Student peer aggression has become an issue of considerable concern in schools and their surrounding communities. While a considerable volume of research and writing now exists on how this problem might be best managed, little has been written concerning the place of law in the management process. Nonetheless, in view of the long term effects of student peer aggression on both aggressors and aggressed, it behoves school administrators and teachers to have a sound awareness of the many issues associated with this form of behaviour. In particular it is advisable for staff to have a sound appreciation of the potential legal repercussions that can be the result of a failure to exercise an appropriate level of the duty of care owed to students in relation to peer aggression. This article examines recent research into student peer aggression in Australia and elsewhere. Reasons advanced to explain this form of behaviour are discussed, the characteristics of aggressors and aggressed examined, and consequences of student peer aggression explored. Restorative conferencing is a new style of criminal justice intervention which is being increasingly used in Britain, especially as a method of delivering police cautions to youth offenders.Is is currently the subject of a lively debate, focusing on its effectiveness as a method of crime reduction, its benefits tovictims, its feasibility in modern society, its effect upon procedural rights of arrestees, and the danger of it becoming a degradation ceremony. This paper seeks to extend the debate to include less obvious, but equally important, issues. The paper focuses on the processes of reintegrative shaming which, inspired by the work of John Braithwaite, are at the core of restorative conferencing. It places these processes in broader historical and cultural contexts, such as the re-emergence ofshame sanctions in the USA, the attack on the notion ofshame launched by cultural radicals, and the changes which have occurred historically in our emotional response to offenders.Three sets of questions emerge: What is the political –as distinct from penal – meaning of the practice of shaming offenders? The graphic and widespread atrocities committed during conflicts around the world and broadcast across 24/7 news and social media have made war never feel so close and the powerlessness of law seem so real. This raises difficulties in engaging students in real-life decision-making quandaries where military necessity meets legalism, as well as fundamental ethical questions about the use of realistic, yet explicit, imagery in the classroom. The School of Law at Queen’s University Belfast has developed a series of innovative computer scenarios based on the Arma 3 open world tactical war simulator. A variety of formative scenarios (addressing issues such as cluster munitions and landmines) were developed to familiarise the students with the factual scenario and the computer technology. Subsequently, students engaged in a summative assessment to test their legal understanding in the face of increasingly challenging conflict situations, in particular grey zones where legal argument can justify seemingly morally wrongful acts during war. This paper examines both the learning objectives of this project, and the project development cycle – from the initial proposal to its implementation in class, as well as positing the benefits and drawbacks in integrating technology and games into the legal teaching environment, reflecting on the emerging and traditional pedagogy in this area. 相似文献
