China’s ten years in the wto: its performance and new challenges

Becoming a member of the WTO in 2001 was a historic event of great significance during the process of China’s reform and opening up. Since then, China has steadily pushed forward the reform and opening up policy, proactively seizing the opportunities of economic globalization and positively utilizing the multilateral trading system to develop economic and trade relations with other countries, all of which have contributed to the great economic and social achievements during the first decade of 21st century. However, there are different opinions on China’s futuristic role in the WTO, and those disagreements resulting from various interest preferences are not only one-sided and limited, but also triggering off the discussions on the criteria to assess China’s performance in the WTO. This article argues that China’s activities in the WTO (i.e., implementing WTO commitments, participating in the Doha Round negotiation, the dispute settlement and trade policy review) should be a kind of assessment criteria. Based on comprehensive observation of China’s performance in the WTO, it is concluded in this article that China’s participation in the WTO system and global trade governance extends the scope of world trade law, improves its effectiveness, constitutes China’s new contributions to implement treaty obligations in good faith, resolves peacefully international trade disputes, and maintains substantively the international rule of law. At the same time, it has not only caused new driving forces for international trading system, but also made China face new challenges in the WTO.     

Validation studies of the ParaDNA® Intelligence System with artificial evidence items

Short tandem repeat (STR) profiling is one of the mostly used systems for forensic applications. In certain circumstances, STR profiling is time-consuming and costly, which potentially leads to delays in criminal investigations. LGC (Laboratory of the Government Chemist, UK) Forensics has developed a robust STR profiling platform called the ParaDNA^® Intelligence Test System which can provide early tactical intelligence and aid investigators in making informed decisions on sample prioritization for detection. Here, we validated the ParaDNA intelligence test for its application in forensic cases using a range of mock evidence items following guidelines set by the Scientific Working Group on DNA Analysis Methods (SWGDAM). Specifically, we tested the sensitivity and accuracy of the ParaDNA intelligence test, as well as the success rates for detecting mock samples and for use in case scenarios. Our findings demonstrate that the ParaDNA intelligence test generates useful DNA profiles, especially for samples such as blood, saliva, and semen that contain ample DNA, indicating the benefits of including ParaDNA as a prior step in forensic STR profiling pipelines.

我国刑事诉讼卷宗移送方式的困境及其改革出路

我国原刑事诉讼法采用的全部卷宗移送方式因易导致法官预断而致庭审流于形式,在刑事诉讼法修改时遭到废弃。新刑事诉讼法采用的部分卷宗移送主义因其改革的不彻底性又产生了种种弊端。部分学者因之提出了借鉴“起诉状一本主义”改革我国卷宗移送方式的思路。但在我国刑事诉讼改革方向尚不明确,起诉状一本主义需要的各项配套制度尚未建立的情况下,贸然实施起诉状一本主义必然导致制度内部的冲突,甚而会因制度的反作用而产生始料未及的结果。因此,暂缓实行与我国诉讼制度适应性前景无法预料的“起诉状一本主义”,结合我国国情,重塑预审程序,实现庭审法官和预审法官的职责分离,将卷宗移送划分为向预审法官的证据移送和向庭审法官的证据移送是较为合理选择。

Railway Sector Reform in China: controversy and problems

The railway sector in China has undergone several major rounds of reform and institutional restructuring since 1986. These reform initiatives have largely been unsuccessful due to strong resistance from vested interest groups. The development of China's railway sector has raised some challenging issues that include the centralization of power in the Ministry of Railways (MOR), state monopoly control, rampant corruption and the accumulation of a huge debt burden. The 2013 railway reform initiatives have provided very little in the way of concrete measures to deal with these thorny issues but have instead created more controversy and problems in an already crisis-ridden sector. For the railway industry, the transformation from the mixed-function MOR to a monopolistic China Railway Corporation (CRC) will not necessarily lead to better railway management.
