英美刑法上的被害人共同责任

在认定行为人的刑事责任时,英美刑法传统上坚持"不得谴责被害人"的原则,但这一原则不符合被害人学的原理,而且,在英美刑法中,实际上在诸多方面例如被害人同意、自我防卫与挑衅行为中均承认了被害人的共同责任。承认被害人的共同责任,具有合理的规范性基础。根据权利的限定性原理,被害人共同责任可区分为自愿的权利减少型和非自愿的权利减少型,在此基础上考虑行为人与被害人在具体案件中相关权利的重要性程度、比较因果关系与比较罪责等因素,从而为被害人共同责任的适用提供了具体的判断标准。英美刑法的被害人共同责任原理对我国司法实践具有重要的借鉴价值。

正值改革发展关键时期,在认同职工队伍思想主流健康向上的前提下,不能忽视一些思想领域的新问题及其背后的现实原因,包括职工社会地位和认同度较低、生活压力较大、劳动关系和谐度有待提高、维权方式和诉求渠道相对有限、理想信念出现小范围的分化、业余精神文化生活亟待丰富等。做好新时期职工思想政治工作,需从经济、政治、社会环境等各方面协同发力,一是要以"微"手段弘扬主旋律提高职工思想政治工作的人文性与科学性、实效性与时效性;二是推动收入分配制度改革,切实保障广大职工分享改革红利;三是健全社会保障体制,提高职工的幸福指数和认同感;四是畅通参政议政渠道,增强职工的话语权和责任感;五是发挥工会"枢纽型"社会组织的服务功能,当好职工的"娘家人"。

李可博士新著《权利 权威与公正》以实证调研材料为分析对象,运用法社会学和法规范学的方法展开研究。该书对被征地农民、用地单位、征地部门的行为进行微观分析,探寻其中的规律特征,认为当下农民土地权益难以保障的困境根源在于土地权利体系的缺失,因而应通过设立耕作权及土地权利体系完善的方式解决问题,但该种思路难免存在诸多问题。李可博士提出的"菲尔图"对行政权力与公民权利的关系研究具有重要的理论意义。

如何提高积极分子群体的质量是基层党建工作面临的重要问题之一,建立一套有效的评价体系对提高积极分子质量具有积极的促进作用。本文利用积极分子自评和群众他评构建双轨评价体系,对大学生入党积极分子质量评价指标体系进行探索,同时对双轨评价体系的结果进行比较分析,将积极分子存在的问题进行分级量化,并在后续工作中将分析结果应用于基层组织的评价指标体系建立中。     

The development of a new labour framework during the Second Republic in Spain: the Central Service for job placement and defence against unemployment

The Great Depression affected the Spanish economy, sharply increasing the number of unemployed workers, known as the ‘sin trabajo’. In an effort to address problems with the labour market, the Central Office for Job Placement and Defence against Unemployment was established in 1931 for the purpose, in Niceto Alcalá-Zamora’s words, of heading off ‘regrettable passions and misadventures of a social or political nature’. The ‘reformist challenge’ to the traditional social order would commence that same year, when the PSOE’s Largo Caballero became head of the Ministry of Labour. The staff of the Central Office for Job Placement were aware of proposals by Keynes and other economists regarding this issue, so it can be said that in addition to responding to the urgent social pressure of the moment, the employment policies implemented also sought added legitimacy in the context of theoretical trends that enjoyed consensus at that time.     

Democracy and corruption: a complex relationship

We argue that an ‘electoral democracy’ is not sufficient to reduce corruption. Our contention is that the institutions associated with mature democracy are crucial to successfully deterring corrupt behaviour. At the core of our argument is the idea that with well-functioning institutions, the probability of detection and punishment is sufficiently high to deter most decision makers from choosing to act corruptly. The empirical evidence we present supports this idea. The nonlinearity of democracy variables is tested to confirm that an advanced stage of democracy is crucial for combating corruption.

The Contingent Effects of Risk Perception on Risk-Taking Behavior: Adolescent Participative Orientation and Marijuana Use

Viewing marijuana use as a risk-taking behavior, we find that the perception of high risk related to regular use of marijuana has no simple direct effect on that risk-taking behavior. Rather, the effect of risk perception is contingent upon the extent of youth participation in activities such as going to parties, going to bars, attending concerts and visiting friends. The perception of risk suppresses marijuana use most effectively in the context of activities where such a risk-taking behavior is most prevalent. These findings are congruent with recent literature on actions of risk-taking that takes into account the subjective meaning orientation as a moderator between perception and action. These lead us to conclude that a behavioral-specific approach can augment the conventional approach to common factors underlying the youths' proneness to problem behaviors.
