PARTICIPANTS’ EVALUATIONS OF ASPECTS OF THE LEGAL CHILD CUSTODY PROCESS AND PREFERENCES FOR COURT SERVICES

Domestic relations courts continue to experience large caseloads. As the volume of cases in which families are in crisis continues to grow, policy makers, practitioners, judges, and attorneys struggle to meet the growing demand and seek more effective ways to address the needs and issues of those who are engaged in child custody processes. The present study provides an examination of parent attitudes concerning various aspects of the legal process and preferences concerning a variety of court‐based family services and interventions.     

Revolving Fund Finance: The Case of Wastewater Treatment

This article examines the general topic of revolving fund finance by looking at the specific case of wastewater treatment. The analysis that follows focuses on the organization and administration of the fund to see what types of benefits are generated for the future rather than the present.     

Gender Differences in Agency Head Salaries: The Case of Public Educaton

This study demonstrates a quantitative approach to assessing gender discrimination in public salaries at the individual level. Using data from more than 1,000 school districts in Texas over a period of four years, the results show that gender differences in superintendents' salaries are subtle rather than systematic. Female superintendents who replace male superintendents receive lower compensation. Local district wealth also interacts with gender to affect salaries.     

Effectiveness of Risk-Needs-Responsivity-Based Family Violence Programs with Male Offenders

The following presents the outcome of an evaluation of family violence prevention programs for male offenders. The moderate and high intensity programs were designed and implemented to conform to the Risk-Needs-Responsivity (RNR) principles. Results showed that program participation significantly reduced attitudes that supported violence against women and improved pro-social skills related to non-abusive relationships; treatment effects were moderate to high. Parole officer feedback generally reported positive changes in behavior and attitude associated with treatment. A post-release follow-up indicated that program completion significantly reduced spousal violence and general violent recidivism. Program participation did not, however, have a significant impact on non-violent crime. Results indicate that domestic violence programs respecting the RNR principles may be effective in reducing partner violence.     

Durie v Gardiner: Public Libel Law and Stare Non Decisis

This note examines the controversial case of Durie v Gardiner, a recent decision of the Court of Appeal of New Zealand, which radically altered the nation's public libel jurisprudence. It argues that Durie is incorrect as a matter of public libel law for three reasons. First, both Durie judgments failed to engage in freedom of expression theorising. Second, this undertheorising has caused significant confusion in Durie, including misinterpretation of material facts, breakdown of the ‘theory-doctrine’ interface, and a precipitous and unwarranted dismissal of the Court of Appeal's settled public libel principles. Third, owing to these difficulties, the Durie courts were in no position to import a new ‘public interest’ defence from foreign jurisdictions. Above all, by hastening towards wholesale law reform and ignoring its earlier comparative law deliberations, Durie arguably scuppers public libel law's best hope for advancement.     

Contemporary criminal defence practice: importance of active involvement at the investigative stage and related training requirements

ABSTRACT

The shifting focus of criminal proceedings from the trial to the pre-trial stages leads to a changing role of criminal defence practitioners across Europe. European criminal defence lawyers are now expected to enter the proceedings earlier and exercise “active” and “participatory” defence as early as the investigative stage. Criminal lawyers, trained in the traditional trial-centred paradigm, are ill-prepared for this role, which results in an important skills gap. Legal representation at the investigative stage presents unique challenges, such as shortage of information, time pressures and the closed nature of pre-trial proceedings. It requires lawyers to operate in a more complex communication environment, than the one to which they have been accustomed. This article sets out the main elements of a professional training programme aiming to fill in the emerging skills gap. The training programme (SUPRALAT) was successfully implemented in Belgium, Hungary, Ireland and the Netherlands, and is being expanded further. The training focuses on effective communication skills, experiential learning and the development of reflective skills. It includes elements of interprofessional training and encourages the development of “communities of practice”.     

Structures of feeling: contemporary research in women’s film and broadcasting history

ABSTRACT

This special issue is the second volume originating from the ‘Doing Women’s Film and Television Histories III’ international conference held at the Phoenix Cinema, Leicester, England, in May 2016. It connects with concerns and questions of women’s production histories related to the constructed nature of history and how we write a ‘history from below’ to foreground the hidden, marginalised or forgotten histories of our women ancestors. This collection captures something of the dominant ‘structures of feeling’ of women’s film and broadcasting history scholarship in the contemporary period ranging from considerations of women working in both above and below-the-line roles in film, television and radio, to those whose labour fell outside of mainstream cinema production, as in the instance of the amateur film in the UK between the 1930s and 1980. Together, these case studies span from 1926 to the contemporary period, providing particular flashpoints of women’s history across the UK, North America, Italy and Australia.
