It is increasingly common that children of divorce are geographically separated from one of their parents. This article considers the challenges that arise from that reality by exploring this problem from a variety of perspectives and by providing practical tips to minimize the impact of the distance. A review of the Ontario caselaw and Arizona Guidelines reveal that certain factors are important in the resolution of these disputes, including: the age of the child, mode of transportation between homes, distance, prior contact, and feasibility of virtual access. Court‐ordered access may include remedies that, absent the distance issue, may be considered extreme, including moving to overnight/extended access periods for young children, permitting children to travel unaccompanied, favoring the nonresident parent for holidays and vacation time, allowing children to decrease contact with the nonresident parent, and decreasing or terminating child support. Where distance dictates the in‐person and virtual access schedules, creative solutions are critical to the successful resolution of these cases. Forward thinking family law professionals can meaningfully help parents to achieve better outcomes for children.  相似文献

To see if unabused children with externalizing behavior disorders display more sexual behaviors and verbalizations than other children in their interactions with anatomically detailed dolls, sixteen 3- to 6-year-olds were compared with 44 nonexternalizing controls. A five-phase structured, detailed interview, and comprehensive coding of videotapes by external raters, was completed on 17 behaviors and verbalizations. As would be expected, externalizing children exhibited more overall activity than non-externalizing children. Also, externalizing children exhibited more behavioral sexual aggression during the body inventory phase, but no other differences in sexual behaviors or verbalizations occurred. Results suggest that most normative data on AD dolls generalize to externalizing children.  相似文献

One of the few laws of political science is the fairly regular relationship in any given plurality electoral system known as thecube law, transforming vote shares into seat shares. In this paper, we develop an altogether different and more robust paradigm relating seats to votes which generates similar results as the cube law. In our model, political parties bargain with each other for an expected number of seats using the ability to gerrymander in determining their bargaining strength. We find that an arbitrated solution to the seat-vote allocation problem generates solutions remarkably similar to the conventional cube-law-based solutions. Thus our model can in some way replace the cube law paradigm. With our model, we are able to evaluate the impact ofBaker v. Carr (1962) on gerrymandering. We also find that proportional representation results can be achieved within our model by allowing non-zero population deviations between districts.I am grateful for the comments and criticism of David Levy, Bernard Grofman, Charles Rowley, William Crain, and Robert Tollison. Responsibility for all errors, of course, remains mine alone. This paper does not necessarily reflect the views of the American Association of Retired Persons.  相似文献

In Thinking About Crime James Q. Wilson brings a new dimension to crime policy research by explicating the failure of criminologists to adequately consider the philosophical perspectives on man and society which underlie alternate policy options. As a result, they rarely appreciate the inherent limits on government efforts to deal with crime. Wilson's consideration of these limitations, together with a critique of causal analysis in criminological thinking, lead him to propose an alternate conceptual framework, policy analysis. Our inspection of Wilson's own thinking reveals, however, that policy analysis is no less problematic and shortsighted than causal analysis, a result we attribute to serious flaws in his critique of criminological thinking and to the incorporation of his own biases about human nature into his conceptual framework. We seek in the concluding section to remove this bias and to demonstrate how policy analysis may be expanded into a more flexible, multi-dimensional framework, one which accounts for different assumptions about human nature and different policy goals.  相似文献
