论医疗纠纷的代替性解决机制

由于在纠纷解决方面所表现出来的简便、经济、快捷、专业性及保密性强等优点 ,代替性纠纷解决机制———ADR(Alternativedisputeresolution )逐渐成为许多国家和地区解决民事纠纷的一大趋势。我国现行医疗纠纷解决机制仍存在着一些问题 ,有待于进一步的改革与完善。根据我国所面临的实际情况 ,将SDR引入医疗纠纷领域是一条快速、有效地解决医疗纠纷的途径。医疗纠纷的代替性解决机制主要包括仲裁、调解以及和解。这三种纠纷解决方式各具特点 ,适用于不同情况下医疗纠纷的解决。     

Controlling School Crime: An Examination of Interorganizational Relations of School and Juvenile Justice Professionals

Abstract Crime in and around schools creates a climate of fear among students and teachers, and disrupts the learning environment. Effective control of school crime demands the cooperative efforts of school and juvenile justice officials. This paper examines the interorganizational relations between school principals, teachers, and juvenile probation officers by comparing survey results from three cities. Findings reveal significant differences onmethods for controlling school crime; and on due process and sharing of school and court records. School and court officials do cooperate in working with students who are under probation supervision; but the extent of their interaction is characterized by a low level of interorganizational relations.

本文介绍一种制备高效价鸡抗人精血清的方法。给10只2kg 以上的公鸡同时静脉和肌肉注射5～10％混合人精液7～8次,获得特异性很强,效价达50,000倍左右的抗血清。通过实验和检案证明,对由于腐败污染、水浸或水洗而含微量精斑的检材,均能检出。     

Just punishments: Guideline sentences and normative consensus

The federal sentencing guidelines prescribe ranges of sentences to be given to persons convicted of felonies in the federal criminal courts. The U.S. Sentencing Commission wrote the guidelines attempting to make sentences conform to community views of appropriate punishments, along with several other criteria. Employing data from a 1994 national sample of adult Americans, designed as a factorial survey, the degree of correspondence is shown between guidelines sentences and those desired by the American public. Although at the individual level only a modest degree of concordance was found, the central tendencies of public opinion (median sentences) were found to correspond quite closely to the guidelines sentences. The major points of disagreement centered around drug trafficking crimes: the guidelines prescribed very long sentences for those crimes and distinguished sharply among trafficking in heroin, powder cocaine, and crack, whereas median sentences desired by the public were much lower and did not distinguish sharply among trafficking in those drugs. We interpret the findings as indicating that the guidelines sentences conform reasonably closely to American normative consensus concerning the sentencing of federal felons.The research reported in this article was commissioned by the U.S. Sentencing Commission. USING A JURY SIMULATION AS A CLASSROOM EXERCISE

The authors' empirical research project considers the effects of differences in actual legal rules on jury decisions and, concurrently, gives business students the opportunity to participate in a realistic jury experience. The project uses actual trial evidence to produce a videotaped simulated trial presentation thereby insuring that the testimony, legal arguments, jury instructions and facts are realistic. To date, approximately 2,000 business students have participated in the simulation, under the supervision of 13 different Academy members at 11 different universities. This article describes the project and its curricular benefits within the context of an introductory course in law.     

应用气相色谱电子捕获检测器检测生物体内拟除虫菊酯杀虫剂

本文研究了一种同时测定生物样品中二氯苯醚菊酯、氯氰菊酯、杀火菊酯、溴氰菊酯的方法,并详细介绍了试管提取净化的过程。在安装电子捕获检测器的气相色谱仪上,选择不同极性的色谱柱和优选操作参数,能使上述4种杀虫剂达到基线分离,并在20～25分钟内同时完成分析。添加生物样品肝、胃,脑、血中的回收率达到70～90％;变异系数在±0.03～0.08范围。应用本文建立的方法,对中毒兔(溴氰菊酯和杀灭菊酯)各脏器均检出了原体杀虫剂,并成功地运用于一些法庭中毒案件的鉴定。
