Democracies only: When do IMF agreements serve as a seal of approval?

Conditional lending by the IMF is predicated, in part, on the belief that IMF programs are associated with increased capital inflows to participating countries. This belief is generally consistent with theoretical arguments in the academic literature (e.g., Bird and Rowlands 1997; Bordo et al. 2004) but the empirical literature often finds otherwise (e.g., Jensen 2004). This paper argues that the effect of IMF agreements on a country’s access to foreign direct investment (FDI) depends on its domestic institutions. Access to FDI depends on a country’s ability to credibly commit to implementation, and this ability varies systematically across regime type. The theory is empirically tested using a treatment effects model with a Markov transition in the treatment equation in a dataset covering 142 countries from 1976 to 2006. We find that in democracies IMF program participation has a strong positive effect on FDI inflows and in autocracies participation has a weak negative effect.     

Autopsy at 2 months after death: brain is satisfactorily preserved for neuropathology

Disclosure of neurological disorders by neuropathological examination may be one important aim of forensic autopsies. There are insufficient data on human brain tissue preservation after prolonged postmortem periods. Here, we describe neuropathological findings in a brain of a 77-year-old woman that was fixed at autopsy 2 months after death. The body had been stored in a cooling chamber at 3 degrees C temperature. Gross inspection of the brain was satisfactorily possible. Histomorphology was excellently preserved. Many histochemical and immunohistochemical stains allowed satisfactory neuropathological evaluation of brain tissue and the diagnosis of Alzheimer's disease. Nevertheless, some immunohistochemical stainings repeatedly yielded negative or suboptimal results. We conclude that neuropathological examination of human brain tissue extracted from the skull and fixed after prolonged body storage in a cool environment is feasible for forensic diagnosis of neurological disorders even several months after death. However, in such cases the significance of negative immunohistochemical staining results must be interpreted with caution.     

Green Light for PPP on German Motorways?

While public–private partnerships (PPPs) have surged worldwide since the 1990s, they have been met with growing skepticism during the last years. A recent revision of Germany’s constitutional rules on motorway construction and observations on the use of PPPs published by both the German and the European Courts of Auditors illustrate this new caution. These two examples fit into a general trend towards a revival of the public sector, which can be summarized under the cross-level umbrella term “publicization.” It would, however, be remiss to replace the uncritical euphoria that once surrounded privatization with a similarly undifferentiated euphoria regarding publicization. Rather, it is crucial to identify the most appropriate solution for the fulfilment of each public task from the “toolbox” of publicization on the one hand and privatization on the other hand in order to ensure the most effective completion of public functions.     

Liability in desensitization accidents

Deaths that occur during the course of desensitization treatment are regularly analyzed in penal or civil investigations. Abnormal activity of an allergenic extract may also be the cause of the incident, but it is difficult to prove. Today the burden of proof is being reversing in favor of the patient because the legal requirements for drug producers are more specific. Liability to injury and liability of the product are discussed with regard to the legal situation in the Federal Republic of Germany and in Austria. In any case, there is a considerable gray area regarding liability for incidents during desensitization treatment. Because safer medicines are required today, the author is proposing that the duty to notify be intensified by the requirement that mild systemic reactions also be reported to a central registry.     

Who Does It Better? Comparing Immigration Detention Facility Performance in an Intergovernmental and Intersectoral Context

Contracting for prison services has been a topic of discussion for decades. Absent from this discussion is the relationship between contracting for immigration detention and confinement quality, a topic that has gained relevance as the detained immigrant population recently surpassed 440,000 per year. Detaining immigrants presents unique challenges because of detainee characteristics, the performance standards governing facilities, and the intersectoral and intergovernmental arrangements used to manage detention facilities. This research conducts the first-known large-N study that evaluates the confinement quality of U.S. Immigration and Customs Enforcement's detention facilities to determine the effect, if any, of contracting on performance. The findings suggest that all detention facilities have deficiencies that threaten the well-being of detained immigrants, but, broadly, privately contracted detention facility environments are less safe and secure than their public counterparts. The authors use contracting theory to explain why this performance disparity might exist and conclude with a discussion of the practical implications of this research.     

Regional psychiatric boards in Israel: expectations and realities

As laid down by Israeli legislation, the Regional Psychiatric Board constitutes one of the chief instruments in the monitoring of compulsory hospitalization, of compulsory outpatient treatment and of the quality of all inpatient care of the mentally ill. This article presents the findings of a study into the working of these boards. Taking a sample of every second application (N=168) over a 6-month period to one of Israel's six existing Regional Psychiatric Boards, an examination was made of the decisions issued by the board and of other aspects of its functioning. Explanations for the findings of this analysis are suggested, and generalizing from these findings, recommendations are offered for the improvement of the future functioning of all six Boards.     

The Practice of One Ombudsman

This essay delineates the influences and constraints upon theauthor's practice as an ombuds in two different Canadian universities overmore than twenty years. My hope is that an account of my practice as itevolved day by day will help to shed light on the divergences in practiceamong particular groups of ombuds practitioners, notably government orlegislative ombudsmen; corporate ombudsmen; and academic ombudspersons inboth Canada and the United States.
