U.S. Supreme Court Affirms Potentially Responsible Parties' Right of Action for Cost Recovery

In the wake of the Supreme Court's decision in Aviall—that potentially responsible parties (PRPs) are not permitted to seek contribution from other PRPs under CERCLA unless they have been sued or otherwise settled their CERCLA liability—PRPs and the courts have struggled to identify a remedy for those that voluntarily undertake cleanup of contaminated sites. The Atlantic Research decision resolves a conflict among the circuits and clarifies that PRPs voluntarily incurring cleanup costs pursuant to CERCLA, can maintain an action for cost recovery against other PRPs. The authors discuss the current legal landscape regarding actions for cost recovery as presented in Atlantic Research.     

What does Brexit Tell Us about Our Understanding of European Identity?

This paper reports on a number of Eurobarometer surveys undertaken by the European Commission as a way of reflecting on Brexit and the challenges it poses to European identity. Our work with the surveys has been undertaken in the context of developing an educational game (RU EU?) which will explore European identity. European citizenship and identity have been strongly promoted by the EU but, while they appear to have been accepted at an elite level, the EU—and the UK in particular—have so far not constructed a narrative which has been supported by ‘ordinary’ citizens. Brexit has therefore exposed the failings of European elites in this regard. That said, there is some evidence that the complexities of Brexit have led to a strengthening of European identity in the other EU 27 countries.     

Russia,the West and the 2007–2008 Electoral Cycle: Did the Kremlin Really Fear a ‘Coloured Revolution’?

In the period before the 2007–2008 elections, there was much talk from the regime about the danger of a ‘coloured revolution’ in Russia. The article considers whether the fear of revolution was genuine or artificially created to discredit opposition and strengthen support for the regime. It seems that tensions inside the regime and the unexpected occurrence of the previous coloured revolutions led to real fears of revolution in Russia, although this was in fact unlikely. Russian policy towards the West and the rival election programmes are examined to investigate whether the regime was creating an ‘enemy image’ of the West.

Abstract

As early as Edgar Snow's pioneering Red Star over China (1937), Yan'an was seen as the “defining moment” of the Chinese Communists' rise to power. Beginning in 1935, Mao Zedong set his personal imprint on the party as he successfully guided it from the disaster of the Long March to the “Congress of Victors” in 1945. This set the stage for the final showdown with Chiang Kai-shek and the hapless Nationalists in the civil war of 1946-49. With the victory of the Chinese Communist Party (CCP) in 1949, the experiences of Yan'an became the blueprint for the reconstruction of China along the lines first laid out in that remote and impoverished town in the northeast.
