offenders. Borrowing from these techniques and specific questioning approaches, restorative dialogue facilitators can enhance restorative practice, particularly in the phases of preparation for restorative dialogue and follow-up after restorative dialogue, by deliberately emphasizing meaning-building discussions (generative justice). Therefore, regenerative justice synthesizes the restoration of people and relationships with the generation of peaceful and healing meanings that can help stakeholders in wrongdoing make sense out of suffering and move forward with a sense of purpose. In recent years, focus on the high attrition rates and low conviction rates in sexual assault cases in Scandinavia has increased. Attrition refers to the dropout of cases through the criminal justice system. However, only limited research exists on the importance of suspect characteristics for the legal outcomes in these cases. The present study is the first in Scandinavia to investigate legal and extralegal suspect variables relating to charges and convictions in the criminal justice system regarding suspected offenders in rape and attempted rape cases. All reported cases of rape and attempted rape in the Eastern Jutland Police District from 2008 to 2010 with an identified rape suspect (N = 175) were analysed through binary logistic regression analyses to examine which variables might increase the likelihood of charges or convictions. Results show that suspects with one or more prior sexual assault charges were more likely to be charged and convicted of a rape offence. The results of the present study help improve the understanding of the judicial processing of cases of rape from a different perspective than the victims’ and partially lend support to the hypothesis of ‘the credible criminal’ in terms of investigative and prosecutorial decision-making in rape cases. 相似文献

Residential mobility has substantial negative effects on voter turnout. However, existing studies have been unable to disentangle whether this is due to social costs, informational costs or convenience costs that are related to re-registration. This article analyzes the relevance of the different costs by studying the effect of moving and reassignment to a new polling station in an automatic registration context and using a register-based panel dataset with validated turnout for 2.1 million citizens. The negative effect of moving on turnout does not differ substantially depending on the distance moved from the old neighborhood and it does not matter if citizens change municipality. Thus, the disruption of social ties is the main explanation for the negative effect of moving on turnout. Furthermore, the timing of residential mobility is important as the effect on turnout declines quickly after settling down. This illustrates that large events in citizens’ everyday life close to Election Day can distract them from going to the polling station. Finally, residential mobility mostly affects the turnout of less educated citizens. Consequentially, residential mobility increases inequalities in voter participation, which can be viewed as a democratic problem. 相似文献

Despite the widespread scholarly attention given to get-out-the-vote tactics the recent one and a half decade, few have studied the effect of short text messages (SMS) on voter turnout, and no previous such study has been conducted outside the US. We analyze four SMS experiments with more than 300,000 voters conducted in relation to two elections in Denmark and find intention-to-treat (ITT) effects between 0.33 and 1.82 percentage points with a pooled effect of 0.74 percentage points. Furthermore, we vary the timing and the content of the messages to test existing theories of text messages as mobilization tools. In one experiment, we find messages delivered before Election Day to have a higher effect than those delivered on Election Day, while we find no additional effect of delivering multiple messages. We also vary message content and in general find no significant differences from sending different messages. 相似文献

There is a growing need to develop health‐related indicators for climate change to assist in policy, planning, and evaluation of preventive measures. To date, no environmental health indicators of climate change have been developed specifically for Australia. We conducted a review of the Australian literature relevant to climate change health impacts to find out which exposure–response relationships could be readily used as indicators. The bulk of the literature relates to direct health‐related outcomes of extreme heat, and indirect outcomes associated with air pollution and infectious disease agents. Based on this information, evidence‐based indicators were chosen using the modified Driving force‐Pressure‐State‐Exposure‐Effect‐Action framework. Three groups of health outcome indicators are proposed: direct heat related, air pollution related, and climate‐sensitive infectious diseases. Indicators of human vulnerability to these outcomes are also included. The potential usefulness of and barriers to their use are discussed in the context of relevance for policy makers. 相似文献

The Asian economic crisis ravaged numerous economies in thelate 1990s. Significant social and political disruption followedthe fall in Asian currency prices. The newly industrializedstates of Asia were particularly hard hit, yet some also experiencedswift turnarounds, reaching pre-crisis currency rates and economicoutput. The enduring puzzle of the crisis is the role of bureaucratic-businessties as a background cause of the crisis and determinant ofgovernmental policy responses. In this paper, we adapt Tsebelis'veto player model to include bureaucracy as a formal actor inthe adjustment process. We argue that states that minimizedthe control of developmental bureaucracies over finance anddirect managerial decision-making weakened the institutionalcapacity of bureaucrats to veto adjustment policies, both beforeand after the 1997 crisis. Moreover, we find that a traditionof strategic regulatory guidance is associated with favorableeconomic performance, provided that bureaucrats had subjectedprivate firms or state-owned enterprises to competition (oreven business failure) historically, and where the risks associatedwith financial decisions were not socialized by the state. 相似文献

Committees are the backbone of nearly every modern legislature. Yet there is relatively little knowledge about how committee assignment politics occur in the multiparty parliaments with minority coalition governments that so often are the case in many European countries. Is there a pattern to which MPs are assigned to which committees? In this article the Danish case is used to address this question. A dataset of all committee assignments in the Danish Folketing from the period 1994–2007 has been collected; added to this are data on each MP. The data are analysed using a quantitative approach, and drawing on the literature on committee assignments in the United States Congress and the European Parliament, complementing the vast qualitative studies, and updating the few quantitative studies, of the Danish parliamentary committees. The results show that which variables have an influence on committee assignments varies across parties and that no uniform pattern is found. 相似文献
