Under the label ‘youth sanction’ (ungdomssanktion) a new type of sentence for juvenile offenders has been enacted by a 2001 amendment to the Danish Penal Code. The study reported here is an analysis of the 55 sentences imposed over the first year. Widespread disparity and disproportionality in sentencing was found. Statutory requirements regarding the seriousness of the individual case have not in all instances been satisfactorily established. The emergence of the new sanction implies a considerable increase in the intensity of intervention. Being based on a revitalized treatment ideology, the new criminal sanction legitimizes a vast widening of the control measures directed against troubled youth, in particular such offenders who has another ethnic background than Danish. No comprehensive programme or coherent vision regarding treatment methods has been stipulated, and professionals are bewildered and in disagreement regarding such issues. Nothing indicates that the costly efforts will prove to be adequate as rehabilitative and crime preventive tools. The introduction of the youth sanction is part of a contemporary criminal policy agenda dominated by a broad political coalition with an urge to demonstrate ability and readiness to cope with juvenile street crime by employing more ‘consequent’ measures, involving tougher and swifter punishment combined with coerced rehabilitation.  相似文献

This paper suggests a new approach to analyzing the causes of franchise extension. Based on a new dataset, it provides a detailed econometric study of the Great Reform Act of 1832 in the United Kingdom. The analysis yields four main results. First, modernization theory receives limited support. Second, the reform enjoyed some measure of popular support. Third, the threat of revolution had an asymmetric impact on the voting behavior of the pro-reform Whigs and the anti-reform Tories. While the threat might have convinced reluctant reformers among the Whig politicians—and among their patrons—to support the bill, it seems to have hardened the resistance to reform among the Tories. Fourth, ideology played a critical role. Nevertheless, it also appears that self-interest and political expedience explained the votes of many Members of Parliament.  相似文献

The article discusses the nature of the Indian state and of the Indian bureaucracy. During the 1980s, it was widely believed that the Indian bureaucracy constituted a dominant class and that this dominance is the root cause of economic stagnation. When confronted with empirical evidence, this assertion seems less convincing. The complex picture that emerges of the Indian state does not totally contradict the dominant view. This complexity points to a need for a more elaborated theoretical understanding of the role of the state and of the public bureaucracy. The article concludes by sketching the outlines of such a possible revised theoretical framework.  相似文献

There is a renewed interest in whether land reforms can contribute to market development and poverty reduction in Africa. This paper assesses effects on the allocative efficiency of the land rental market of the low-cost approach to land registration and certification of restricted property rights that was implemented in Ethiopia in the late 1990s. Four rounds of a balanced household panel from 16 villages in northern Ethiopia are analysed, showing that land certification initially enhanced land rental market participation of (potential) tenant and landlord households, especially those that are headed by females.  相似文献

This is a brief comment on a meeting held at the Council of Europe in Strasbourg, which discussed ways of improving transnational access to data by law enforcement through the Cybercrime Convention. In particular, the possible introduction of a new protocol, and a guidance note on art. 32(b), were considered. It is argued that there are serious concerns with both proposals. Moreover, the meeting revealed a surprising lack of knowledge as to current levels of cooperation between law enforcement and foreign service providers.  相似文献

Previous studies of the electoral consequences of corruption in Spanish local elections (Jiménez Revista de Investigaciones Políticas y Sociológicas, 6(2):43–76, 2007; Fernández-Vázquez and Rivero 2011, Consecuencias electorales de la corrupción, 20032007. Estudios de Progreso, Fundación Alternativas; Costas et al. European Journal of Political Economy: 28(4):469-484, 2012) have found that voters do not necessarily punish corrupt mayors. As has been pointed out in the comparative literature, the average loss of electoral support by corrupt incumbents is small and does not prevent their reelection most of the times (Jiménez and Caínzos 2006, How far and why do corruption scandals cost votes? In Garrard, J. and Newell, J. (eds.) Scandals in past and contemporary politics. Manchester: Manchester University Press). What remains unsolved, however, is the remarkable variability in this pattern. This article explores some of the micro-level variables that may mediate the effect of corruption scandal on the votes. We focus on three factors: ideological closeness to the incumbent party, political sophistication, and employment status. Our results provide only partial support for our hypotheses, suggesting that the effects of corruption are much more complex than what may seem at first sight.  相似文献

Many studies have shown that there are significant racial disparities in the application of death penalties. In this paper, three studies (N = 484, 94% female), conducted in France, test and explore why racial prejudice and support for the death penalty (SDP) are strongly and positively related. First, prejudice against Arabs remains a significant predictor of SDP, even when ethnocentrism/authoritarianism (Study 1) and Right-Wing Authoritarianism (RWA; Study 2) are statistically controlled. Second, the attribution of criminal traits to Arabs (Study 1) or criminality-based prejudice (Studies 2 and 3) significantly mediates the relationship between racial prejudice and SDP. Finally, a path analysis illustrates that two relatively independent processes could explain the relationship between prejudice towards Arabs and SDP: criminality-based prejudice leading to specific SDP for Arabs and Social Dominance Orientation (Study 3). Together, these results provide support for the racist punitive bias hypothesis. When racist people think about questions of crime and punishment, they frame the issue in racial terms, leading them to support a punitive law which in their minds will mainly punish minority racial groups.  相似文献

In crime cases with available DNA evidence, the amount of DNA is often sparse due to the setting of the crime. In such cases, allelic drop-out of one or more true alleles in STR typing is possible. We present a statistical model for estimating the per locus and overall probability of allelic drop-out using the results of all STR loci in the case sample as reference. The methodology of logistic regression is appropriate for this analysis, and we demonstrate how to incorporate this in a forensic genetic framework.  相似文献

Most of our knowledge about intimate partner homicide (IPH) is based on studies of men, as they outnumber women as perpetrators. From a total cohort of IPHs in Norway from 1990 to 2012 (N?=?177), we investigated differences between male (n?=?157) and female (n?=?20) perpetrators in terms of (a) IPH characteristics and sentencing issues, (b) sociodemographic, contextual and clinical factors, and (c) previous intimate partner violence. Multivariate logistic regression analyses indicated that, in comparison to male perpetrators, female perpetrators were more often in intimate partnerships without mutual children, had a greater number of accumulated welfare deficiencies, and tended to be ascribed different motives (fear and revenge) for their crimes.  相似文献

This study explores the effects of the 2008 global economic crisis on the labor allocation and productivity in Luxembourg. The analysis is based on firm-level data from manufacturing and non-financial service sectors and finds a dramatic productivity slowdown after 2008. The study reveals that the cleansing effect of recession did not function effectively which would otherwise improve the efficiency in the labor allocation and counterbalance the productivity slowdown. The firm entry and job creation rates are lower in the post-crisis period, but the job destruction is not significantly altered by the crisis. The findings call attention for the strict employment protection legislation that possibly plays a role in preventing reallocation towards more efficient establishments. Relaxing the employment protection legislation simultaneously with facilitating the entry and growth of young firms is expected to promote creative destruction, improve allocative efficiency and speed up the post-crisis recovery.  相似文献
