In this essay, I explore the meaning of the legal profession (the defence attorney). I carry out my investigation in the interactional register. I suggest that we examine the profession of defence attorney as a professional identity in becoming. I localize the event of becoming in the first attorney-client interview. I propose that it is during the first encounter that the attorney comes to stand for the client as a legal counsel. I further propose that the analogy of ‘standing for’ be accessed empirically through an analysis of a recorded episode from the first attorney-client conference. For my methods I use a combination of frame analysis and conversation analysis. The two analyses show how the attorney becomes to stand for the client as a legal figure moulded in a series of interactional moves. By reformulating and reframing the ordinary talk that is introduced as an entry mode into an institutional relationship, the attorney and the client alter their discursive positions until the attorney assumes his professional identity, that is, becomes to stand for the client in legal action.  相似文献

The removal of the President of the United States from office is a rare and significant event. This study investigated the influence of procedural fairness and blame attributions on punishment and support attitudes during the 1998 impeachment of President Clinton. This study assessed the influence of the procedural fairness of Clinton's behavior, procedural fairness of the Kenneth Starr/Congress investigation, satisfaction with Clinton policies, and blame attributions on punishment attitudes (i.e., whether Clinton should be removed from office) and support attitudes (i.e., whether individuals would vote for Clinton if an election were held today). Both the procedural fairness of Starr/Congress and procedural fairness of Clinton' behavior significantly influenced punishment and support attitudes. Procedural fairness of Clinton had indirect effects on punishment attitudes (through perceived blame of Clinton) and direct effects on support attitudes. Procedural fairness of Starr/Congress had direct effects on both punishment and support attitudes.  相似文献

The aim of this article is to analyse the nexus of integration and disintegration processes in the post-Soviet space. On the one hand it considers ‘formal’ regionalism projects and the reasons for their inefficiency, and explores the real impetus behind the repeated attempts at top-down regional integration by post-Soviet elites. On the other hand, it analyses the bottom-up regionalisation of the post-Soviet space through the investment activity of Russian corporations, and demonstrates possible effects of this process for institutional development.  相似文献

The current investigation examined cross-national similarities and differences in routine activities, measures of deviance, and their relationship in representative samples of 7,000 adolescents aged 1519 years (mean age: 17.5 years) from Hungary, the Netherlands, Switzerland, and the United States. For the majority of youth, most of their time was spent in solitary activities, followed by peer activities, community/sports activities, and family activities; Hungarian youth reported spending a much greater amount of time with the family than adolescents from other countries, while Dutch youth spent far more time in solitary activities than their peers. Rates of total deviance were remarkably similar for American, Dutch, and Swiss youth; Hungarian youth reported substantially lower rates than all other adolescents. Finally, findings indicated that routine activities accounted for 18% for males and 16% for females of the variance explained in total deviance. Furthermore, with the exceptions of alcohol and drug use, country had very little or no explanatory power in deviance. The current study suggests that the utility and the explanatory power of the routine activities framework replicates across national boundaries.  相似文献

Abstract: Anyone who has followed the evolution of six European nations from a simple Coal and Steel Community to the current twenty‐five Member State European Union (EU), has witnessed a truly remarkable passage. Nonetheless, the EU remains a decidedly jerrybuilt affair. Through numerous enlargements, increased competences, changes in structure and operation, the Union has been bedevilled by the fact that it is neither a simple international treaty with 25 signatories, nor a truly federal union. Rather, the EU has operated, sometimes effectively, often shakily, between these two extremes; exhibiting a sort of ‘fear of federalism’. From a US perspective, this article looks at the present state of the European Union and asks why it has met its potential in some ways, but has fallen so far short in others. Obviously, the tension between the Member States and the Community institutions is one reason. The article asks why do the states compete so much with one another, when their true competition is often with non‐European entities? Why does the European Council never seem to act in a timely manner? Why do euro‐citizens have so poor of an appreciation of what the Community does for them? Why does the Common Agricultural Policy, which contributes such a small amount to European gross domestic product, so dominate the EU budget and agenda? Can the euro, clearly the world's second currency after the US dollar, ever win over its doubters and harmonise European financial service markets? Does enlargement improve or threaten the future of the Community? And can its Common Foreign and Security Policy ever be successful if it is forced to compete with parallel politics in the Member States? All of these questions are addressed in this article with the hope that, through an external critique, the EU will live up to its potential both at home and abroad.  相似文献
